FBI Death Investigation — Jeffrey Epstein, MCC New York (90A-NY-3151227)

On August 10, 2019, Jeffrey Epstein was discovered unresponsive at approximately 6:30 a.m. in his cell on the L tier of the Special Housing Unit at the Metropolitan Correctional Center, 150 Park Row, New York, NY. He was being held as a pretrial detainee under United States v. Epstein, 19-cr-00490 (S.D.N.Y., Judge Richard Berman). Two days later, on August 12, 2019, the FBI New York Field Office's Squad C-19 (Violent Crimes Against Children / Color of Law) opened captioned matter 90A-NY-3151227, classification 90A (Civil Rights / Color of Law — Death Investigation), under the title 'UNSUB; JEFFREY EPSTEIN — VICTIM; DEATH INVESTIGATION' (EFTA00023973). The Opening EC recited that 'preliminary investigation revealed a series of protocol failures by MCC personnel, as well as technical failures/deficiencies' at the time Epstein was discovered with a fabricated noose around his neck.

The FBI worked the matter jointly with the DOJ Office of the Inspector General, which opened parallel administrative investigation 2019-010614, and with the U.S. Attorney's Office for the Southern District of New York. AUSAs Rebekah Donaleski and Nicolas Roos sat in on FBI/OIG interviews. The FBI New York CART (Computer Analysis Response Team) collected and forensically imaged the MCC SHU video surveillance equipment beginning August 12–15, 2019: the Dell PowerEdge R420 DVR Controller, the NICE VISION PRO 'DVR System #1' disk array (sixteen drives, Premium 8600 chassis, NP-2000 controller), and 'DVR2' (later determined non-functional) (EFTA00127400). The FBI's Operational Technology Division tracked 37 digital evidence items associated with the case as of August 22, 2019 (EFTA01683629). The FBI ultimately reviewed over 400 hours of MCC video covering July 23, 2019 (Epstein's first SHU incident) through August 10, 2019, with focused attention on the August 9 4:00 p.m. – August 10 7:00 a.m. window, and confirmed that DVR1 had been recording but DVR2 had suffered a system failure on July 29, 2019 and was not recording at the time of the death (EFTA01660622).

The two correctional officers on duty in 9 South overnight on August 9–10, 2019, Tova Noel and Michael Thomas, were charged in November 2019 in United States v. Noel and Thomas, 19-cr-00830 (S.D.N.Y., Judge Analisa Torres) with conspiracy and false records arising from their failure to perform mandated 30-minute rounds and the falsification of count and round forms. Both entered into deferred-prosecution agreements in May 2021, the deferral period closed in November 2021, and the indictment was dismissed by nolle prosequi on January 3, 2022 (separately briefed as 'MCC-Guards'). On December 6, 2022 OIG received the FBI's case closing communication, with the FBI 'having found no criminality pertaining to the death' (EFTA00035805). A FOIPA response prepared on October 5, 2022 described the file as 'pending inactive' while OIG's parallel investigation continued (EFTA00175052). The OIG issued its final 128-page report in June 2023, concluding that Epstein died by suicide and identifying systemic BOP supervisory and operational failures (separately briefed as OIG-23-085). The New York City Office of Chief Medical Examiner ruled the cause of death hanging and the manner of death suicide.

The corpus contains 323 EFTA-stamped pages and 348 emails linked to FBI case 90A-NY-3151227, drawn primarily from DS8/DS9 and the SDNY production. The sampled material is the operational evidentiary record of the FBI side of the joint investigation. It includes the August 12, 2019 Opening EC (FD-1057) initiating the full investigation (EFTA00023973), the December 3, 2019 subfile opening for grand jury subpoenas (EFTA00133182, 'Subfile Opening Document' for case 90A-NY-3151227-SBP), and serial-by-serial Collected Item Logs (FD-1087) documenting the August 14–16, 2019 CART seizures of MCC DVR controller, DVR System #1, and successive DVR2 hard drives (EFTA00127400; EFTA00025433; EFTA00023971; EFTA00023977; EFTA00032101).

The FBI 302 record in the sample anchors the chronology around the death. Dr. Kari Schlessinger, MCC Bureau of Prisons psychologist, was interviewed on August 30, 2019 about her July 8, 2019 intake screening of Epstein, his denial of mental health, suicide and substance abuse history, and the August 9, 2019 1:00 p.m. meeting with Epstein's attorney about cell-mate placement (EFTA00075355). An MCC SHU Operations Lieutenant (GS-11) was interviewed the same day about SHU procedures, Epstein's prior suicide watch, the placement of inmate Efrain Reyes as Epstein's cellmate, the receipt of an emailed warning about cell-mate need from AUSA Donaleski, and the events of the 6:00 a.m. – 2:00 p.m. shift on August 9 during which Reyes was removed from the cell and not replaced (EFTA00122996). A SHU senior officer specialist was interviewed September 25, 2019 and described leaving Epstein at approximately 9:30 p.m. on August 9 with the directive 'make sure you watch him … he's your priority,' and gave 'inconsistent answers' when questioned about the last in-cell visit before he left (EFTA00141130). An additional SOS interviewed August 20, 2019 (EFTA00009958) and a Bureau of Prisons psychology unit interview produced August 12, 2019 about Epstein's three encounters with the witness (EFTA00126948) round out the SHU staff record.

The sample also captures the joint investigation's investigative cadence and digital evidence work. A weekly Significant Activities/Update memo dated August 30, 2019 reports five FBI New York victim interviews that week, identification of a new email address for Ghislaine Maxwell, the password-protected DVR Main Controller for which the BOP-supplied administrator password proved incorrect, and a notation that 'FBI NY uncovered dereliction of duty violations and fraudulent reporting by MCC staff' while supporting the OIG investigation (EFTA00165517). November–December 2019 emails between the case team and the FBI Multimedia Exploitation Unit document the iterative pull of MCC camera footage from 'DVR1' (front lobby, lobby waiting area, lobby main entrance, and other channels) and the splitting of evidence between this case and a related MCC contraband matter, 90C-NY-3154599 (EFTA01683907; the OTD digital-evidence tracking spreadsheet is at EFTA01683629). A Sentinel evidence-return concurrence email dated September 4, 2019 documents the return of seized item 1B44 belonging to Michael Thomas to his counsel Shannon Farrar (EFTA00137617), and a December 2019 FD-302 of a BOP corrections officer working the August 9 evening watch (EFTA00141130) preserves the in-the-moment account of the last in-cell contact with Epstein.

Later file activity captured in the sample includes the FBI's October 5, 2022 FOIPA response describing the case as 'pending inactive' while OIG continued its parallel work (EFTA00175052), and the OIG's December 6, 2022 Memorandum of Investigation receiving the FBI's case-closing communication (EFTA00035805). Compiled briefing material in the file recites that 43 interviews were conducted (28 MCC staff members and 15 inmates), that Operations Lieutenant–level FBI 302s, the MCC count slips for July 23 to August 9, 2019, the OCME autopsy report, and 30-minute round sheets are part of the underlying evidence, and that the case closed on December 5, 2022 with no criminality found pertaining to Epstein's death (EFTA01660622). The sample does not include the OCME autopsy report itself, the surveillance video, the Noel/Thomas deferred-prosecution agreements, the sealed grand jury record, or the OIG's published report.
