David J. Mitchell, a New York property developer trading as Mitchell Holdings LLC, is named in the instruments that would have governed Jeffrey Epstein’s estate. He is one of three Trustees of the Jeffrey E. Epstein 2013 Trust and of the 2014 Trust, and one of three Executors named in the will Epstein executed on 18 November 2014, in each case beside Epstein’s own attorney and a serving bank executive. He is also, through the decade before the arrest, the man running Epstein’s New York property book: a hotel on West 31st Street, a townhouse conversion on East 82nd Street, a floor-area study of Epstein’s own house on East 71st Street, and a rolling account of loans, deposits and lender negotiations reported back several times a week.
Three things printed in the investigation report on which this page was commissioned do not survive the documents. The report says Epstein wired him $580,500; the exhibit it cites puts his name in the payer column of a chart of money coming in, and the rows bearing his name total $526,500, the difference being a single row whose payer the producing party barred.4 The report quotes Epstein telling him “tomorow you must make money. clear that cascade will authorize the payments”; the sheet reads “tomorow you must make it clear that cascade will audit the=payments”.12 And the report presents a run of small March and April 2019 wires as a possible structuring pattern; the file records, in the parties’ own words, a $100,000 short-term advance that had gone overdue and a debtor saying he was selling jewellery to repay it.13 Nothing on this page is a finding of wrongdoing. He has been charged with nothing, and no document read for this page alleges that he knew of any offence.
Identification: two men called Mitchell, and the corpus puts them in one room
David J. Mitchell is not Senator George J. Mitchell. The release documents that distinction rather
than leaving it to be asserted. EFTA01755390 is a day sheet sent by [[people/lesley-groff|Lesley
Groff]] to Epstein on 5 November 2013, setting out the coming days in New York. Under
Wed. Nov. 6, 2013 it prints two appointments ninety minutes apart:

Both lines print w/ on the sheet. The extraction renders the second as Appt iv/, so a page
written from the text layer would have quoted a form that is not on the paper. Each of the two entries
is followed by a barred value.1
The surname alone reaches 11,046 documents and the full phrase reaches 8,429, so 2,617 documents
carry Mitchell without carrying David Mitchell. Those 2,617 were censused, not sampled: every
occurrence of the token in every one of them was located and classified by the words standing in front
of it. 2,570 yielded at least one locatable occurrence; 47 did not, because the tokenizer cannot reach
the string on those sheets.

A document is counted in every class its own occurrences carry, so these figures do not partition
the residue and must not be summed. The classes were then read rather than inferred from their
frequency. The largest single body is Joy E Mitchell, 215 documents, a name standing in the Cc
line of a Deutsche Bank internal distribution list. Nathanael J. Mitchell is an attorney whose
name stands beside Paul G. Cassell and [[people/brad-edwards|Bradley J.
Edwards]] on court filings. Mitchell A. Kline M.D. is a dermatologist, 48 documents. Levin
Middlebrooks Mabie Thomas Mayes Mitchell is a Florida law firm inside a repeated case citation.
Mitchell Bard is a columnist whose name recurs in a newsletter Epstein received. Zattia
Mitchell is a name in the Cc line of Epstein-office correspondence beside
Rich Kahn and Darren Indyke.14
And there is a contaminant inside the narrower phrase. "David J Mitchell" returns 300 documents,
of which only 129 are also in the 8,429: the middle initial breaks the phrase, so 171 documents are
reachable only through the longer form. One of the 171 is a newspaper page carrying the byline
“Bryn Stole and David J. Mitchell”, dated 30 July 2020. That is a journalist, and a third man of
the same name.14
Enumerating the index instead of guessing the misspellings
A table of misspellings somebody imagined and then probed cannot say what nobody
imagined. The forms below were taken out of the search index itself. An fts5vocab
table was built over the page index and twelve prefix ranges were walked, 76,295 index
terms in all, every term measured against mitchell for Levenshtein distance of two or
less, for consonant-skeleton equality, and for containment. 137 forms answered. The
largest of them by far are the Michel, Michelle and Michael family, which is a
different name and is excluded; what separates the rest is conjoining each with the
forename and reading what comes back.
Two whole-index passes over all 12.1 million terms were attempted first and NEITHER COMPLETED, one at a 3,500-second timeout and one killed, both while another job was reading the same database. An enumeration that did not finish is not a null, so nothing below rests on either of them; the bound on this table is the twelve named ranges, which did complete.

The union of the base with every form above is 8,633 documents, which is 204 more than
the phrase alone reaches. Two documents are reached by two of these forms each, which is
why the outside column sums to 206 and the union adds 204. All 204 were opened and the
matched passage read. 201 are this subject. The three that are not, disclosed rather
than counted out silently: two are a five-sheet spreadsheet headed First Name,
Last Name, Messaging ID, CIO Outlook, Tax Topics and Intermediary Client/Prospect, with Y flags down the columns, which prints the form and nothing else;
and one is an interview transcript in which a David Michell is discussed in a Florida
context this page cannot connect to him. Four further documents matched the index phrase
but their passage could not be located by a literal probe, and they are not counted as
his.9
And the enumeration paid for itself in one document. DAVID NIITCHELL, with the m
read as ni, occurs once in the whole release, on a Deutsche Bank statement, and no search
on any spelling of his name reaches it. That sheet is in the money section below.915
Two probes for a fault that is not a misspelling at all. The surname was searched broken
at every internal point, mi tchell through mitchel l, and run together with its
neighbours; and the forename likewise. The split forms are real but tiny: mitchel l
three documents, mitch ell four, mit chell one, mitche ll two, mi tchell none, and
of those only the mitchel l pair is him, carrying Epstein’s “my fried david mitchel l
will call you” of 6 December 2013. davidmitchell run together is one document.916
And a third fault, which is neither a misspelling nor a word break: the forename swallowed
by the word in front of it. The residue census produced the form wldavid, which is
w/David with the slash read as an l, and this page’s own residue footnote said in terms
that it defeats the phrase search. Naming a corruption and searching for it are two
different acts, and only the second one moves a count. wldavid alone returns 35 documents, most
of them other men, because the token is the abbreviation w/ run into whatever forename
follows: wlDavid Blaine, wlDavid Schulhof, wlDavid Stern, wlDavid Kralz and
wlDavid Fiszel all answer to it. Twenty-four of the 35 are this subject, nineteen
printing wlDavid Mitchell, four wlDavid Mitchelll and one wlDavid Mitchel, with no
document in more than one form. All twenty-four lie outside the 8,429 and outside every one
of the twenty-one forms the prefix walk produced, and they are what raises the union from
8,609 to 8,633.17
What the twenty-four are. Every one is a day sheet or a schedule message from
Lesley Groff’s desk to Epstein, entering him as an appointment; the
dated entries run from 16 January 2012 to 15 June 2017, and several sheets appear in two
or three copies. Twenty of the twenty-four are in the House Oversight production rather than
the EFTA release. One of them is another copy of the 6 November 2013 day sheet this page’s
identification section is built on, printing 9:OOam Appt wlDavid Mitchell above
10:30am Appt w/Senator George Mitchell: the two men ninety minutes apart, on a sheet whose
first entry no spelling of his name reaches.17
The instruments
An instrument naming a fiduciary is an act, and these name him four times over.
The 2013 Trust. EFTA00082247, nineteen sheets, opens: “THIS TRUST AGREEMENT (“Agreement”),
dated September 16, 2013, by and among JEFFREY E. EPSTEIN, as Grantor (“Grantor”), and DARREN K.
INDYKE, JAMES E. STALEY and DAVID MITCHELL, as Trustees (“Trustees”).” Its first article reserves to
Epstein alone the right to amend the agreement, to remove any Trustee, to revoke the trust and to
withdraw principal, each by written instrument; Section 1.2 lets the Trustee distribute principal to
Epstein at the Trustee’s discretion.18
The 2013 will. EFTA00016876 appoints Indyke, Joseph Pagano and Staley as Executors, and
continues: “If any one or more of my Executors fails to qualify or ceases to act, I appoint DAVID
MITCHELL as successor Executor.”19
The 2014 Trust. EFTA00082273, twenty-three sheets, is “dated November 18, 2014” and names the
same three Trustees.20
The 2014 will. EFTA00016884 is the controlling instrument, and its third article reads:
THIRD: A. I appoint DARREN K. INDYKE, DAVID MITCHELL and JAMES E. STALEY to be the Executors of this Will. If any one or more of my Executors fails to qualify or ceases to act, I appoint LAWRENCE H. SUMMERS as successor Executor. I authorize the last acting Executor to designate his successor as Executor.
Its first article directs that each Executor be paid “the sum of Two Hundred Fifty Thousand Dollars ($250,000) … upon the completion of probate”. Between 2013 and 2014 he moves from successor executor to named executor, displacing Pagano, while Lawrence H. Summers takes the successor slot.21
Two details on the face of the will that the extraction destroys. Its second article gives all property to the Trustees of a trust agreement “dated November ___, 2014”: the day is an empty printed rule, not a bar and not an omission, and the extraction closes the gap so that the sentence reads as though no day had ever been contemplated. And the execution clause reads “I have duly executed this Will the 18th day of November, 2014”, the day written in ink over the printed ordinal, with Epstein’s signature in black ink beneath it and the two witnesses’ in blue.21
He swore his acceptance separately, and late, both times. Each trust carries the trustees’
notarial acknowledgements on its closing sheets, and his is on a sheet of its own in both. The 2013
Trust is dated 16 September 2013 and his acknowledgement is sworn 4 November 2013, forty-nine days
later, before Harry I. Beller, with the identification blank left as an empty printed rule. The
2014 Trust is dated 18 November 2014; Indyke and Staley swear together on 26 November before one
notary, and he swears on 3 December before another, “who is personally known to me or who has
produced” the blank being filled in by hand with the words drivers license. The notary who took his 2014 oath is named in
the stamp as DOUGLAS BENTON ARNAUDIN. A Doug Arnaudin writes throughout this file from Mitchell
Holdings LLC, at Mitchell’s own addresses, and introduces himself to Indyke as “Doug Arnaudin from
David Mitchell’s office”. No sheet read for this page states that they are the same man, and this
page does not resolve it.2223
By August 2019 he had been moved down the line. The 1953 Trust, made as of 8 August 2019, two days before the death, names Indyke and Richard D. Kahn as Trustees and sets out a successor chain in which he is fifth, after Boris Nikolic, Barnaby Marsh, Anthony Barrett and Kathy Reummler. A successor’s appointment takes effect only when the successor signs an acceptance, and no acceptance signed by him has been located in this release, so nothing here says he ever became a trustee of that instrument.24
Mitchell Holdings LLC, and why 4,489 documents are not 4,489 acts
His messages close with a block set in small capitals: DAVID MITCHELL over Mitchell Holdings
LLC over a Manhattan street address. 4,489 of the 8,429 documents, 53%, carry the string
MITCHELL HOLDINGS. That figure measures nothing he did. A signature block reproduces in every
message that quotes him, in every forward of such a message, and in every duplicate scan of both:
2,120 of the 4,489 are not his own under the sender rule below, their sender being somebody
else or barred.7
The block’s street line dates it, and the line moves four times across the decade. Conjoining
"MITCHELL HOLDINGS LLC" with each address gives 41 East 60th Street 242 documents, 815 Fifth
Avenue 659, 801 Madison Avenue 1,278, 745 Fifth Avenue 1,142, which is 3,321 of the 4,489; the
remaining 1,168 carry the block with no parsable street line, the line having been cut off, barred or
damaged in the scan.7
How much of the file is his own writing
The rule and both of its label sets are printed here in full, because a rule whose most consequential parameter lives somewhere else is not a rule. A reader who follows only what is on this page reaches 2,756. For each of the 8,429 documents take the document’s own first sheet, the row with the lowest page number for that identifier, and its first sixteen non-blank lines.
The sender labels are these sixteen, the set carried by scripts/act_rate.py, which covers the
damaged renderings of From: this extraction produces: From, Fromm, Fran, Front, Frorn,
Frnm, Fram, Fnxn, Frm, Fron, Erom, Frcrn, Ftom, Fiom, Fm, Sender. The header
labels, used for nothing but the decline test, are those sixteen plus these nine: To, Cc,
Bcc, Ta, Tc, Sent, Date, Subject, Subj. A label matches when the line, after any
leading space, begins with those characters, case-insensitively, followed by optional space and an
optional colon, semicolon or full stop; no word boundary is required after the label, and the
alternatives are tried longest first so that Fromm is not read as From.
Find the first line in the window matching a sender label. The sender value is the remainder of that
line if it is non-empty; otherwise the next non-blank line, unless that line itself begins with a
header label, in which case the value is absent and the document is declined. Only the first
sender label is used, so a quoted header further down the sheet can never supply the sender. The
value carries his name if it contains, case-insensitively, mitchell, or djm as a whole word.

129 distinct sender values carry the name, the commonest being David Mitchell (1,703),
David Mitchell < (437), David Mitchell. (179) and "David Mitchell" (155). The decline set
earns its place on sixteen documents. Sixteen sheets in the 8,429 carry an empty sender label
whose next non-blank line begins Subject, among them Subject Alert - 5:00pm Appt w/David Mitchell and Subject Alert - 2:15pm David Mitchell. Those lines carry his name, so a rule with a
narrower decline set counts all sixteen as things he sent; under the set printed above every one of
them is declined instead, and lands in the barred-or-blank bucket.10
2,756 documents are not 2,756 messages. Three top-level stamp shapes occur on these first sheets
and they are not comparable until they are normalised, so a naive key counts one message up to three
times: an RFC form printing its own offset (1,165), a bare written-out form (986) and a bare numeric
form (457). The stamp is taken from the same window by the same shape of rule as the sender: the
first line beginning Sent or Date, its value inline or, if the label stands alone, on the next
non-blank line unless that line is itself a header label. Reading the bare forms as UTC and
converting the zoned form by its printed offset, 2,608 of the 2,756 yield a parsable stamp and
those resolve to 1,804 distinct minutes; 611 of those minutes are shared by 1,415 documents between
them. 148 documents yield no parsable stamp, 40 because no stamp label or value stands in the
window and 108 because the value is too damaged to read. So the 2,756 documents are between 1,804
and 1,952 distinct messages. The normalisation was controlled by opening a run rather than trusting
the arithmetic: five documents land on 2011-08-15 16:50 in all three export shapes and a sixth
carries the same message with no parsable stamp at all, and all six carry the same eleven-word
message.11
When he writes, over the 1,804 stamped messages: 2009 three, 2010 thirty-nine, 2011 one hundred and sixty-five, 2012 one hundred and ten, 2013 one hundred and thirty-seven, 2014 two hundred and seven, 2015 one hundred and eighteen, 2016 one hundred and six, 2017 three hundred and sixty-six, 2018 four hundred and thirty-three, 2019 one hundred and twenty. The correspondence runs a decade and its peak is its last two full years.11
The money, and which way it ran
EFTA00027019 is the document the investigation report treats as its payment ledger: nine sheets of
Deutsche Bank transaction tables compiled for the [[entities/southern-district-of-new-york|Southern
District of New York]], set out as five exhibits. His name occurs on two sheets, both inside
Exhibit C: Capitalization of Jeffrey Epstein’s Now/SuperNow Accounts.
The exhibit’s five columns are headed Date, Payer, Recipient, Amount and Bates number, and his name stands in the Payer column. On Exhibit A of the same document the recipient column prints in the clear; on Exhibit C every recipient cell is barred, and the exhibit’s own sixth footnote says why, that column holding the account number. The fifth footnote states what the table is: “According to KYC records, Jeffrey Epstein used the Now/SuperNow accounts (also referred to as “Elite Checking with Interest”) for his “personal daily use.” … The attached chart reflects incoming wire transfers from Deutsche Bank brokerage accounts and accounts held at third party financial institutions.”4
So the exhibit records money going into Epstein’s personal spending account, not out of it. The
report’s “direct recipient of at least $580,500 in verified wire transfers from Epstein’s Deutsche
Bank accounts” has the direction reversed. Fourteen rows carry his name and they total $526,500,
running from 30 March 2018 to 12 April 2019. The remaining $54,000 of the report’s figure is a single
row of 2 April 2019 which sits between two of his and whose payer cell is barred. The report does
not put a name in that cell either: it prints the cell as “(Mitchell context)”. What it does is
enter the row in a table it heads Recipient and fold the $54,000 into a subtotal it calls his.
This page names nobody for that row, gives nobody a role in it, and counts it in no total.4
The other direction is documented too, in the parties’ own words
Money moved both ways, and the outbound leg ran through Richard Kahn of HBRK Associates Inc.

David mitchell: “please confirm that i should send david 85,000 wire today”. Epstein: “yes”.26 - 1 February 2019. Mitchell to Kahn: “Spoke with Jeff this morning and very kindly has agreed to help me with a short term advance of $100,000 which will paid back between the 15 th or the 18th / Please let me know once you have wired so I can track and let you know when it is received”.13
That last one can be watched leaving the account. Epstein’s Deutsche Bank statement for February
2019, for the “Elite Checking With Interest” account which is the same account Exhibit C calls
NOW/SuperNOW, opens its transaction detail with a single line for the first of the month:

taking the balance from $3,638,482.16 to $3,538,482.16. The sheet prints his name in the clear;
the extraction reads it DAVID NIITCHELL, which is why no search on his name reaches it.15
That last one has a sequel, and it is the answer to the report’s structuring theory. The thread’s
subject line is Loan repayment. On 12 February Kahn asks “please advise if this will occur on
friday as originally mentioned in your email below”. On 13 February he writes “david i would
appreciate a reply to my email”, and Mitchell answers “working on getting it by the week end , will
know for sure this afternoon”. On 25 February Kahn writes “still waiting to hear when you will be
repaying 100,000 which is overdue.. / please advise”. On the morning of 26 February Mitchell replies
“it is overdue / I am selling some jewelry pieces and look to get paid this week for them”, and nine
minutes later Kahn forwards the entire exchange to Epstein.13
Seven days after that, on 5 March 2019, Exhibit C records three wires from him into Epstein’s account on one day, of $25,000, $14,000 and $4,000, followed by $5,500 on 18 March, $3,000 on 1 April, $7,800 on 11 April and $2,200 on 12 April. The page does not assert that those are the repayment. No document read for this page ties a particular wire to a particular advance, and the bank exhibit carries no instruction field. What the file does establish is that the parties were running a two-way account, with sums going out as short-term advances and coming back as wires, and that the small fragmented payments fall at the end of a documented chase for an overdue loan. Whether that sequence explains them is a reading, and it is this desk’s; the file does not say so.413
A second bank, and a suspicious-activity report
EFTA00151554 is a FinCEN BSAR transcript filed on 19 July 2019, thirteen days after Epstein’s
arrest, by FIRSTBANK PUERTO RICO. Its four named subjects are Jeffrey E. Epstein, F T Real Estate
Inc, Laurel Inc and Michelles Transportation Company LLC. He is not one of
them. He appears once, in the narrative:
two (2) incoming funds wire transfers were processed for $840,000.00. According to our system applications both transactions were originated by David J. Mitchell with address at ▮ USA. No instructions or details were included.
The analyst then records an attempt to work out who that is5: “We performed a search on internet and was found a possible match with David J. Mitchell; Chief Executive Officer and President of CenterPoint Corp. since January 24, 2002 … He has been Managing Partner of Las Vegas Land Partners LLC since June 2004.” That biography belongs to neither the subject of this page nor the Senator; it is a fourth man of the same name. The bank’s own word for it is “a possible match”.
The report concludes: “we will file a Suspicious Activity Report (SAR) totaling $1,740,000.00 … The period on which the suspicious activity was processed was from June 25, 2018 to March 29, 2019.” The structured block gives the grounds as suspicious wire transfers, source of funds, use of multiple accounts, transactions out of pattern, and “Transaction with no apparent economic, business, or lawful purpose”. The $840,000 is not among the Exhibit C sums, which are a different bank; and the SAR window falls inside the window of the Exhibit C rows. What the two records share is a shape: substantial sums arriving in Epstein accounts under that name, with nothing on the face of either record saying what they were for. Whether the name on the FirstBank wires is his is exactly what this page declines to decide, below. Account numbers on those sheets are not reproduced here.5
The property book
The correspondence is a working account of Epstein’s New York real estate, and it is specific.
2010, an acquisition. On 8 August 2010 he writes: “I think at max 2.20 (with 3 cent leeway) we
get the whole thing / They are holding at 2.50 / Need to go back firm to get them to move / What say
you”. Epstein answers “doesn;‘t tel me anything.. is this your 51% or your partial , who is the
they?” and he replies: “This is for 51 percent / 5-6 groups that make up the 51 percent , depending
how you count / Working on the Proxy route as an option as well but that looks like 2.50 and bit more
complicated as the Vicis wants a board seat”. The target is not named on the sheet and this page
does not supply one. His block at that date reads 41 East 60th Street, 6th Floor.6
2012, a proof of funds. On 15 May 2012: “Dear Jeff / The seller is getting edgy on me and I need to produce this proof funds letter Was the last edition ,ok I would be very thankful if you send it back to me ,I have a noon deadline set by them”. Epstein’s reply, copying Indyke, is “Yes”. A proof-of-funds letter shows a seller that the buyer has the money; the sheet does not say whose money it was, and this page does not infer it.27
2013, Epstein’s own house. On 26 June 2013 he forwards Epstein a zoning study of 9 East 71 Street prepared inside his own office, headed “Ratio of Building SF to Lot SF (FAR)” and giving “Max allowed FAR 4 / FAR as built 3.68 / Maximum usable floor area 20,432 / Usable floor area 18,797”, beneath the question “What is an R8B Zoning District?”. The measurement says the house was built below what the zoning allowed. Nothing read for this page records any application, filing or work following it.28
2017, the Life Hotel. The largest single run in the file is an eleven-sheet chain of 5 November 2017 about the Life Hotel at 19 West 31st Street, forwarded to Epstein the same evening. It carries the closing statement of a $3,500,000 CREDS loan as preferred equity, with fees deducted to $3,393,000 net and a good-faith deposit added back to $3,408,000, distributed to Katsky Korins ($98,000), Arnold & Porter ($30,000), Muchnick, Golieb & Golieb ($25,000) and Life Hotel Pref LLC ($3,236,367.70). Around the statement is a quarrel with the restaurateur Stephen Hanson. Hanson: “seems like another of your stall tactics that I have seen you do with the contractors … I think it best I respond to you through lawyers as it seems I will not be able to proceed for lack of funding … Let’s hear your separation plan on Monday”. Mitchell answers in capitals: “MOST IMPORTANT TWO FACTS ARE: 1.WE NEED TO CLOSE OUT CONSTRUCTION AND GET A TCO SO THAT BOTH OF US ARE OFF ANY CONSTUCTION GUARANTEE FOR COMPLETION 2. MAKE THE FUNDS AVAILABLE FOR THE RESTAURANT WORK AS THERE IS NO OTHER SOURCE OF FUNDING AND EVERY DOLLAR IS ACCOUNTED FOR IN DETAIL”, and earlier: “Money is set aside and ready to be released pending a fairly simple outline that gives detail to your budget what is required”.29
Hanson’s complaint about him goes further than that, and his answer sits beside it. In a September 2016 message to his own side Hanson writes “Punch line for me is I knew davids $ was bs +high on hotel so I low balled the restaurant - so we can actually meet these net $ projections”, an allegation that Mitchell’s hotel numbers were inflated. Nothing read for this page records Mitchell being shown that message or answering it; what the file holds instead is the capital stack his own office supplied in the same exchange, which the sheet sets out as a total of $58,000,000 over a senior loan of $28,249,398, a building loan, a project loan and $22,000,000 of equity.30
2019, East 82nd Street, and a denial. On 2 March 2019 Epstein writes: “i dont know the carrying costs on 82 . but even if you found the 10m to servie it would cost 500 -600 k per year. minmum . plus taxes condo etc. i have no problem with you dragging it out making some income. for yourself and wife. . but I ask again that nnumbers give to me be as accurate as possible”. The answer is a denial of the premise: “Understood / There is no income opportunity for me or my wife in this , never has been / The only reason I would do this would be to have a chance ( all be it long term) to return capital to the investors versus letting bank sell this out at this point in the market”. Epstein’s next message reads “hopeless. not worth your time just look at the real numbers. its easy . 19m debt. plus interst , carrying etc.”2
What a working day looked like. On 2 January 2019, answering Epstein’s two-word “hny status , ?”, he files a headed report copied to Richard Kahn: “COOP / Power Mortgage Bank sending loan documents and note / First Republic that was going to modify Heloc ( home equity line ) last week , can’t get my contact today / Art / Reserve on Hercules is still in place / 320 / Two contracts out on 320 , one will have deposit on the 7th / We have not gotten comments on the other / Hotel / nothing to report today”.31
“cascade will audit the=payments”
The investigation report’s headline document is a single-sheet message of 7 November 2017, 12:51 AM, from Epstein to him. The report quotes it as “tomorow you must make money. clear that cascade will authorize the payments. do you have another idea for who can hold the […]” and builds an authorisation chain on it. Read at the image, the sheet prints:12
tomorow you must make it clear that cascade will audit the=payments. . do you have another idea for who can hold the mone=. ?
The report’s “make money” is “make it clear” on the sheet, and its “authorize” is
“audit”.12 An audit is a check after the
event and an authorisation is a gate before it, so the two readings point in opposite directions. The
= characters are quoted-printable damage on the face of the sheet, not an artefact of the
extraction, and are reproduced here unrepaired.12
The word was censused across the whole corpus rather than sampled. cascade returns 487
documents, overwhelmingly company names: the commonest neighbouring tokens the census returns are
Boise, Lone and fitness in front of it and lp, body and investment behind it. Twelve of
the 487 also carry "David Mitchell", and they are three distinct messages and one conference list,
not the single occurrence the report describes: the 7 November message in four copies; an exchange
four days later reading “Not from m cascade” in four copies; a message reading “but i dont knowt the
cascade papers it liens etc.”; and a 1994 to 1995 conference itinerary listing Boise Cascade.12
The corpus does hold an entity of that name, and this page declines to join them. "Cascade Investment" returns 21 documents, none of which carries "David Mitchell": a draft letter agreement
between an entity of Boris Nikolic and Cascade Investment, LLC; a bgC3
services description listing Cascade Investment, L.L.C. among an owner’s affiliates; Schrodinger board
minutes recording that its consent would be required; and a bank client list. No document read for
this page connects Epstein’s lower-case “cascade” of 7 November 2017 to Cascade Investment, LLC or to
any other named entity, and this page does not assert that it has been identified. The forms
searched were "Cascade LLC", "Cascade Capital", "Cascade Partners", "Cascade Fund" and
"Cascade Group", each returning nothing, and "Cascade Investment" and "Cascade Investments",
returning 21 and 3.12
What this page does not establish
It does not establish that he acted. Being named executor and trustee is an appointment, not
conduct. The test was written before it was run, on the principle that a document recording a step
in an estate administration would use the vocabulary of one: searches of the full-text index for
Mitchell conjoined with "letters testamentary", renounce and "co-executor" return nothing;
with surrogate, two documents, neither an estate filing; and with probate, fourteen
documents, every one of them a copy of one of the wills or trusts already cited here. So nothing
read for this page records him signing an acceptance, taking a step in any probate, or receiving the
$250,000 the will provides for.
It does not establish what any of the money was for. Exhibit C carries no instruction field on any row, and the FirstBank narrative says in terms that “No instructions or details were included”.5 The three advances are described in the file as advances, and the Loan repayment thread is the only one whose outcome the file follows.
It does not identify the man the FirstBank analyst was looking for, and it does not assert that the David J. Mitchell named as originator there is the subject of this page. The overlap is a name and a date range; the sheet itself offers only “a possible match”, and to a different biography.5
It does not resolve whether the notary who took his 2014 trust oath is the Doug Arnaudin who worked in his office, and no page on this wiki should be read as having done so.
