Epstein was discovered with a fabricated noose around his neck in what was an apparent suicide. Preliminary investigation revealed a series of protocol failures by MCC personnel, as well as technical failures/deficiencies within the MCC at the time Epstein was discovered. During the course of the investigation, no criminality was found pertaining to the death of Epstein. Further investigation resulted in the charging of two correctional officers at the Metropolitan Correctional Center with Title 18, United States Code, Sections 1001(a)(3) and 2 (False Records) and Title 18, United States Code, section 371 (Conspiracy). On 5/2021, the United States Attorney's Office for the Southern District of New York entered into a deferred prosecution agreement with the two correctional officers, Tova Noel and Michael Thomas, for a period of six months.
