Daphne Louise Wallace, who signed her messages “Daphne” and her notarial certificates “Daphne Louise Wallace” and “Daphne L. Wallace”, worked in Jeffrey Epstein’s St. Thomas office and held a commission as a notary public for the St. Thomas/St. John district of the U.S. Virgin Islands. Her file in the released documents is very large and most of it is office traffic. What separates it from office traffic is a second capacity: for at least six years she was the officer before whom Epstein and his trustees swore and acknowledged the instruments by which his Virgin Islands property was conveyed, his trusts were constituted, his litigation was settled and his island construction was permitted. Her notarial jurat is on the affidavit that claimed a stamp-tax exemption on the transfer of Little St. James; on a trustee’s oath under Epstein’s 2013 trust; and on Epstein’s sworn statement of legal interest in Great St. James, filed with the territorial government in support of a development permit.423

Alongside that she was the office’s working channel to the Virgin Islands Department of Planning and Natural Resources and its Division of Coastal Zone Management, reporting the movement of permits to Epstein directly and in her own name.10 In August 2018 the Southern District of New York docket recorded that service of a summons and complaint on Financial Trust Company had been accepted by her.8

Nothing read for this page shows her setting policy, approving a payment or deciding anything. What it shows is an officer of the territory, employed by the subject of the instruments she attested, applying her seal to them.

The plain form therefore understates the union by 42 documents, or 0.37 per cent. The two middle-name forms are disjoint from the plain form rather than contained in it, which is the ordinary behaviour of this index: the phrase "Daphne Wallace" cannot match a string with a middle name between the two words. They are small in number and large in weight, because the formal instruments are where a notary writes her full name. The corpus tokeniser splits on the comma, so "Wallace, Daphne" and "Wallace Daphne" are one query and not two.9

Neither bare token can be used as a key. "Daphne" reaches 15,684 documents, 4,244 of them outside the union, and at least two other people of that forename appear in this release: a Deutsche Bank branch manager and director, and a lawyer at a New York firm. "Wallace" reaches 12,640, of which 1,200 lie outside the union and include at least four unrelated surnames in the sender field of the email index.911

On the act test: the email index records 5,694 messages across 4,426 documents sent under the exact sender value Daphne Wallace, and 4,674 documents once the index’s damaged renderings of the same name are added. Against the 11,398 documents that name her, that is a rate of 38.8 per cent on the base form and 40.9 per cent against the union; against the 1,106,822 documents in the release that carry any parsed sender at all, it is 0.40 per cent.11 Both denominators are given because neither answers the question alone: the first says she wrote a large share of her own file, the second says nothing about whether what she wrote matters. The documents that matter most on this page have no sender field at all. They are deeds, affidavits, a trust agreement and a permit application.

The St. Thomas office

The only statement of her title read for this page comes from outside the office. On October 22, 2015 the Jaredian Design Group, “Architects, Engineers and Construction Managers” of St. Thomas, addressed a letter to “Daphne Wallace, Executive Assistant / Southern Financial Trust / 6100 Red Hook Quarter, Suite B3 / St. Thomas, U. S. Virgin Islands 00802”.1 That is the address the release gives for Epstein’s Virgin Islands administration. “Southern Financial Trust” is the sender’s own rendering; the release names a Southern Trust Company, Inc. and a Southern Financial, LLC at that address, and this desk has not found an entity of the exact name the letter uses.

The letter is also a record of an act of hers. It opens: “I was extremely disappointed with your email this morning regarding Mr. Epstein’s refusal to pay Jaredian’s invoice no. 15-001.4, dated September 22, 2015 for the Generator, R.O. & Maintenance Buildings.”1 The refusal is Epstein’s; the communication of it was hers, and the architect’s letter is the document recording that she made it. The same letter sets out the permit history of the island construction in the architect’s own words, and that history is the second half of this page.

The notary

December 21, 2011: the stamp-tax exemption on Little St. James

An affidavit headed with the venue of the Territory of the U.S. Virgin Islands, Division of St. Thomas/St. John, recites:

On this 21st day of December, 2011, personally appeared Jeffrey E. Epstein, who as the President and the sole beneficial owner of Nautilus, Inc., a U.S. Virgin Islands corporation, and the sole member of L.S.J., LLC, hereby on oath asserts that, pursuant to 33 V.I.C. §128(a)(6), Section 8, Nautilus, Inc. and L.S.J., LLC are entitled to an exemption from the payment of stamp taxes, in that, the conveyance by L.S.J., LLC to Nautilus, Inc., pursuant to that certain Warranty Deed of even date, of all of L.S.J., LLC’s rights, title, and interest in Little St. James Island, 6B Red Hook Quarter, St. Thomas, United States Virgin Islands is a conveyance, for no consideration, between subsidiary entities, all beneficially owned by Jeffrey E. Epstein.4

Epstein signed over a printed block giving him as “President and sole beneficial owner, Nautilus, Inc.” and “Sole member, L.S.J., LLC”, above two witness signatures. Beneath that: “Subscribed and Sworn before me this 21st day of December, 2011”, signed by her and struck with her seal.4 A hand entry lower on the sheet gives a “Value for Recording Purposes” of $6,442,100.00.4 The recorder’s stamp on the same sheet is dated December 30, 2011.4

The transfer of the island from L.S.J., LLC to Nautilus, Inc., and the corporate reorganisation around it, are set out on those pages. What this sheet adds is the mechanism by which the transfer paid no stamp tax: a sworn assertion by Epstein of an exemption under territorial law, taken by a notary on his own staff.

March 9, 2012: a bill of sale

A one-page “BILL OF SALE & AGREEMENT” between “LSJ Employees, LLC” as seller and a named individual as buyer transfers a 2000 Mack MS300 truck for $1,000, and recites that the buyer will be transported to Little St. James and the equipment to Red Hook Marina.5 Her notarial block is signed and sealed at the foot. On the copy in the release the “Seller” and “Buyer” signature lines are blank; only the notary line carries a mark.5 A later executed copy may exist and has not been found; this page does not assert that the instrument was or was not signed by the parties. The buyer is a private individual and is not named here.

October 3, 2013: a trustee’s oath on the Jeffrey E. Epstein 2013 Trust

The instrument is “THE JEFFREY E. EPSTEIN 2013 TRUST”, a trust agreement dated September 16, 2013 “by and among JEFFREY E. EPSTEIN, as Grantor (‘Grantor’), and DARREN K. INDYKE, JAMES E. STALEY and DAVID MITCHELL, as Trustees (‘Trustees’)”.12 Its execution sheet carries two separate jurats, taken in two jurisdictions six weeks apart.

On the upper block, the preprinted words “STATE OF NEW YORK” and “COUNTY OF NEW YORK” are struck through by hand and replaced, also by hand, with “TERRITORY OF THE UNITED STATES VIRGIN ISLANDS” and “DIVISION OF ST. THOMAS & ST. JOHN”. The certificate then reads that the instrument “was subscribed and sworn to before me this 3rd day of October, 2013, by DARREN K. INDYKE, a Trustee, who is personally known to me or who has produced ______ as identification”, and is signed and sealed by her.2

The lower block on the same sheet is a New York jurat: the instrument “was subscribed and sworn to before me this 20 day of November, 2013, by JAMES E. STALEY, a Trustee”, taken by Harry I. Beller, a New York notary.2 She did not take Staley’s oath and Beller did not take Indyke’s. The two trustees swore in different places nearly seven weeks apart, and the trust agreement is dated before either of them.

May 14, 2014: an acknowledgment on a settlement agreement

A sheet headed “ACKNOWLEDGMENTS / For: JEFFREY EPSTEIN” certifies that “On the 14th day of May in the year 2014 before me, the undersigned, personally appeared JEFFREY EPSTEIN, personally known to me or proved to me on the basis of satisfactory evidence to be the individual whose name is subscribed to the within instrument and acknowledged to me that he executed the same in his individual capacity”.6 It carries her signature and her seal. The venue lines above it are blank.6

The instrument it closes is a “SETTLEMENT AGREEMENT AND GENERAL RELEASE” dated as of May 15, 2014, made between Jeffrey Epstein, “Island Global Yachting Facilities Ltd., a Cayman Islands exempted company”, and others.13 Epstein’s acknowledgment is therefore dated the day before the agreement’s own stated date.

July 31, 2015: a Florida litigation paper acknowledged in St. Thomas

A notarial certificate on a “Notice of Serving Expert Interrogatories / Regarding Motion for Appellate Attorney’s Fees” certifies that “The foregoing instrument was acknowledged before me this 31st day of July, 2015, by JEFFREY EPSTEIN, who is personally known to me”.7 The printed venue reads “STATE OF” and “COUNTY OF” and the printed notary line reads “NOTARY PUBLIC, State of Florida”; on this sheet all three are struck through by hand and replaced with “Territory of the United States Virgin Islands” and “Division of St. Thomas and St. John”.7 The certificate is signed, sealed and stamped. The case caption at the head of the sheet is barred on the copy cited, and nothing about the party behind that bar is recovered, inferred or reproduced here.

The identifier holding that sheet is a mixed run of twenty-one pages whose own first page is a Fifteenth Judicial Circuit filing in a different case, Jeffrey Epstein v. Scott Rothstein and others, e-filed July 31, 2015.14 The sheet cited here is page 13 of that run and is cited as page 13 for that reason.

The most consequential of the six. The sheet is Form L&WD-5, “PROOF OF LEGAL INTEREST”, of the Government of the Virgin Islands Department of Planning and Natural Resources.3 It sits inside a development permit application package whose first page is Form L&WD-2.15 The affidavit is completed in manuscript:

I, Jeffrey Epstein, being duly sworn depose and say that: 1. I am the ☒ Record title owner (fee simple) … of the real property described as Parcel No(s) Remainder C-1, Estate Great St. James Cay, Quarter 6A Red Hook, Island St. Thomas … 2. I have the irrevocable approvals, permission, or power of attorney from all other persons with a legal interest in the property to undertake the work proposed in the permit application3

Beneath it, in her hand: “The foregoing instrument was acknowledged before me this 14th day of July 2017 by JEFFREY EPSTEIN at ST. THOMAS county of VIRGIN ISLANDS”, over her signature and her seal.3

This is the document that put Epstein’s sworn word in front of the territorial regulator on the question of who owned Great St. James and what he was entitled to build on it. The regulatory history of that island, including the 2016 cease and desist order and the $280,000 notice of violation, is on its own page. Her name does not appear there, and this is the connection between the two records.

The two commissions

The stamps she used fall into two periods. The earlier one prints her name in full as “Daphne Louise Wallace” with a commission expiring January 6, 2014; the later one prints “DAPHNE L. WALLACE” with a commission expiring December 21, 2017. Both give her district as “St.Thomas/St. John, USVI District”.23 The July 2017 acknowledgment on the Great St. James affidavit falls five months inside the later commission’s expiry.

The permit channel

The Jaredian letter of October 22, 2015 describes, to her, how the island’s permits had been obtained:

The Jaredian Design Group has performed exceptional services for Little Saint James (LSJ) from the beginning, particularly as it relates to permit requests to the Division of Coastal Zone Management (CZM). In 2014, we applied for, and received, a Minor Permit for the paving of all of the roadways on LSJ. You will recall that CZM initially wanted LSJ to apply for a Major Permit, which would have required a public hearing. Then, on May 5, 2015, we were able to successfully negotiate a Permit Modification for the Generator & R.O. Buildings, and a Minor Permit for the Maintenance Building with CZM. This was not a small feat as Director J.P. Oriol initially felt the Maintenance Building should have been a Major Permit.1

The architect is describing the avoidance of a public hearing as a professional achievement, and is describing it to her. That is the architect’s account and it is his own advocacy in a fee dispute; it is reproduced here as what he wrote, not as a finding about what the Division decided or why.

Her own side of the channel is documented. On April 16, 2018 at 5:00 p.m. she wrote to Epstein:

Greetings Sir,

John Woods called today. P=ul Kalloo has left CZM - he is now working with John at Jaredian. He=wanted to make sure that you are aware, and to see if anyone had reached o=t to inquire on the status of your two GSJ Minor Permits for Remainders A =nd C-1.

Per John, the permit reviews are complete=, approved and are now awaiting signature - pending a site visit. Si=ce Paul is no longer in the department, he does not want the permits to fa=l through the cracks. John also said JP Oriole may decide to conduct=the site visit himself.

The stray = characters are on the sheet itself, not introduced here: the message was produced with its quoted-printable encoding unresolved, so a soft line break appears as an equals sign inside words. Read as intended the damaged words are “Paul”, “He wanted”, “reached out”, “A and C-1”, “complete”, “Since”, “fall”, “conduct the” and “Erik”. The spelling “JP Oriole” is the sheet’s, not this page’s; the Division’s director is named “Jean-Pierre L. Oriol” elsewhere in the release.10

Epstein’s reply, at 9:01 p.m. the same evening, is one word: “no”.10

Three things are in that exchange. The permits are the two Great St. James parcels, Remainders A and C-1, and C-1 is the parcel named in the affidavit she had notarised nine months earlier.3 The regulator’s officer who had been handling them, Paul Kalloo, had left the Division of Coastal Zone Management and gone to work for Epstein’s own architects, and it was the architects who passed that news to Epstein’s office. And she asked her employer whether to press the regulator for a status, and was told not to.

A separate message of August 12, 2015 shows how the site meetings were run. It is from Leighton Allenby, copied to Richard Kahn, Anna Rodriquez, Wallace and himself, and reports to Epstein on a meeting that day with David Rosa of CZM and a representative of the Jaredian Design Group about “Layout of the proposed maintenance and workshop building” and “Two roofs for the RO Plant and Generator building”.16 Her part in it is recorded in the message’s own item 8: “Daphne gave me a set of drawings that I will review.”16 The message is Allenby’s; nothing in it is hers beyond that line.

Service of process, 2018

On September 4, 2018 the CM/ECF system of the U.S. District Court for the Southern District of New York generated a Notice of Electronic Filing in Gerber et al v. The Financial Trust Company et al, No. 1:18-cv-07580-JPO, recording document 13:

AFFIDAVIT OF SERVICE of Summons and Complaint. The Financial Trust Company served on 8/29/2018, answer due 9/19/2018. Service was accepted by Daphne L. Wallace. Service was made by Mail. Document filed by Marvin Gerber; Kalma Koenig.8

That case, a putative class action brought by two Towers Financial noteholders against The Financial Trust Company and Epstein, is described at Towers Financial Corporation and at Bennet J. Moskowitz, who defended it. Neither of those pages records who received the process. The docket says she did, at the Virgin Islands office, by mail.

What this page does not establish

The material read for this page does not show what she knew about anything other than property, permits, payments and process. No document read here places her in any part of the record concerning Epstein’s offences, and none is asserted.

Her notarial file is certainly larger than six instruments. Only three documents in the release carry the string “Daphne Louise Wallace” and only fifteen carry “Daphne L Wallace”, and the reason is visible on the sheets: her name is handwriting and a rubber stamp, which the extraction reads badly or not at all. On one of the six instruments cited here the extraction renders her printed name as a different forename and a different middle name entirely, so that document is reachable by no search for her at all.17 The count of her notarisations in this release is therefore a floor of six and cannot be bounded above by any text search. Finding the rest would mean reading the execution pages of every Epstein Virgin Islands instrument in the release, which has not been done.

Two further limits. The email index’s derived year field is unreliable outside roughly 2012 to 2019, so the earliest and latest sender rows attributed to her there are not relied on and no first or last date is claimed from them. And a seventh capacity is visible and not pursued: her name appears on employment tax forms and on a bank register in the release, which would bear on what she was paid and by which entity, and none of that is set out here.

Epstein’s reply is the single word “no” and is quoted whole. Two divergences between the image and this desk’s extraction are recorded so that the quotation above is not “corrected” by a later reader: the extraction interleaves the line > wrote: between “Greetings Sir,” and “John Woods called today”, which is a reordering and not a gap in the message; and where the image reads P=ul Kalloo the extraction reads Prul Kalloo, the equals sign having been resolved into the letter r to make a plausible misspelling of a real person’s name.
