The Haze Trust is a trust Jeffrey Epstein settled on himself in February 1999, naming himself as both grantor and trustee and himself as the person for whose benefit the property was to be held.3 What makes it worth a page is how much of its life the release holds: the instrument, the 2007 addition of a second trustee, a bank’s due diligence file on it, that bank’s decision to exit it, a second bank’s onboarding of it, a balance of $41,108,732.17 in June 2016, and the instruction that ordered its account closed.34131210614
This page is about the instrument and the institutions that handled it. The trust’s beneficiary is its own grantor, so nothing here identifies a private beneficiary; where a bank record enters somebody else against a beneficiary field, this page reports the entry and does not resolve it. Appearing in these documents is not evidence of wrongdoing by any person named here.
The instrument
The agreement is seven printed pages, a schedule, an acknowledgment page and two 2007 instruments, and the release holds it several times over. Its first line is printed as “TRUST AGREEMENT dated”, then a run of blank space, then ”, 199”, then more blank space, then ”, between JEFFREY E. EPSTEIN, as Grantor, and JEFFREY E. EPSTEIN, as Trustee.” Into those blanks a hand has written the month, the day and the year’s last digit, in strokes that vary in weight and sit off the printed baseline; the date they make is the February 9, 1999 that both 2007 instruments recite in machine print.34
What the trustee was to do with the property is Article FIRST. He is to “retain such property, IN TRUST”, and:
(i)To pay any part or all of the income and such sums from or any part or all of the principal of the Trust as the Trustee, in his discretion, from time to time determines for any reason whatsoever to, for, or on behalf of the Grantor. Any income not so paid shall annually be added to the principal. (ii)On the death of the Grantor, to dispose of the remaining income and principal of the Trust, including any property received by the Trust as a result of the Grantor’s death to the estate of the Grantor.3
Article EIGHTH keeps the whole arrangement in the grantor’s hands while he lives: “The Grantor retains the right at any time or times during his life to revoke, in whole or in part, this Agreement and the Trust created hereunder and to receive a portion or the entire income and principal,” and a matching right to amend, exercisable “by a written and acknowledged instrument”, personal to him and not exercisable by any guardian, conservator or committee on his behalf. The trust becomes irrevocable and unamendable only on his death.151
Article NINTH puts it under New York law; Article TENTH provides that the agreement and trust “may be referred to as The Haze Trust”, and it is that clause, rather than any party’s name, that gives the trust the name the banks used.1 The property transferred to the trustee is described in Schedule A. That sheet carries the heading and the figure “$100.00” and nothing else.8
Below the closing words of Article TENTH, a pen stroke crosses each of two rules, captioned “JEFFREY E. EPSTEIN, Grantor” and “JEFFREY E. EPSTEIN, Trustee”. This page reports the strokes and does not characterise them.1 The following sheet is a New York acknowledgment: the state and county blanks and the day and month are completed in ink, the final digit of the year is a manuscript character this page does not read, and beneath the notarial rule sits a rubber stamp of Harry I. Beller as a notary public of the State of New York, qualified in Rockland County, with a pen stroke across the rule above it. The commission number on that stamp is not reproduced here, and the two copies of the sheet do not treat it the same way.16
The copies are not interchangeable, and they are not in the same order. At least two eleven-page copies of the instrument are in the release. On the copy produced by Deutsche Bank under Rule 6(e), the Acceptance of Successor Trustee stands at page 10 and the Designation of Trustee at page 11; on a cleaner copy carrying no production stamps at all, the two are the other way round.345 A pin to “page 10” of this instrument therefore names a different document depending on the copy.
May 2007: a second trustee
Two sheets dated as of May 8, 2007 add Darren K. Indyke. One is headed “THE HAZE TRUST / Designation of Trustee” and recites, in machine print, that the trust “was created under a trust agreement dated February 9, 1999 between Jeffrey E. Epstein, as Grantor, and Jeffrey E. Epstein, as Trustee”, that Article FIFTH paragraph (a) authorises the trustee “to designate one or more additional Trustees”, and that “Jeffrey E. Epstein, as Trustee, hereby designates Darren K. Indyke, to act as Trustee of the Trust, effective from and after the date hereof.”4 The other is headed “ACCEPTANCE OF SUCCESSOR TRUSTEE OF THE HAZE TRUST” and records that the undersigned “accepts his appointment as Trustee”.5 A pen stroke crosses the rule on each, captioned “Jeffrey E. Epstein” on the first and “Darren K. Indyke” on the second.45
The heading of the second sheet says successor while both sheets recite the additional-trustee paragraph. Article FIFTH’s other limb, paragraph (b), appoints a named successor trustee if at any time no trustee is acting, and that is treated on Jeffrey Schantz’s page, which cites the Deutsche Bank copy of these two sheets and is not repeated here.15
What Epstein’s office recorded
On a schedule of Epstein entities kept by his own office, the Haze Trust stands under the heading TRUSTS beside the Butterfly Trust. Its row enters the return type as “1041”, the state as “USVI”, the year end as 31 December, 15 April under “Extension Due” and 15 October under “Due with Ext”, and ownership as “JE”. Its notes column reads “JEE - Grantor & Trustee”, then “a) JPM Bonds & Cash $5,100,000”, then “c) Hedge Funds”, then “1) King Street Capital 2) Highbridge Multistategy”; the lettering runs a) then c), with no b).11 The Zorro Trust row on another page of the same schedule enters “Trust” in that column rather than “1041”, which is a difference between the two trusts on the office’s own paper.11
The office carried the trust on its April filing worklist. On March 29, 2012 Richard Kahn sent Epstein a message headed “RE: Open Items” whose item 5, “April 15th Tax Returns & Extensions”, lists “c) Zorro Trust”, “d) Haze Trust”, “e) Butterfly Trust”, “f) Financial Ballistics Trust - we are waiting on direction from Erika”, “g) KCAC LLC”. The Haze Trust line carries no annotation; the words about waiting on direction sit on the Financial Ballistics Trust line beneath it.17 That message is set out at greater length on Butterfly Trust and Zorro Trust.
JPMorgan Private Bank, 2010: the due diligence report
The Private Bank ran its Epstein-related due diligence under a single decision-maker record in Epstein’s name, and the Haze Trust has a report of its own inside it: a “USCG Due Diligence Report - Fiduciary” whose DDR Name is “The Haze Trust ~” and whose banker is Paul V Morris.13 The form family, and the list of other reports filed under the same decision-maker record, are described on JPMorgan’s Due Diligence on Epstein and Maxwell.
The report records the trust’s situs as New York, Epstein as primary non-JPM trustee and Darren K. Indyke as an additional one, and Epstein as grantor.18 Against the printed heading “Beneficiary (-ies):” it enters one name, Jeffrey Epstein, with the relationship to grantor and trustee given as “Self”.7 Its introduction type is “Related Client A/C” and its specific-information field reads: “This is another part of an existing client relationship with Jeffrey Epstein. The client has requested the opening of a checking account for trust. This trust is for the benefit of Jeffrey Epstein.”7 The same sentence is repeated verbatim as the report’s Summary Of Findings, with the anticipated product given as “Deposits”.19
The financial fields put the trust’s value at ”$ 50.00 (USD millions)”; the source of wealth is entered as “Other”, explained as “The source of wealth derives from distributions, funding from other sources - personal investments”, with the trustees’ occupation given as “Jeffrey Epstein is a financial advisor - he has made his wealth managing money for wealthy individuals.”7 The purpose of the account is “Checking account for trust.”, the expected source of funding “Wire”, and the approximate amount to fund it 10,000,000.7
Two background checks are recorded, both dated 04/22/2010 and both on the Morgan Network: “Jeffrey Epstein is an existing client. Darren Indyke is the attorney for Jeffrey Epstein and an exisiting client” in the trustees’ block, and “Jeffrey Epstein is an existing client” in the grantor’s. Printed above the grantor’s block is the form’s own instruction that “At least one Background Check needs to be performed OUTSIDE THE MORGAN NETWORK (Third Party Validation)”; in both blocks the Morgan Network box carries a mark and every other box in the list beneath it is empty.20
No search result was entered in the Security Services table of that report. Its “Security Search Type” field reads “None”; the ten-row table headed Company Information, Corporate Records, Other Database Searches, Internal Database Search, State Court Searches, Federal Court Searches, Personal Particulars, Publications, Regulatory Sanctions and OFAC/Control List Search has no entry in any cell of its Details or Banker Response columns; the “Signed by:” and “Dated:” rules beneath are blank; and of the two radio buttons following “Has this been identified as a Red Dot DDR? :”, measured on the native raster at 600 dpi, both rings are open. Beneath the table, inside the same Security Services Information block, one field does carry a value: “Expense No.:” reads 102/29338, the “Total Costs:” rule beside it being blank.19 The Approval Information block on the next sheet answers “No” to “Public/High Profile Figure”, “No” to “High Risk Jurisdiction” and “No” to “High Risk Business”.21
The approvals are staggered. The form was created and submitted on 04/22/2010 by Debra White, who requested a temporary waiver the same day for the reason “The Senior Manager is out of the office and the Banker is unable to find another senior manager to approve the DDR”; Elizabeth X Hogan approved the waiver eight minutes after the request, by the ticket’s own audit trail. Paul V Morris gave banker approval on 07/14/2010 and Thomas K. Southmayd gave senior manager approval on 07/22/2010, the audit trail recording that he approved “on Behalf of Mary C Casey because designated Senior Manager is Senior manager unavailable.”9 The periodic review interval entered on the same sheet is 36 months.9
JPMorgan, July and August 2013: the exit
On July 13, 2013 Justin D Nelson of the PB Front Office opened know-your-customer ticket 105258611 on THE HAZE TRUST.12 Its initial and final risk ratings are both High and the GCS report requested is “Full”. Its Summary of Risk Attributes opens “Convicted Felon” and then sets out the Florida charges, the thirteen months served, law-enforcement investigations, sex-offender registration and settled civil suits; the same paragraph is reproduced in the ticket’s investigations grid as what the internal database returned on Jeffrey Edward Epstein, marked as requiring further review.12 The other rows of that grid read that no records were found or that nothing derogatory was found, except a final row headed “Negative or Inconsistent Information”, whose details cell is empty and whose Further Review Required cell reads “Yes”. The GCS Red Dot block answers “No” to “Has this been identified as Red Dot KYC?” and “Yes” to “Negative Information Found”.12
Asked to state the rationale for conducting business with the client, the banker entered: “Client has been ased to exit the firm and is in process of doing so now.”; the spelling is as printed in that field. The field asking him to respond to the issues in the investigations grid carries the same sentence with the word spelled “asked”.2 Tickets in the same words, and to the same effect, were opened on other Epstein entities the same day and are documented on JPMorgan’s Due Diligence on Epstein and Maxwell.
The ticket’s own description of the trust is fuller than the 2010 report’s. Its Client Legal Entity Type is “Trust”; its industry code is “Personal & Testamentary Trusts [525921]”; its “Date of Incorporation/Situs (Date of Trust)” is 02/09/1999; against “Estate Trust” it enters “Revocable Trust”; its documentary evidence is “Trust - Trust Agreement/other governing document establishing the Trust”; and against “What is the nature/purpose of this entity?” it reads: “This is a Trust set up as part of Jeffrey Epstein’s Estate Planning.”2 Its country and state of primary domicile are the United States and New York, and its legal address is the Red Hook Quarter address in St Thomas.2 Against “High Risk Jurisdiction” this ticket enters “Yes”, where the 2010 report’s approval block had entered “No”.221 A comments field elsewhere in the ticket records Indyke as a trustee and Epstein as “the Grantor of this Trust”, and answers “No” to whether JPM is sole trustee and “Existing” to whether this is an existing or external JPM trust.22
Two rows of the ticket’s Additional Party Information tables do not agree with the instrument or with the bank’s own earlier report. One enters “Jeffrey E Epstein”, relation type “Owner”, percent owned 100.0. The other enters “DARREN INDYKE”, relation type “Beneficiary”, percent owned 100.0, with his last completed search date given as 01/15/2010.2324 The trust agreement names the grantor as the person for whose benefit the property is held; the 2010 due diligence report entered Jeffrey Epstein in its beneficiary field; and Deutsche Bank’s 2019 exhibit enters Jeffrey Epstein as the beneficiary of all three of the trust’s accounts there.3725 This page reports the discrepancy and does not resolve it.
A month later the investigations group was brought in. Its report is headed “Confidential Due Diligence Report”, carries “THE HAZE TRUST” on its cover, bears the reference 786460313B, and opens: “On 08/14/2013, GS&I was requested by Justin Nelson to conduct a background investigation. Media research was conducted on The Haze Trust.”2627 Under the heading THE HAZE TRUST it records that other databases revealed no records, the internal database revealed no records, publications revealed nothing derogatory, the regulatory sanctions search revealed no records, and a search of OFAC did not reveal any matches. Under the heading “Jeffrey Edward Epstein” it records that the internal database search returned prior GS&I research on him, and reproduces the same paragraph the July ticket carries.26 A later sheet of the same report prints an OFAC search result page reading “No records were found that meet your search criteria: THE HAZE TRUST.”28
Deutsche Bank, September 2013: the move
The trust’s file crossed to Deutsche Bank in the first week of September 2013. On Wednesday, September 4, 2013 at 12:33:28 pm Eastern daylight time, the offset being carried in the message’s own RFC date header, Amanda Kirby of Deutsche Bank Trust Company Americas sent Tazia Smith a message headed “Haze Trust Information [I]”, classified for internal use only, whose body is the single line “Haze Trust:” followed by four attachment references: “Haze JPM Statement1.pdf”, “Haze JPM Statement2.pdf”, “Haze Trust Agreement.pdf” and “Haze Trust W-9.pdf”.29 Two weeks later, on September 18, 2013, she wrote again, attaching three account-transfer forms whose file names are those of Southern Financial and Southern Trust: “Please have Jeffrey sign and date the following 3 attachments on the highlighted lines and return to me. I will be sending the ACATs for Haze and Jeepers in a separate email.”30
Deutsche Bank’s September 2019 presentation to the U.S. Attorney’s Office records the result. Its exhibit on the nature and purpose of the accounts gives The Haze Trust a brokerage account opened 9/19/2013, whose stated know-your-customer purpose is “This is a brokerage account for the trust to hold and make investments in marketable securities”; a DBAGNY Preferred account opened 2/21/2017, “an interest bearing checking account for costs (taxes, etc.) related to this Trust”; and a checking account opened 2/27/2017, “a simple checking account for costs (taxes, etc.) related to this Trust.” The account-number column of that exhibit is covered by a black bar throughout.10 A companion exhibit lists the parties to each of the three accounts under its own key, which distinguishes grantor or UBO, signatory or legal representative, and beneficiary or limited power of attorney. On the brokerage row it names Jeffrey Epstein as grantor and UBO, Jeffrey Epstein, Darren Indyke, Harry Beller and Jean A. Brennan as signatories, Jeffrey Epstein as beneficiary, and Paul Barrett with a limited power of attorney.25 A later dispute between the bank and the office over which signatories the account resolutions showed is documented on Jeanne Brennan-Wiebracht’s page.
”Southern Financial, Trust & Haze Trust”
The instruction that moved the JPMorgan securities carries a subject line that has to be read against its own body before it can be used. On Thursday, September 19, 2013, Stacy Dubov of JPMorgan’s Global Investment Opportunities desk wrote to a private bank service address under the subject “moving securities in Southern Financial, Trust & Haze Trust”:
As discussed yesterday, attached please find the securities that we’re transferring over to DB and the ones that are to remain at JPM. Please ensure that cost basis gets included in the ACAT (not sure if this is a given, but want to double check?). The Color Key is at the bottom of each spreadsheet. Let me know if you have any questions!
I will send through Haze Trust tomorrow — I want to confirm that there is no tax consequences/any other issues in transferring securities out of a trust and into a non trust.31
Beneath that, under the heading “Instructions”, the message carries two blocks. The first is headed “Southern Financial” and the second “Southern Trust”, each with two account lines.31 The subject line’s “Southern Financial, Trust” is those two companies, not a third entity of that name: the body says so, and so does the later message in the same thread, of Tuesday, September 24, 2013, whose attachment field lists exactly two files, “Southern Financial.xlsx; Southern Trust.xlsx”, and whose body reads “Team, please proceed per the attached.” above a sign-off.32 No Haze Trust spreadsheet is attached to it. The next day, Friday September 20, Dubov had chased the same team: “Janet & Team – is the below request clear? Do you need to discuss further or did you already confirm with Jeffrey?”31
The following week the same banker was writing the same instruction under a subject line with the Haze Trust gone from it. On Tuesday, October 1, 2013 at 12:23:26 pm Eastern daylight time, the offset being carried in the message’s own RFC date header, she wrote to Harry Beller, copying Amanda Kirby, under the subject “moving securities in Southern Financial & Southern Trust”, opening “Harry, Jeanne and Amanda, Please see attached”, and set out the same Instructions block with the same two headings and the same four account lines.33
Four copies of the September 20 message were read for this page, and no two are redacted the same way. Account numbers on those pages are not reproduced here, and the copies differ in how much of the Instructions block they cover: on one of them the bar is set wide enough that it also takes in the printed heading “Southern Trust”, so a reader of that copy has only the subject line to tell him which entities the second block belongs to.34 The copies also differ in whether the fax banner’s own sending number is covered.313536 The September 24 message is a further sheet of the same nineteen-page fax transmission and a different document.32
Whether the Haze Trust securities ever moved by the same route is not settled by the documents cited here; the brokerage account at Deutsche Bank was opened on the day Dubov wrote, and the tax question she raised has no answer in them.1031
The account, 2016 and 2017
By the summer of 2016 the trust’s Deutsche Bank brokerage account was among the largest in the Epstein relationship. On Tuesday, June 28, 2016 Vahe Stepanian wrote to a colleague in an internal thread about an initial-advance requirement on Southern Financial’s preferred-equity basket: “Andrew — just in the brokerage accts there are > $100mm in assets”, and pasted the account list beneath. Its second entry reads “THE HAZE TRUST UAD 02/09/99 JEFFREY EPSTEIN & DARREN K INDYKE TTEES 6100 RED HOOK QUARTER B3 ST THOMAS VI 00802”, with the figure 41,108,732.17 on the line below; the Southern Financial LLC entry above it carries 98,610,505.00.6 The message’s own “Sent” line carries no time zone and no clock time is taken from it here.
On October 11, 2016 the same banker sent quotes to “Rich” under the line “two way markets are included below”. Under the heading “Haze Trust” the message names a Bank of America 8.125% preferred security due 12/29/2049 and gives a market of “102 x 103.25”; the security’s identifier is covered by a black bar, and two further figures on that entry stand on separate lines with no column heading, so this page does not say what they measure. The message’s stated hour carries no zone and none is printed here.37
The trust also stood as the contracting party for a Paris art-storage account. On January 27, 2017 at 11:22:41 AM Eastern standard time, the zone being printed in the forwarded header itself, Lisa Tourenne of the storage company wrote to Richard Kahn: “I am in charge of your storage account. I would need the following information and documents to draft it: a certificate of incorporation or other legal proof of your company’s registration, delivered from the appropriate authority in your country; name and ID document of the representative (person who will sign the contract)”, and asked him to “confirm the contract and billing should be made to the following entity (they could be different if need be):”, giving “The Haze Trust” and beneath it “c/o Darren Indyke, Trustee”.38 Kahn forwarded it to Epstein under the subject “Stockage 1 sculpture - Giacommetti” with the note “attached is request made by paris storage unit for giacommetti / please advise if ok to send haze trust agreement / thank you”. Epstein’s reply, whose RFC date header reads “Sat, 28 Jan 2017 11:08:22 +0000”, is one word: “ok”.38
That thread is in the release twice, and the two copies do not withhold the same fields: one carries the RFC date header and the Eastern-time line quoted above, and the other carries in their place a “Sent” line with no zone reading 11:08 AM. Email addresses and contact lines on either copy are not reproduced here. The zoneless “Sent” line matches the hour of the coordinated-universal-time header on the other copy, so on this pair that field is UTC.3839
Deutsche Bank’s anti-money-laundering compliance correspondence about a wire into the trust’s account in December 2016 has a page of its own at EFTA01369019, and the trust’s appearance in a relationship-manager balance report of June 2017 is on Bank Records of the Epstein Entity Network. Neither is repeated here.
July 2019: the close
On Monday, July 8, 2019 at 7:33:19 AM Eastern daylight time, the zone being printed in the message’s own date line, Kimberly Hart of Deutsche Bank wrote to colleagues under the subject “URGENT!!! Need to close accounts ASAP - please prioritize today”, classified for internal use only. Her item 2 reads “$0 balance brokerage accounts that are still open. Please coordinate with Dawn Forbes to get these hard closed”, and beneath it a list of account titles whose last entry is “THE HAZE TRUST UAD 02/09/99 JEFFREY”, the title breaking off at that word. No count of that list is given here: each entry is preceded by a black bar covering the account number, and a bar of that kind can cover more than one line.14 Her item 3 lists deposit accounts with residual balances to be distributed and closed the same day, and the trust’s name is not among the titles printed there. She closes “Please confirm back to me once completed.”14 At 9:14:27 AM Eastern daylight time, the offset being carried in the RFC date header that a second copy of the same reply prints in place of the zoneless one, Chris Harvey of Deutsche Bank Securities replied “Dawn is on her MTA. I’ve closed all the Pershing accounts today.”40
That message reaches the release as a machine-rendered export rather than as a photograph of a sheet, and the two copies read for this page apply their redactions differently: on one the account-number bars beside the brokerage list are four separate rectangles, on the other a single rectangle spanning three of the rows. Measured on the native raster at 600 dpi, the bar edges are straight to within a pixel of antialiasing.1441
What the record here does not show
These documents establish who settled the trust and when, on what terms, who its trustees were, which banks held its accounts and on what dates they were opened and ordered closed, what one of those accounts was worth in June 2016 and what two institutions wrote down about it. They do not show what the office’s note about JPMorgan bonds and cash and two hedge funds refers to at any particular date; the Deutsche Bank exhibit listing hedge fund investments across the relationship names other entities and not this trust.1142 They do not show whether the securities the September 2013 instruction deferred were ever transferred, or what answer the tax question in it received. They do not show whether the trust was ever revoked, amended or wound up: the last step documented here is an instruction to hard-close a zero-balance brokerage account, and no instrument amending or terminating the trust appears among the documents read for this page.
They also do not reconcile two things the record states in more than one way. On the trust’s home jurisdiction, the instrument itself provides for New York law and JPMorgan’s records enter New York as the situs and domicile, while Epstein’s own office schedule enters the state as “USVI” and the address on every bank record cited here is in St Thomas.118211 On the beneficiary, the instrument, the 2010 report and Deutsche Bank’s 2019 exhibit all point to the grantor, while one row of the 2013 ticket enters another name against “Beneficiary”.372524 The ticket’s net-worth fields are not used here at all: they sit at page boundaries between the blocks for different parties, and which figure belongs to which is not readable from the sheets.

Whether an instrument amending or ending the trust is somewhere in the release under wording none of those searches reaches is not settled here.
