Geoffrey S. Berman is the United States Attorney, the subject of this page. Richard M. Berman is the United States District Judge who presided over United States v. Epstein and who ordered the case dismissed after Epstein’s death. They are not related to this page’s subject and are not the same person. Across this wiki the judge is in fact the commoner of the two, by roughly two to one, so a bare “Berman” on any page should be read as the judge unless a forename or a title says otherwise. Every mention on this page is qualified for that reason.

Geoffrey S. Berman was the United States Attorney for the Southern District of New York when his office arrested and charged Jeffrey Epstein in July 2019, when Epstein died in federal custody five weeks later, and when the office opened the inquiry into how that had happened. He left the post eleven months afterwards, in circumstances the release documents only through press digest.

The institutional record of the prosecution is set out elsewhere on this wiki, on the indictment page and the page on the death at the MCC. What this page is for is the part of the record that is his own act, in his own words, and there is more of it than anyone had realised: a dozen messages he wrote himself, most of them never used on any page, including two that put the United States Attorney personally inside the investigation of the jail.

The charge, in July 2019

The grand jury returned the indictment on 2 July 2019. At 11:45 that morning he wrote to his own staff:

Can you send to me a copy of the Indictment to be presented today.

Four days later he was tracking the inbound flight: “tells me that he is confirmed on board. Wheels up. Geoff.” At 5:54 p.m. on 6 July 2019 he sent the message that is the plainest single line in the file:

Epstein is in custody. Search warrants being executed now. Geoff

He signed the indictment himself, alongside the grand jury foreperson.1 On 15 July 2019 he edited his office’s public statement on the case by hand before it went out: “Thanks. I took out part of a sentence. If this is OK can you circulate to the group.”7

The jail

Epstein died in the Metropolitan Correctional Center on 10 August 2019. What the release shows next is a United States Attorney running the inquiry into the jail himself rather than delegating it.

On 12 August, two days after the death, he sent the Office of the Deputy Attorney General his own two-page summary of the recorded voluntary interview of the warden, signed “Geoff”. It covers the incident of 23 July, the downgrade from suicide watch, the missing cellmate, and an officer who “refused to open the door or discuss the matter and said that she had retained a lawyer.”8

On 13 August at 11:23 a.m. he asked his staff a question that connects two of those facts:

Can we confirm that one of the co’s who would not meet with FBI without union rep was the co who did not assign a new cellmate to JE when the old cellmate was moved out? Geoff

The visit, 15 August 2019

Later on 13 August an Assistant United States Attorney in his office wrote to the jail’s supervisory staff attorney asking for a tour:

As discussed, we would like to see the 2nd floor pscyh observation and suicide watch area; the 9th floor SHU, and Epstein’s cell, which we understand to still be cordoned off. As discussed, we would appreciate if only MCC legal would escort us, and we will not speak to any of the guards present given the ongoing investigations. Please give me a call with any questions, and let us know what time and where we should go, and if it would be easier for us to enter via the 3rd floor bridge.

The misspelling of “psych” is the sender’s own and prints that way on the sheet.4

The jail organised the visit around his diary, replying within the hour: “It should not be a problem. Does 10 am work for Mr. Berman and the rest of his staff?” Internally the jail described it as “a tour of the SHU and suicide watch areas by the US Attorney and his staff”, adding “we may be subject to the US Attorney’s schedule.”4

It grew overnight. On 14 August the office advised that two more Justice Department officials would join, the Principal Deputy Attorney General and an adviser to the Attorney General, and added one sentence that is his own decision and appears on no other page:

In addition, Geoff has asked that the new acting warden join the tour.

Late that night four more were added, described only by agency: two FBI and two from the Justice Department’s Office of the Inspector General. The jail’s concern was practical: “I was hoping to get the names so we could ensure we have enough vests for everyone.”4

The visit took place on 15 August 2019. At 9:40 a.m.: “Ok we are heading over now.” At 2:17 p.m.:

Thank you both for everything today — really appreciate it, and lovely to see you, as always! The following morning: “Thank you for your guidance during the tour.”4

Two different sheets are involved and this page keeps them apart. The visitor list in the 13 August request runs to eight lines. The roster with titles circulated on 14 August is a different document listing ten from the Justice Department. Much of both is redacted; this page names only those its cited sheet names, and supplies nothing for any barred line. Audrey Strauss’s page covers the arrangement of the same visit from her side.4

The dismissal, and the work after it

Epstein’s death ended the prosecution but not the office’s work on the matter. On his direction, “with leave of the Court,” the indictment was dismissed.1 He remained the addressee of the office’s principal Epstein work into 2020:

  • Both prosecution memoranda of December 2019, on a corporate prosecution and on the co-conspirators, are addressed to him.9
  • The office’s grand jury subpoena to the Interlochen Center for the Arts went out over his printed name.10
  • On 7 December 2019 he asked: “Are there any new allegations of abuse as minors in the filings this week by attorney Jordan Merson? Geoff”.11
  • In March and May 2020 he was handling the Epstein estate and probate strands, including the Virgin Islands: “Ha! Now I’m getting emails from line assistants in the VI. Can you have someone call him?”12
  • On 8 June 2020, under the subject “Re: Prince Andrew”: “Let’s set up a call on this for 2:15.” That is ten days before the meeting at which the Attorney General asked him to resign.13

A correction this page occasions

A reply of 5 December 2019 from his office, in the unrelated Avenatti prosecution, has been described on this wiki three times as going out “over the signature of Geoffrey S. Berman.” Read at 400 dpi that is wrong. The sheet closes with his name and title set in printed capitals and, beneath them, “By: s/” over a barred name and the words “Assistant United States Attorneys”. There is no ink signature of his and no “s/” against his name. It went out over his name, signed by somebody else. That page has been corrected.14

The removal, and what the release does not contain

He left office in June 2020. On this, the release is thin, and the page will say so rather than fill the gap from memory.

There is no contemporaneous Justice Department document about the removal in the release at all: no letter from the Attorney General, no resignation letter, no statement, no internal e-mail. Searches for the obvious phrasings return nothing.5

What the release does hold is press digest, collected by the FBI’s own public affairs office. The fullest is a news briefing of 10 July 2020 summarising his closed-door testimony to the House Judiciary Committee the previous day: that Attorney General Barr pressed him to resign at a meeting on 18 June 2020 and raised the chairmanship of the Securities and Exchange Commission and the head of the Civil Division, and that he answered:

I said that there was no job offer that would entice me to resign from my position.

That is a press summary of testimony, not the testimony. A trade newsletter in the release says a transcript was attached to it; the transcript is not in the release, and the sentence above returns exactly one document corpus-wide, which is the digest. Cited at the tier it deserves and no higher.5

How much of the release is actually about him

At least 986 documents, on a seven-form name key. The figure is a floor rather than a convergence, and two things must be said in the same breath as it.

First, the bare surname is not a key for this man. It reaches 1,993 documents, and those partition cleanly: 986 him, 469 the district judge only, 196 other Bermans and firms (Hagens Berman, Neuberger Berman, Amy Berman Jackson, Howard Berman), and 342 unresolved. Nearly a quarter of the surname’s reach is somebody else.6

Second, most of his own 986 is not about him. About 489 of them carry his name only as his office’s printed signature block on a filing or a subpoena, which records the office rather than the man. The productive seam is much smaller and much better: of the 93 documents the sender-line query "From: Berman" returns, all 93 were read and 92 are genuinely his.6

One specific trap. A memorandum this wiki already cites is unreachable by any clean form of his name, because its searchable text renders the forename “Geoffre S. Berman”. Anyone rebuilding this evidence set from a name search alone will silently miss it.6

The release contains no Justice Department document about the removal, and that was tested by opening the documents rather than by counting zeros.The four exact phrases "Berman stepped down", "Berman ouster", "Berman was removed" and "removal of Geoffrey" each return 0, but a zero on an exact phrase is a claim about the phrase. So the broader sets were taken and read: "Berman" AND "removal" returns 13 documents and all 13 were opened; "Berman" AND "resign" returns 16 and all 16 were classified. Of the 13: ten are press (congressional-hearing schedule listings in a news digest, a DailyMail report, a Washington Post column, a New York Times digest) and three are false hits about other people entirely: a different prosecutor’s termination for bribery, and a passage about Steve Bannon. Of the 16: fourteen are press, none is a Justice Department document, and the two remaining are one filing produced twice: Ms. Maxwell’s Reply In Support Of Her Objections to Unsealing Sealed Materials, No. 1:15-cv-07433-LAP Doc 1073, filed 1 July 2020, which cites a Guardian article. Twenty-nine documents, not one of them from the Department. There is and there is no letter from the Attorney General, no resignation letter, no statement and no internal e-mail.
