Jane Doe 1 & Jane Doe 2 v. United States (CVRA)

Case 08-cv-80736 was filed in the U.S. District Court for the Southern District of Florida on July 7, 2008 by two pseudonymous Epstein victims, Jane Doe #1 and Jane Doe #2, against the United States. The petition alleged that the U.S. Attorney's Office for the Southern District of Florida — then led by U.S. Attorney R. Alexander Acosta with AUSA Ann Marie Villafana as the line prosecutor — had violated the Crime Victims' Rights Act, 18 U.S.C. § 3771, by negotiating a September 2007 non-prosecution agreement (NPA) with Epstein's defense team (Jay Lefkowitz, Roy Black, Martin Weinberg, Kenneth Starr, Alan Dershowitz, and others) without conferring with, or even informing, the identified victims. The case was assigned to U.S. District Judge Kenneth A. Marra, with magistrate jurisdiction first under Linnea R. Johnson and later William Matthewman.

The litigation was unusually protracted. After the petition was filed, the petitioners moved to unseal the NPA itself (D.E. 28, Sept. 25, 2008) and pressed for a stipulated factual record. The Government refused to stipulate and in November 2011 moved to dismiss for lack of subject-matter jurisdiction (D.E. 129, raised again at D.E. 208) along with a motion to stay all discovery, which the Petitioners characterized as a deliberate delay tactic. Three sets of Epstein's defense attorneys, led by Roy Black, Martin Weinberg, and Jay Lefkowitz, intervened on a 'limited' basis to assert privilege over their plea-negotiation correspondence with the U.S. Attorney's Office; that privilege fight produced an interlocutory appeal that the Eleventh Circuit ultimately resolved against the intervenors in Doe No. 1 v. United States, 749 F.3d 999 (11th Cir. 2014), holding that the CVRA proceeding was 'ancillary to a criminal investigation.' In 2015 two additional victims filed a Joinder Motion as Doe #3 and Doe #4; that motion drew an extensive response from intervenor Alan Dershowitz, whom Doe #3's pleadings accused of abuse, and produced a dense round of contested filings that were partially struck and re-filed in redacted form by court order in November 2015.

Following years of contested discovery, including disputes over grand-jury materials and government plea-negotiation correspondence, Judge Marra issued the central liability ruling on February 21, 2019, holding that the U.S. Attorney's Office had violated the CVRA when it executed the 2007 NPA without conferring with the victims. The ruling came roughly four months after the Miami Herald's 'Perversion of Justice' series re-focused public attention on the NPA. Acosta, by then U.S. Secretary of Labor, resigned that July; Epstein had been re-charged in the Southern District of New York (19-cr-00490) on July 8, 2019 and died in MCC custody on August 10, 2019. With the federal criminal case against Epstein abated and a 2009 confidential settlement between Epstein and the petitioners already on the record, Judge Marra entered final orders in 2019 closing the matter without ordering rescission of the NPA. The Eleventh Circuit subsequently reconsidered the framework en banc in In re Wild, 994 F.3d 1244 (11th Cir. 2021), holding that the CVRA does not authorize a pre-charge enforcement remedy of the type the petitioners had sought — a holding that limits the precedential reach of Marra's 2019 liability finding without disturbing the trial-court record itself.
