Card relationshipAn FBI forensic accountant recorded that Maxwell held a sub-account under a Theodore W Waitt American Express relationship, last appearing on the September 2010 statement3
AllegationsOne, uncorroborated: an anonymous caller to the FBI in July 2020. This page found no record that it was investigated78
ChargesNone. He has not been charged with any offence and is not a defendant in any case named in the material read for this page

Ted Waitt co-founded the computer company Gateway. The released files identify him that way, and tie him to a second firm: the Sioux City hangar the aircraft leaves from on a 2005 itinerary is printed “GATEWAY HANGAR”, that itinerary’s requester is “Avalon Capital Group Inc”, and an FBI intake record of July 2020 calls him “the owner of Gateway Computer”.24

In the Justice Department’s release of the Epstein material he appears almost entirely as a payer. J.P. Morgan statements produced under subpoena show a standing monthly wire of $30,000 from his California account into a New York company, 116 East 65th Street, LLC, from June 2008 into 2010; and then, on 24 September 2010, a single wire of $7,211,238.00 into Ghislaine Maxwell’s own account, followed within five days by three million dollars moving out of it again.

Nothing on this page is a finding of wrongdoing. He has not been charged with any offence, and the documents read for this page do not show that any payment he made was used for an unlawful purpose.

What this page is, and what it leaves out

This page is built from documents in the released files and, where noted, from the page images of those documents. Waitt appeared before the House Committee on Oversight and Government Reform for a voluntary transcribed interview on 30 April 2026, and the committee released the transcript on 13 May 2026.9 That transcript was not read for this page, so nothing here reports what he told the committee, and a reader who wants his own account should go to it directly.

Some documents in the release that name him were read and are deliberately not used, because their subjects are people this page will not describe or identify in any way. Their contents are withheld entirely, including what they say about him.

On the card accounts, this page cites the FBI’s own one-page summary and did not read the American Express statements themselves. The business-background report that supplies the company registry record below runs to forty-one sheets, of which one was read.

The monthly wires into 116 East 65th Street, LLC

The release contains a run of single-sheet extracts from J.P. Morgan Private Bank statements for an account in the name of 116 EAST 65TH ST LLC. Each extract is the statement’s transaction-detail page, and each one read for this page carries the same entry near the top of the month: a Fed Wire credit of $30,000.00 placed by order of “Theodore W Waitt LA Jolla CA”.5

Thirteen distinct statement periods were found, the first covering 31 May to 30 June 2008 and the last 27 February to 31 March 2010.5 Several of the thirteen are present in more than one copy. Thirteen wires at $30,000 come to $390,000; that is the figure the sheets read for this page support, and it is a floor rather than a total, because nine monthly periods inside the same span are not among the statements found here.10 This page makes no estimate of what was paid in the months it did not find.

The entry matters less for its size than for where it landed. The same transaction-detail pages show the account paying out, in the same weeks, payroll-tax debits and payroll fees to ADP and a debit to American Express.11 The account receiving the wire was running a payroll.

The company itself leads to a lawyer. A commercial business-background report held in a bank’s file lists 116 EAST 65TH STREET, LLC as the first of twenty-three business associations of Darren Indyke, printing his name as “INDYKE, DARREN K”, with a New York corporation number and a filing date of 9 June 2008.12 That record gives Indyke no title in the company. On this point the printed page corrects the released text, which runs the columns of several records together and appears to attach the word “MANAGER” to this one; it belongs to the next entry down, a different company.

The sequence is worth setting out plainly, because the two dates are a week apart. The earliest Waitt wire this page found reached the account on 2 June 2008.1 The registry record associating Indyke with the company carries the filing date 9 June 2008.12 The record does not say what was filed, and this page draws no conclusion from the interval.

24 September 2010

A one-sheet extract from a J.P. Morgan statement in Ghislaine Maxwell’s name, for the period 1 to 30 September 2010, records a single Fed Wire credit on 24 September by order of “Theodore W Waitt LA Jolla CA” in the sum of $7,211,238.00.6

The arithmetic on the sheet is complete and self-checking, which is the reason to trust the figure. The account opens the month at $3,748,972.81 and stands at $10,960,210.81 after the wire. Three days later $1,000,000 is transferred out, two days after that $2,000,000, and the month’s withdrawals total is printed as ($3,000,000.00). Interest of $1,484.56 is credited on the 30th and the account closes at $7,961,695.37.6

The statement period, the one fact that fixes this wire in time, is legible on the page image and is lost from the released text, which breaks off mid-word.6

The card relationship

On 1 July 2020 a forensic accountant at the FBI’s New York field office circulated a one-page note headed “Maxwell - AMEX Production”, attaching a file named “AMEX_Account_Matrix.pdf”. It opens: “Per your request, I have prepared an analysis of the account numbers included in the AMEX production regarding Maxwell.”3

The note lists three account relationships in the production. The third is headed THEODORE W WAITT, and reads: “Maxwell had a sub account under this relationship.” It continues: “The September 2010 is the last statement in which Maxwell is included in the account.”3

That is the same month as the $7,211,238.00 wire. The note does not say why the sub-account ended, and this page does not infer it.

June 2005: Maxwell on the Avalon aircraft

A six-sheet passenger itinerary printed by TAG Aviation on 23 June 2005 sets out an eight-leg trip flown between 27 June and 3 July 2005 on a Gulfstream V, tail number N401WJ. The requester is “Avalon Capital Group Inc”.2

Waitt is the only passenger on the first leg, Sioux City to West Palm Beach, which departs from a hangar the sheet calls GATEWAY HANGAR. The general note on that leg reads “G MAY NEED TO BE PICKED UP IN MIAMI”.2 From West Palm Beach onward, the passenger list on every leg but the last carries two names, Maxwell’s and his: to Exuma in the Bahamas the same afternoon, on to Marsh Harbour in the Abacos two days later, then Jacksonville, Vancouver, Victoria and, on 2 July, Teterboro.13 The arrival note at Teterboro reads “GND TRANS: G’S PERSONAL DRIVER”.14 The final leg, Teterboro to San Diego on 3 July, lists Waitt alone.15

The itinerary shows no stop at any property associated with Epstein, and Epstein is not on it. What it does show is that in the summer of 2005 Maxwell travelled for a week on an aircraft booked by Avalon Capital Group Inc, with her driver waiting at the end of it.

2009: “it just feels dirty”

In July 2009 a Canvas Financial partner, AJ Discala, sent Waitt an investment proposal under the subject “Clockwork” and asked his view. Waitt answered on 23 July 2009 from, as he put it, “the boat in galapagos”:16

My initial take away is it just “feels like a dirty business” or scam. Could very well be totally legit and a great investment, but it’s just doesn’t feel clean. First of all you start with a sexual harrassment case that could be set-up, or blackmail. Then you throw in a scumbag lawyer, and then you try and pay it off early to get around a court order. Mix in an off shore entity in the caymans, and you have something that just feels highly dodgy.

He closed: “My advice to you although you might not want to hear it, is with all the clouds surrounding you, I’d look for something squeaky clean, and while this might be legit, it just feels dirty.”16

The email names no case and no lawyer. On 16 October 2009, in an exchange headed “Lawyers”, Waitt put a name to a firm. The thread runs across two sheets and is read from the bottom up. At 17:15 he writes, as the whole of the message: “Scott rothstein with Rothstein, Rosenfeldt, Adler.”17 Maxwell replies ”? I don’t know these people”17; he answers “Well, maybe they are suing je as well. As they have your name.”; she writes back “They are suing me?????”.18 He then sets out what he has worked out:18

Got to be related somehow to the guy that subpoenaed you. Who is that firm? They have all the info and apparently settling for 18mm. Same suit I believe.

And two minutes later: “These are the guys aj is working with. He read all your stuff apparently, as they have it all, doing due dilligence on their biggest upcoming settlement.”18

The documents do not say who “je” is, and this page does not supply it. What the exchange does establish, on its face, is that on 16 October 2009 Waitt referred to “the guy that subpoenaed you” as something already known between them, told Maxwell that the firm he had named “have all the info”, and tied that firm to the proposal AJ Discala had brought him in July.

The lawyer he named is the subject of a separate page: Scott Rothstein.

Both of these threads survive because Maxwell forwarded them to a third address in 2011, under the line “Only for your eyes”.19 On 23 March 2011 the recipient wrote back “and they apparently SETTLING FOR 18 MILLION DOLLARS>”, and the next day Maxwell set out her own account of what had happened:19

AJ approached him in July as you can see if not before and TW did not see the stuff nor know it was your cases — As Rothstein got more desperate AJ got a meeting behind TW back and then said to TW that if he paid my name would go away guaranteed ..tw said he was being blackmailed that is all I know — I don’t know how many calls or e mails were sent between them also tw said he didn’t pay anything —

That is Maxwell’s characterisation, written in March 2011 and addressed to someone else. It is not Waitt’s. Her account contains the only use of the word “blackmail” that is attributed to him, and she attributes it at second hand. No document read for this page shows a payment by Waitt to Discala or to Rothstein.

July 2020: two callers name him, and the record goes quiet

In July 2020 the FBI’s National Threat Operations Center took two calls, fifteen days apart, that named Waitt. Both were logged to the same case number, 50D-NY-3027571.

The first was taken at 2:52 p.m. Eastern on 2 July 2020 from an anonymous caller. The intake record is not reproduced here beyond the sentence that concerns him: “She said Maxwell was the one in charge of getting the girls and Waitt was there and knows what was going on.”7 The caller named him as one of two people law enforcement should speak to. Nothing in the record corroborates the assertion, and nothing in it is first-hand as to Waitt.

The second came in on 17 July 2020 at 5:20 p.m. Eastern and was written up three days later. The caller, Peter Nomikos, described a dinner at Maxwell’s townhouse he thought was around 2012, and the intake record continues: “Nomikos was also under the impression that the owner of Gateway Computer, Ted Waitt (no identifying information provided) (Waitt) and Jeffrey Epstein (Epstein) were in some sort of relationship beyond friendship at this time.”4 The parenthesis is the FBI’s own: the record notes on its face that the caller supplied nothing to identify the man he was naming, and it records the claim as an impression.

Both are allegations by callers, in intake records, and neither was tested. A search of the released files for this page found no report of any FBI interview of Waitt, and found nothing indicating that either call was followed up.8 That absence is a fact about the material released and read here, not a finding about what the Bureau did or did not do; but the sequence is the thing a reader should weigh. Two callers named the same man to the same case number inside a fortnight, and nothing in these files follows. The question of what happened next is open.

What the documents do not show

  • No document read for this page places Waitt at any property associated with Epstein, on any aircraft associated with Epstein, or in any communication with Epstein.
  • No document read for this page shows that any payment he made was used for an unlawful purpose, or that he knew what the company receiving his monthly wires was, or who stood behind it.
  • No survivor account read for this page accuses him of anything.
  • The one allegation against him in the material read here is the sentence quoted above from an anonymous call, which was not corroborated and, so far as these files show, not investigated.
