Dawn L. Henry is an attorney who was Commissioner of the U.S. Virgin Islands Department of Planning and Natural Resources from 2015 to 2018. DPNR, through its Division of Coastal Zone Management, was the agency that licensed and policed construction on Great St. James and Little St. James. She signed the 2016 settlement of the territory’s enforcement action against Epstein’s company, she refused in writing in 2017 to sign the instrument that closed it until its wording was changed, and she corresponded with Epstein directly, without counsel on either side, for three years.

⚠ THIS PAGE IS SCOPED ON A REGULATOR’S CHANNEL, MARCH 2015 TO MAY 2023. It is not a career and it is not the island’s construction record, which belongs to the island’s own page and is not re-told here. The correspondence runs March 2015 – December 2018; her own published account of it is February 2020; the litigation layer, in which a bank quoted her against her own government and a newspaper reported that she had been quoted out of context, is 2023.

⚠ Nothing here rests on her having held the office. The contrast is in the record: when the enforcement acts of 2019 were the agency’s and not hers, she is simply absent from the paper, and no claim on this page is drawn from it.14

⚠ What reaches her, and the man the surname does not reach

Her name is in this release in at least seven printed forms, and the commonest short query finds only about three-quarters of them. Measured as sheets and as containers over the whole released corpus, with an invented control token returning zero throughout: the full name 557 sheets in 507 containers; the name with the middle initial 94 in 76; the title with the surname 239 in 220, of which 135 containers carry no form of her forename-plus-surname at all; the honorific with the surname 28 in 28; the abbreviated title 40 in 40. Their union, with two further OCR forms, is 784 sheets in 688 containers, from which two sheets were removed on reading as a different woman entirely, a technology-company executive in a securities prospectus. The floor for this subject is therefore 782 sheets · 686 containers · 767 distinct normalised texts, largest repeat 7, which is to say replication here is effectively nil: this is a large body of separate small instruments, not one document copied.4 Every passage quoted below was put through the desk’s copy-divergence screen before it was used, and each note states that span’s own verdict; the verdicts are not interchangeable and are never grouped.15

⛔ The bare surname must never be used, and Mr. Henry is a different man. That form stands on 18 sheets in 16 containers and reaches a roofing contractor bidding on work for Epstein’s islands. Mrs. Henry stands on 9 sheets in 8 containers and reaches nobody connected with her at all: every one is a guest-list or donor-roll line in which Henry is a forename. Attorney Henry reaches three other men. A surname route conflates them; this page uses none.4

March 10, 2015: her nomination arrives in Epstein’s files as political intelligence

Ten months before Epstein bought the second island, the identity of the regulator who would police it was e-mailed to him. On Tuesday March 10, 2015, Cecile de Jongh sent him a message headed Back Brief:

Below are some back brief bullet points on some issues in preparation for your meeting with Mapp on Thursday. I’m not sure what the meeting is about but I wanted to give you a sense of what is happening in the community and issues that he has raised.16

Its first bullet, before the Treasury, the highway funds and the HOVENSA refinery:

Mapp has not appointed JP Oriol as DPNR Commissioner. To lead the DPNR, he nominated Dawn Henry, an attorney who has worked as legal counsel in the department’s Division of Environmental Protection for the last 10 years.16

Epstein’s reply, the same day, is two words: great help.16

Documented fact: a briefing prepared for Epstein ahead of a meeting with the Governor named her nomination to lead DPNR on March 10, 2015, and he acknowledged it. ⚠ Question, and it must stay a question. The deeds to Great St. James were recorded in January 2016 and the Division ordered development on it stopped in April 2016. What does it mean that the incoming regulator’s name reached him as political intelligence ten months before he bought the property she would police? Nothing read for this page records him acting on it, and this page draws no inference.

August 2016: the settlement, the helicopter, and the meeting that stayed on shore

The settlement of the 2016 notice of violation was signed by Epstein on July 22, by the Director of Coastal Zone Management on August 1 and by her as Commissioner on August 4, 2016. That signature and the enforcement sequence around it are on the island’s page and are not re-told here.1

Two days before she signed it, he offered her a helicopter. His message of Monday August 1 reads, in full, and is quoted from the image:

Dear ms Henry , I tried to call today as agreed - does any day this week work for you to visit the island with me. thanks.17

Her reply, Tuesday August 2, also quoted from the image:

Hi Mr. Epstein:

I spoke with Cecile DeJongh regarding scheduling a meeting. Mrs. DeJongh will contact my assistant to schedule a date after I return from NY. We are looking at early September.

Thanks Dawn Henry17

⚠⚠ A CORRECTION PUT TO THIS PAGE AND OVERTURNED AT THE IMAGE. The desk was told that a sibling rendering of this message spells the surname two different ways within one sentence, and that neither spelling could be repaired. At the image the sheet prints DeJongh in both positions. The variant form belongs to the extractor, which misreads the capital J, and treating an extraction artefact as a document’s own spelling is the error this page exists to avoid. The quotation above is taken from the image, and the correction is recorded rather than quietly made.1718

His answer, the same day:

thank you for your response. I appreciate your participation. fyi, if you would find amusing and useful I am flying in today and could take you , or you and jp for a helicopter overview. pick you up at the airport and return you in under 30 minutes. otherwise - see you in september.17

Hers, in full:

I have a public hearing scheduled for this afternoon. Dawn17

Documented fact: on August 2, 2016 the regulated party offered the sitting Commissioner of the regulating department, and jp, the Director who had signed the settlement the day before, a helicopter overview of the island, collection at the airport and return inside thirty minutes. Her written answer was that she had a public hearing that afternoon. Two days later she signed the settlement.

⛔ The absence is stated at the thing actually unrecorded. The release does not record that she accepted, and it does not record that she declined in terms. It records that she answered with her afternoon’s commitment. Nothing read establishes that a flight occurred.

The scheduling channel is visible the same morning. De Jongh to Epstein, August 2:

Commissioner Henry just returned my call. She said that when she spoke to you she relayed that she could not meet with you until she got back from NY in September. I asked when in September and she said anytime from September 1st onward. She asked that we set up the date and time with Jeneva Lawrence in her STX office.19

and earlier that morning: “I left a VM for Jeneva Lawrence (scheduling secretary on STX). She has not called back so I will call again at 10:30.”19 Jeneva Lawrence is named here because she is a government employee performing an official function, and because the function (who controlled access to the Commissioner’s diary) is the finding.

⚠ August 26, 2016: a visit to Little St. James was proposed, and did not happen

A thread of Friday August 26, 2016 between Epstein and his own assistant Daphne Wallace runs: “Commissioner Henry is requesting to move the meeting this afternoon from 2 pm to 3 pm”; then Epstein, “Ask if she would come to office as she will be in red hook”; then Wallace:

Commissioner Henry thanks you for the excellent suggestion. She will try to come down on the 2 pm boat from St. John, and meet with you at STC. Shayra will try to call me when she knows the Commissioner is on her way.20

and then:

Shayra, the Commissioner’s assistant, is unsure that going over to LSJ this afternoon, with the Commissioner having a 4 pm meeting at her office, will work today, so she is respectfully requesting for the meeting to remain at the STC office.20

Wallace’s covering line, forwarding the thread on: “The STC office is the confirmed location of the meeting with Commissioner Henry this afternoon.”20

Documented fact: three weeks after she signed the settlement, a crossing to Little St. James was canvassed for that afternoon, her assistant said it would not work, and the meeting was held at Epstein’s St. Thomas office instead. ⚠ Shayra is this sheet’s spelling; the same staff member is Shyra Raymond-Henley on departmental mail, and neither spelling is repaired inside a quotation.2021 ⚠ The sheet’s own transmission stamp gives the year as 2018. Its continuous prose gives Friday, August 26, 2016 three times, and August 26 fell on a Friday in 2016 and not in 2018. The date on this page is taken from the prose; the stamp is wrong and is recorded rather than quietly followed.20

September–December 2016: the channel ran through the Governor

⭐⭐ This is the part of the record that neither the island’s page nor any prior desk reading of this subject carries, and it is the largest thing on this page.

On September 9, 2016 Epstein forwarded a DPNR permitting e-mail to “Governor Kenneth E. Mapp” under a covering note offering the Governor a 200-page draft of legislation. The covering note, in his own words:

1 . I have the first draft of the trust legislation, its rough but i am confident you will get the product on time. . its over 200 pages . I am willing to jump through the new dpnr hoops i( below ) in order not to create waves. I will be patient and spend the thousands of dollars needed for unncessary surveys to point out where the garbage is.22

The message he was forwarding is from his own counsel Erika Kellerhals, of the same afternoon, to Epstein and to the Director of Coastal Zone Management, copied to Cecile de Jongh:

JP, Commissioner Henry, Cecile, Amy and I had a productive meeting this afternoon. The following deliverables are required with respect to the clean up permit:22

and, after two numbered deliverables:

Commissioner Henry indicated that she would expedite the permit approval. I know you are travelling next week so please advise to whom we should submit this additional documentation.22

⚠ Tier, and it matters. That the forward was sent to the Governor, and what the covering note says, are documented fact, read at the image. That she said she would expedite the permit is counsel’s own report of what she said: a credible account by an identified lawyer with direct knowledge, not her words, and not independently verified. ⚠ The Amy of that sentence is a forename only and is not identified here. ⚠ A private citizen sat in a departmental permitting meeting; that she did is recorded, and no inference is drawn from it.

Five days later the Governor reported the Commissioner’s account of that meeting back to the regulated party’s own phone. In an SMS extract whose other party the extraction labels only as unknown, and whose messages are arranged on the extract’s own date rows, Ken Mapp wrote on 2016/09/14:

Good morning, Comm Henry advises that she met with ur team and ur counsel. All issues were placed on table, discussed and that there is an agreed upon strategy going forward that will address all of the issues and permits.9

On 2016/10/07 the other party wrote I'm in all next week. STILL NO PERMITS; Mapp answered Ok, will inquire. Leaving for 14 days. Any new iterations?; and on 2016/10/08, after a complaint about six months’ wait for approval to replace dock timber, Mapp wrote:

I do. I will discuss with Comm henry. I thought this was fully settled.9

Documented fact: the Governor of the U.S. Virgin Islands undertook in writing, to a party under his environmental regulator’s enforcement, to inquire about that party’s permits and to discuss them with the Commissioner. ⛔ Stated at the thing actually unrecorded: nothing read records that he did so, what she said if he did, or that any permit moved as a result. ⚠ The extract declares its clock as UTC and its dates stand on its own date rows rather than in prose; both are recorded here and neither is relied on beyond the calendar day.

⚠ What Epstein’s own architect said about it

On November 29, 2016 an architect advising his side, John P. Woods, AIA, reviewed a draft letter to the Department and warned against sending it:

The CZM program is Federally funded. They won’t like the politicization of the review process that has the Governor interfering with it.23

⚠ That is one professional’s assessment in an internal e-mail, not a finding, and the release contains no response to it. ⛔ Other sentences of the same message concern a named departmental employee in disparaging terms and are neither quoted nor described here. ⚠ A producer withheld a name elsewhere in the same paragraph and this page does not supply it from context.

The same day Darren Indyke sent the architect a corrected draft: “I changed a mistaken reference to Commissioner Barnes in the title of the document and the last paragraph of it. It now properly refers to Commissioner Henry.”23 ⚠ Alicia Barnes held the office from 2011 to 2014; Epstein’s lawyer had addressed a draft to the wrong Commissioner.3

March 2017: the meeting the island’s page records as unrecorded

The island’s page carries the March 9–19, 2017 thread in which Epstein negotiated the penalty with her directly, and records that whether the meeting she offered to set for the Wednesday took place “is not recorded in the released material.” The record does carry something, from a route no name-scoped reading of her e-mail would reach.

In the Governor’s own SMS thread, on 2017/03/18:

Sure, expect the commissioner to reach out to you10

and on 2017/03/21:

Good afternoon, I understand that u r meeting with Comm Henry tomorrow. Let’s meet after ur meeting with her. I leave for stx after my press conference tomorrow. Will be back 3 days next week10

to which the other party answered “Sorry , do you mean for me to come see you tomorw after Henry?”10

Documented fact: on March 21, 2017 the Governor wrote that he understood a meeting with the Commissioner was set for the following day, March 22, 2017, the Wednesday, and proposed to meet the other party afterwards. ⛔ It still does not record that the meeting happened. It records that the Governor expected it, wanted to be seen after it, and had told the regulated party two days earlier to expect the Commissioner to make contact. ⚠ The day after that Wednesday, Jeneva Lawrence circulated departmental mail to the Commissioner and to Shyra Raymond-Henley headed Telephone Call to Mr. Epstein; the copy read carries no body text.21

The access channel is continuous through 2017 and into 2018, and it is not about the permit; it arranges the meeting. Among its instruments: “Hello Ms. Henry. Confirming Jeffrey will call you today at 2:00pm”, December 29, 2016; a conference call booked for March 7, 2017; a subject line reading Commissioner Henry Meeting with Mr. Epstein - St. Jim Island, March 21, 2017; an alert of March 30, 2017 that “JE wants to speka with Commissioner Henry today” (sic); a phone date entered in his own Paris itinerary for April 4, 2017; an assistant’s message of April 19, 2017 headed “Trying to call you now - I have Commissioner Henry”; and his answer to his office on June 5, 2017, asked whether he had ever spoken to her, “no but id like to”.24

⭐ Two meetings are recorded as confirmed, and both corroborate what the island’s page says the record lacks. On June 19, 2017 his own assistant Daphne Wallace wrote to him: “Your meeting with Commissioner Henry today, June 19, 2017 at 12:30 pm is confirmed.”25 And his itinerary for February 21, 2018, circulated by his assistant Bebe Avdiu the previous evening, carries “10:00am EST (11am VI time) Meeting w/Commissioner Dawn Henry” at the Commissioner’s St. Thomas office, with a member of his household staff assigned to drive him.26 ⚠ That driver is a private employee and is described rather than named. ⚠ No document read records what was said at either meeting.

⭐ May 31 – June 12, 2017: she refuses to sign what he had already signed

On Wednesday May 31, 2017 he wrote to her directly (spelling damage in the original, not repaired):

commsionner if we can settle past matters soon i would Ike to have a meeting with jp to discuss, buiding sheds to protect aganst hurricanes this season, i am going to withdraw the other blua issues. separate from flagole5

Her reply the next morning, signed Ldh:

That would be good. Did you have any comments to the draft consent decree I sent. Let me know when you withdraw.5

Documented fact: she tied the consent decree to his withdrawal of the Board of Land Use Appeals matter, in her own words.

A week later his office sent her the redraft, and called the money a grant. Lesley Groff, Thursday June 8, 2017, carrying his message:

Please see the attached. It essentially expands the release.

The $160K grant is also being sent to your office today.

I was hoping to meet with JP to review future plans on June 17, if possible7

Her answer, Sunday June 11, 2017, 12:22 p.m., is the document this page is built on. It is reproduced in full and was read at the image:

Hi Lesley:

Thanks for the email. I explained in a previous email to Mr. Epstein that the changes made to DPNR’s draft consent agreement is not only substantive, but also does not fall within the language of “SEP”. I was asked and I agreed to allow for a SEP in lieu of a penalty. The language DPNR drafted is the correct language. I can tweak the language, but the language can not read like the Respondent is making a donation to settle this matter. As before I was told about a specific issue and language was worked out. I requested that Great Jim, indicate with specificity the issue to see if language can be worked out. However, the draft document that Mr. Epstein signed, I can not sign. Finally, there will continue to be delays, with every suggested language change.

Dawn Henry7

Groff’s reply: “Thank you Commissioner Henry. I will pass this along to Jeffrey… Enjoy your Sunday”.7 His, twenty-one minutes later: “Can we sign a more comprehensive release on both sides .”27 Hers, the next morning: “The best way to answer that question is to send proposed language.”28

⛔⛔ THIS IS THE ASYMMETRY THAT JUSTIFIES THIS PAGE. The island’s page records that the matter closed in June 2017 with a consent agreement funding a $160,000 project in lieu of penalties and with no admission of liability. It does not record the refusal that came first: the regulator declining in writing to execute the instrument the regulated party had already signed, on the express ground that his redraft made the payment read as a donation rather than a penalty substitute, three days after his own office had called that payment a grant. The two sentences stand in one document, read at the image, and nothing on this page needs more than them.

⚠ What she agreed to is in the same paragraph and is not softened: “I was asked and I agreed to allow for a SEP in lieu of a penalty.” The supplemental environmental project was her concession before it was her objection.

July–August 2017: she checked his account against the Coast Guard’s, and she said no

On July 19, 2017 he wrote: “A fairly large boat has crashed on the island. no people found but lots of fuel and dead fish on beach, we have called police and customs.” Her reply two days later: “I fell behind on my emails. I will inquire. Thanks for the heads up.”29

On August 7, 2017 she came back with the answer and it was not his. In her own words, over the quoted-printable damage the sheet carries and which is not repaired: “did not report any fuel spill” … “Maybe you have a different incident”.6

Two regulatory instructions in her own hand, the same day:

Hi Jeffrey: Are you experience sargassum issues. If you are, you need written permission from DPNR for equipment to clean. DPNR is well aware of this issue territory wide and is currently working with other hotels. Please let me know. Dawn30

and, asked what he should do with the seaweed: “Everyone takes it to the landfill”, followed by a direction to submit a letter to the Division requesting permission and stating how and where he would dispose of it.6

Documented fact: the regulator tested the regulated party’s reported incident against another agency’s record, told him in writing that the two did not match, and required prior written permission before he could clear his own beaches. ⚠ On August 1, 2017 he had complained to her that “I was surprised to hear that czm want to inspect the islan= , for the minor permits”; the damage is the extraction’s and is not repaired.31

⭐ December 2017: $25,000 into her own department

Six months after refusing to let a penalty substitute read as a donation, she chose its destination.

The sequence begins on December 21, 2017, three months after the hurricanes, inside a thread in which she is processing his permits. Hers, that morning:

Hi Jeffrey: Sorry to hear progress has been slow on the islands. I have been issuing repair and maintenance request for CZM throughout the territory within 2 days of the application being deemed complete. The last I heard, you were working on submitting the request. Do you know if the application was submitted.32

and, later in the same thread, “Dealing with the aftermath of a hurricane is always more challenging than the hurricane itself.”32 ⛔ A clause of his in this thread describes a named-by-role third party’s medical condition and is neither quoted nor described here.

His reply, the same morning, is the hinge:

we gave the salgave co 25 k to the home for girls in st croix. . any suggesttions for another 25k ? - with the deductions for low income. and reduced corp rate. VI is going to need a new source of rev.32

⚠ salgave is the extraction’s rendering and is not repaired. This page does not identify the institution he refers to and nothing read connects it to anything other than a donation.

On December 22 he wrote to her again; the whole body is one word, library?33 On December 27, taking the dates from the thread’s continuous attribution lines and not from its header stamps, he asked which library org ? and she answered, read at the image:

All public libraries are under DPNR. I was thinking either the Charles Wesley Turnbull Library on St. Thomas or the Sprauve Library on St. John since you live in this district. If you prefer to donate to school libraries I can connect you with the Commissioner for Education. Either way the Territory wins.

Dawn8

His answer: “ill make it 25k to dpnr with a cover letter for public library . merry xmas”. Hers, in full: “Thank you Jeffery. God’s blessings for the New Year.” over Dawn.8

He then put Cecile de Jongh to drafting the cover letter, asking which part of the library the money should go to, “In the cover letter, do you want the donation to go to a specific program or area of the Library?”, and he answered “no just for public library”.34 JPMorgan Chase’s statement of facts in the territory’s action against it records that on December 27, 2017 he directed his accountant Richard Kahn to write a $25,000 cheque from Southern Trust Company, Inc. to DPNR for a donation to a public library; that is the bank’s pleaded fact and the cheque itself was not read for this page.35

⚠⚠ OCR TRAP CAUGHT AT THE IMAGE, AND IT IS THE REASON THE RULE EXISTS. The text layer of the sheet carrying her message renders the library as Tumbull. The image reads Turnbull, and the preceding sheet of the same container spells Charles Wesley Turnbull Library correctly in de Jongh’s own prose. A page quoting the extraction would have published a mangled name for a former Governor of the territory.834

⚠ The within-day ordering of the December 27 thread cannot be asserted. The header stamps place his 25k message earlier in the morning than the message it answers. This page gives the date and no time, the same defect the island’s page already flags on the March 2017 thread.8

Documented fact: the sitting Commissioner of DPNR proposed two named public libraries to a party under her department’s enforcement as destinations for his money, offered to introduce him to another Commissioner if he preferred a different sector, wrote Either way the Territory wins, and thanked him when he answered 25k to dpnr. ⚠ Both facts stand in one page and neither is softened: she refused in June to let a penalty read as a donation, and in December she chose where a donation would go. ⛔ This page draws no conclusion about any exchange, and the release supports none. The sequence is the finding; the inference is not.

December 2018: she tells him she is leaving

On Wednesday December 12, 2018 he wrote to her, in full:

dawn, i hear you are leaving . what will you do next please keep in contact36

Her reply, Sunday December 16:

It appears so. This is what happens when there is a new administration. I was scheduled to go on vacation on the 18th and by time I return, the governor elect will be sworn in. Dawn36

His answer, three minutes later: New job?37

Documented fact: the correspondence outlives the enforcement matter by eighteen months, runs to the end of her tenure, and ends with the regulated party asking the departing regulator to stay in touch. Nothing read records a reply to the last question.

⚠ 2019: the file is not hers

The Division’s letters of January 28 and March 12, 2019 on the later cease and desist order (their substance is on the island’s page) are signed by CZM Legal Counsel Norman and copied to “Jean-Pierre L. Oriol, Commissioner Designee”. She is nowhere on them.14 ⚠ Counsel’s forename is OCR-mangled on the sheet read and is not reproduced. ⛔ The Division’s office address, a telephone line and a fax line print on one of these sheets and none is reproduced.

This is the cleanest test the page can offer of its own scope. When the acts were the agency’s and not hers, the paper says so. No claim here is drawn from her having been Commissioner during a period.

⭐ February 18, 2020: her own account, on the record

After leaving office she gave an extended interview about Epstein to the Virgin Islands Daily News, published February 18, 2020 under the headline “Former DPNR Commissioner says territory must learn from Epstein’s legacy”. It is in this release as an exhibit to a bank’s filing three years later. Her words, as the article prints them:

“Mr. Epstein was in a pretty unique situation in the territory,” Henry said. “Coming into such a small community, you’re going to have a big impact.”3

“Mr. Epstein was not treated any differently than any other person that came to the department,” Henry said. “And that upset him. But I let Mr. Epstein know this is what it is. And I personally feel that when I was the commissioner for DPNR, for the first time, the department not only issued — on paper — notices of violation, but we followed through with them.”3

On what the negotiations were like:

“You look out at the table and you have Mr. Epstein, and then he has, I guess, the knowledge that money can buy, let’s put it that way. Or the power that money can buy,” Henry said. “It can be intimidating.

“You have this thing in the pit of your stomach, because you know you’re going to have to tell them what they don’t want to hear. And you know it ain’t going to go well.”3

⭐⭐ On the Governor, and the documents bear her out. The article reports: Henry said Epstein wasn’t afraid to take his complaints to the highest authorities.

“Epstein even took me to the governor,” and complained to Mapp that his construction plans were being held up by DPNR, Henry said.3

She said Mapp backed her up, telling Epstein “‘If the regular person on the street has to do it, you with all the resources, you could hire an engineer, just apply. Get the permits,’” and added of Epstein, “He was accustomed from the previous time, not having to do those things,” she said.3

⚠ Tier, precisely. That she said these things in a published interview is documented. That Epstein took his permit complaints to the Governor is independently corroborated by the Governor’s own messages above, read at the image. That Mapp said those particular words to Epstein is her account alone; nothing read records it, and the Governor’s messages read for this page say something milder: that he would inquire, and that he thought the matter settled.

⭐ On her own jurisdiction, and on the island:

“That has nothing to do with my jurisdiction. You have to understand, we all have to stay in our lane,” Henry said. “That’s not my lane. When I was the commissioner for DPNR, I didn’t treat somebody that committed a crime, that did their time, any different.”3

DPNR was one of the few government agencies with the authority and the ability to physically access Epstein’s islands, and while Henry said she never personally set foot on either island, DPNR enforcement officers did.3

⭐ And on money:

“I do believe that the level of his money influenced their behavior with him. I’m sure,” Henry said.3

“How many of them do you think would have said to Mr. Epstein, `You know Jeffrey, you know this thing with these young girls? This isn’t right, you shouldn’t be doing that.’ People don’t do that. We don’t.”3

“In the end,” Henry said, “now the man is dead, the government is doing what the government is doing. But when he was alive, we weren’t really willing to hold him accountable.”3

“I think we need to move forward and learn, just really deeply, how we allow money to influence decisions and things that we do that affect the greater community,” Henry said.3

⚠ Read against December 2017, the last sentence is the sharpest thing on this page, and it is hers. This page does not characterise it. It sets the two documents beside each other and stops. ⛔ Passages of the same article concerning Epstein’s abuse of minors and the territory’s own civil complaint are neither quoted nor described here; they are not about her. ⛔ This page quotes around a passage the producer marked and supplies nothing from context.

May 2023: a bank quotes her, a newspaper says out of context, and she will not comment

In Government of the United States Virgin Islands v. JPMorgan Chase Bank, N.A., No. 22-cv-10904 (JSR), the bank opposed the territory’s motion to strike its affirmative defences by arguing that the territory had itself protected Epstein. Its brief names her:

Not only did the DPNR take his money, Dawn Henry, the DPNR’s commissioner, actively facilitated Epstein’s apparent preference to donate to a school library, writing to him: “If you prefer to donate to school libraries I can connect you with the Commissioner for Education. Either way the Territory wins.”11

and, two sections later:

Other USVI officials (including Governor Mapp, Dawn Henry, and First Lady de Jongh) visited Epstein’s islands, Little St. James (“LSJ”) and Great St. James (“GSJ”), with regularity.11

⚠⚠ THREE THINGS, BECAUSE THIS IS THE EASIEST PASSAGE ON THE PAGE TO MISUSE.

First, it is a litigant’s advocacy, not a finding. It is a defendant bank’s characterisation in a brief, filed to defeat a motion. No court tested it; the action settled.

Second, the quotation inside it is of a document this page holds, and the primary document governs. Either way the Territory wins was read at the image on her own e-mail; the brief is not needed for it and is not relied on for it.

Third, the visit allegation is contradicted by her own published words, and the contradiction is the finding. The Virgin Islands Daily News reported, of that filing: “Henry, former Commissioner for the V.I. Department of Planning and Natural Resources, told The Daily News in a February 2020 interview that she never personally set foot on either Little or Great St. James island, but DPNR officers did visit the islands to enforce zoning and environmental laws.”12 The same report states that the filing “includes a quote from Henry that was taken out of context from a Feb. 18, 2020, article in The Virgin Islands Daily News.”12 ⛔ Nothing read for this page records a visit by her to either island. The one crossing the release does record being canvassed, that of August 26, 2016, was not taken up, and the one conveyance she was offered, the helicopter of August 2, 2016, produced an answer about a public hearing and no record of a flight.2017

⭐ What she would not say, and the measurement behind it

When reached by phone Thursday, Henry declined to comment, citing her upcoming deposition in the case.12

Documented fact: in May 2023 she declined to comment on the bank’s filing and gave a pending deposition as her reason.

⛔ No deposition of her appears anywhere in this release, and the measurement was built name-free before it was intersected with her. The deposition vocabulary is richly present across the corpus against an invented control token returning zero: "deposition of" stands on 4,871 sheets in 2,416 containers, "videotaped deposition of" on 502 in 378, "deposition transcript" on 996 in 533, "notice of deposition" on 254 in 174. Armed in the other direction too: the same constructions intersect with four other participants in this matter at 20, 30, 44 and 120 sheets, so the probe fires. Intersected with the 782-sheet, 686-container union of her name forms, every one of them returns nothing. The only sheet in that union carrying the word at all is the newspaper report in which she declines to comment.13

⛔ THE WINDOW, MEASURED, AND IT IS WIDE. The carrying series is deposition material filed in that same action: 406 sheets in 177 containers in this release, with filing stamps across 2023 and 2024. The absence therefore sits inside a live series that runs on for more than a year past the date she said a deposition was coming, not at the end of a dying one.13

⚠ An absence measured this way is a statement about this release and not about the world. It records that no deposition of hers appears in what was produced. It is not a claim that she was not deposed.

What this page does not establish

  1. ⛔ No quid pro quo, and the record supports none. What the record supports is a sequence: a briefing in 2015, a helicopter offer two days before a signature in 2016, a Governor undertaking to discuss permits with her in 2016 and 2017, a refusal in June 2017, and $25,000 into her department in December 2017. The sequence is the finding. The inference is not, and this page does not draw it.
  2. ⛔ Nothing read records that she accepted any conveyance to either island, or set foot on either. A bank’s brief asserts regular visits; her published interview denies them; no primary document read records a visit by her, and the two crossings the release does record being canvassed or offered were not taken up. ⚠ That is consistent with her denial and is not proof of it: an absence in this release is a statement about what was produced.
  3. ⛔ Nothing read records what was said at the meetings of June 19, 2017 or February 21, 2018, or at the March 22, 2017 meeting the Governor expected.
  4. ⛔ Nothing read records whether the Governor did discuss the permits with her, or what followed if he did.
  5. ⛔ No deposition of hers is in this release, measured as above.13
  6. ⚠ Whether this release discusses her without any form of her name, as “the Commissioner” unqualified, has not been measured. That construction is not name-scoped and would have to be screened against every officeholder in the release. I could not look.
  7. ⚠ Her appointment is dated here only as she dates it. The 2015 briefing records a nomination; the 2020 interview says she served “from 2015 through 2018” and that she was appointed by Governor Mapp. No instrument of appointment or confirmation was read for this page.163

⚠ What belongs to the island’s page, and what is new here

Already carried by Great St. James and deliberately not re-told: the cease and desist order of April 2016 and the notice of violation; the terms of the 2016 settlement and her signature on it as Commissioner; the March 9–19, 2017 penalty thread and its quotations; the April 18, 2017 exchange and its UTC/local-time divergence; the terms of the June 2017 Supplemental Consent Agreement and the cheque sequence; the prepared Superior Court complaint of March 8, 2017 captioned against the Department and against her personally, with its blank civil number and empty signature line; the 2019 cease and desist order and the correspondence on it.

New here, and on no other page of this wiki: the March 2015 briefing naming her nomination · the August 1–2, 2016 direct thread and the helicopter offer · the August 26, 2016 meeting and the Little St. James crossing that did not happen · the September 2016 forward to the Governor and counsel’s report that she would expedite the permit · the Governor’s own messages of September and October 2016 and March 2017 · the architect’s warning about the Governor’s interference · Indyke’s correction of the wrong Commissioner’s name · the confirmed meetings of June 19, 2017 and February 21, 2018 · the May 31 – June 12, 2017 refusal to sign · the July–August 2017 fuel-spill contradiction and the sargassum instructions · the full December 2017 donation sequence from December 21 · the December 2018 departure exchange · her February 2020 interview · the May 2023 filing, the contradiction about island visits, and her refusal to comment · the absence of any deposition.

⚠ One correction that belongs to the island’s page and not to this one. That page says of the March 2017 thread that whether the meeting took place “is not recorded in the released material.” The Governor’s messages record that a meeting was expected for the Wednesday, and his own itinerary and his assistants record two later meetings as confirmed. The statement as it stands is too wide, and its remedy is that page’s.

Most of her own words here stand in ONE rendering, which is the weaker clean, and that is stated rather than smoothed over. An earlier reading of mine recorded the hold him accountable span as agreeing across five copies; the phrase occurs on five sheets but the SPAN, with its surrounding text, stands in one. A count measured on a bare phrase is not a count of the span, and the correction is recorded rather than quietly made. ⚠⚠ TIER: this is a newspaper interview, and what it establishes is that she said these things in print on February 18, 2020 — not that what she said is so. Where the article reports her account of someone else’s words, the page says so. ⚠ The page offers no view on whether Epstein was in fact treated no differently; the documents above are what they are. ⚠ The article’s photograph captions name three other people and a photographer; the byline and the reporter’s name are reproduced because a byline is published. ⚠ A prior desk reading of the sheets carrying this article characterised them as press about an unrelated matter and did not read the interview. That is corrected here. ⛔ Passages of this article concerning Epstein’s abuse of minors, a territorial complaint, and funding of activities involving children are neither quoted, described nor relied on: they are not about this subject. ⛔ The producer withheld an island name in some clauses of this printout and not in others. 4. The forms of her name, the other people the surname reaches, and every count above were established by this desk’s own reading of the released material. No query form or retrieval route is published. Units and populations, each stated per figure: sheets and containers (distinct document identifiers) over the whole released corpus, with an invented control token returning 0 on every population. Full name 557 sheets / 507 containers; name with middle initial 94 / 76; title plus surname 239 / 220, of which 135 containers carry no forename-plus-surname form; honorific plus surname 28 / 28; abbreviated title 40 / 40; two further OCR forms add 2 sheets / 2 containers. Union: 784 sheets / 688 containers. ⚠ Two of those sheets were read and are a different woman — a named executive in a technology company’s securities prospectus — and are subtracted, giving the floor used above: 782 sheets / 686 containers / 767 distinct normalised texts, largest repeat 7. ⚠ It is a FLOOR, not a total: a sheet where a producer marked her name, or where the extraction destroyed it beyond the variant list read, is invisible to every figure here. ⚠ A phrase query cannot match a middle initial, which is why the short form misses about a quarter of the subject. ⛔ The bare surname is never used on this page: with an honorific it reaches a roofing contractor (18 sheets / 16 containers), with a different honorific nine sheets of guest-list and donor-roll lines in which Henry is a forename (9 / 8), and with a professional title three other men. ⚠ The three-line signature block and the Ldh initials are read from her own messages cited below. ⚠ An extraction form of her name that is an e-mail handle is excluded from the alias list and from this page. ↩ ↩2 ↩3 ↩4

It establishes that the paper reported her February 2020 denial and her May 2023 refusal to comment, and that the paper itself said the bank had quoted her out of context — not that the bank did. ⛔ The remainder of this sheet concerns a university, student visas and allegations about Epstein’s victims. None of it is about this subject, none of it is quoted, described or relied on, and the word victims on this sheet belongs to that reporting and stands in no position connected with her. ⚠ An earlier desk reading of this sheet described it as being about that university matter only and did not record that it also carries her rebuttal and her refusal to comment. 13. The absence was established name-free and corpus-wide first, with an invented control token returning zero, and only then intersected with the subject — the only form of absence claim this desk accepts. Units and populations, per figure, over the whole released corpus: "deposition of" 4,871 sheets / 2,416 containers; "videotaped deposition of" 502 / 378; "deposition transcript" 996 / 533; "notice of deposition" 254 / 174; "errata sheet" 280 / 182; "examination before trial" 11 / 10; invented control 0 / 0. Armed in both directions: the same leading construction intersects with four other participants in this matter at 20, 30, 44 and 120 sheets, so the probe demonstrably fires, and a planted nonsense deponent returns 0. Intersected with the 782-sheet / 686-container union of her name forms, every construction above returns 0; the single sheet in that union carrying the bare word is the newspaper report cited above. ⛔ THE WINDOW, MEASURED (and it is the measurement that decides whether the absence means anything): the carrying series is deposition material filed in the same action, 406 sheets in 177 containers in this release, whose filing stamps fall in 2023 (339 occurrences) and 2024 (5). The series therefore runs on for more than a year past the date she gave a pending deposition as her reason for silence — a wide window, not a vacuous one. ⚠ An absence measured this way is a statement about this release, not about the world: it records that no deposition of hers appears in what was produced. It is not a claim that none was taken. ⚠ A deposition of hers may exist and have been withheld, and that would itself be a finding; nothing read records a refusal, an exemption, a privilege claim or a non-production concerning her. ↩ ↩2 ↩3 ↩4

I tried to call today as agreed agrees across 13 copies; I spoke with Cecile DeJongh regarding scheduling a meeting agrees across 2 copies; could take you , or you and jp for a helicopter overview agrees across 3 copies; pick you up at the airport and return you in under 30 minutes agrees across 3 copies; I have a public hearing scheduled for this afternoon agrees across 2 copies. ⚠ The order of the two messages is fixed by the quoted nesting, which the document itself settles, and not by a clock. ⚠ jp is Epstein’s own abbreviation; this page does not expand it inside a quotation. ⚠ The desk’s blockquote control cannot resolve the DeJongh line against this sheet’s text layer, because the text layer is what the image corrected; the disagreement is disclosed above rather than hidden, and the image governs. ↩ ↩2 ↩3 ↩4 ↩5 ↩6

  18. https://epstein-data.com/EFTA00650411 p. 1 — a second rendering of the same pair of messages, cited only for the fact that a second rendering exists. Read from the text layer; I could not look at the image for this sheet, and nothing on the page is quoted from it. The span quoted from his message agrees across 11 copies, with 1 further match DROPPED because the anchor was absent from its flattened text; the verdict rests on the remainder and the drop is stated, not hidden; her reply’s surrounding span agrees across 2 copies. ⚠ Its text layer is where the variant spelling of the surname comes from; the image of the rendered sibling settles it and the page quotes the image. ⛔ Nothing from the header block is quoted, described or compared. ↩

  19. https://epstein-data.com/EFTA00650380 p. 1 — Cecile de Jongh to Epstein, Tuesday August 2, 2016, a thread of four messages. Read from the text layer; I could not look at the image for this sheet. She asked that we set up the date and time with is UNIQUE IN THIS RELEASE on the divergence screen — one rendering, so no copy family exists that could differ, which is a weaker clean than agreement across copies and is carried as the weaker one; I left a VM for Jeneva Lawrence agrees across 3 copies. ⚠ An earlier desk reading stopped this quotation before the scheduling secretary’s name. The editor has since ruled that junior staff of both offices are named where they act in an official capacity, so the quotation is completed here. ⛔ Contact values print on the sheet and are excluded. ↩ ↩2

  20. https://epstein-data.com/EFTA02044322 p. 1 — Daphne Wallace to Lesley Groff, forwarding a thread of Friday August 26, 2016 between Wallace and Epstein. Its subject line and three continuous-prose attribution lines give Friday, August 26, 2016; August 26 was a Friday in 2016 and a Sunday in 2018. The date on the page is from the prose and the stamp’s error is recorded rather than quietly followed. ⚠ Shayra is this sheet’s spelling of the staff member named Shyra Raymond-Henley on departmental mail; neither is repaired inside a quotation. ⛔ Contact values print on the sheet and are excluded. ↩ ↩2 ↩3 ↩4 ↩5 ↩6

  21. https://epstein-data.com/EFTA00447937 p. 1 — departmental mail from Jeneva Lawrence to the Commissioner and to Shyra Raymond-Henley, Thursday March 23, 2017, subject Telephone Call to Mr. Epstein. Read from the text layer; I could not look at the image for this sheet. ⚠ The copy read carries no body text at all, and this page states only what the envelope and subject line say. ⚠ The Commissioner’s name is truncated to Dawn Hen in the extraction’s recipient line; the form is an artefact and is recorded as one. ⚠ No name-free span on this sheet is long enough to anchor the divergence screen, so NOTHING WAS MEASURED for it and nothing is quoted from it beyond the subject line. ⛔ Contact values print on the sheet and are excluded. ↩ ↩2

  22. https://epstein-data.com/EFTA00819050 p. 1 — Epstein to "Governor Kenneth E. Mapp", Friday September 9, 2016, forwarding Erika Kellerhals’s message of the same afternoon to Epstein and to the Director of Coastal Zone Management, copied to Cecile de Jongh. VERIFIED AT THE IMAGE at 300 dpi, which is what settles the recipient line and the juxtaposition of the covering note with the forwarded permitting report. I am willing to jump through the new dpnr hoops and indicated that she would expedite the permit approval are each UNIQUE IN THIS RELEASE on the divergence screen — one rendering, the weaker clean; had a productive meeting this afternoon agrees across 2 copies. ⚠ Amy in the quoted sentence is a forename only and is not identified here. ⚠ The remaining numbered deliverables concern mapping and mulching and are described rather than quoted. ⛔ Contact values print across this sheet and are excluded. ↩ ↩2 ↩3

  23. https://epstein-data.com/EFTA01060129 p. 1 and p. 2 — Epstein to John P. Woods, AIA, Wednesday November 30, 2016, carrying beneath it Woods’s assessment of November 29 and, on p. 2, Darren Indyke’s covering message of the same afternoon. Read from the text layer; I could not look at the image for this sheet. They won't like the politicization of the review process that has the Governor interfering with it agrees across 2 copies; in the title of the document and the last paragraph of it agrees across 2 copies. ⛔ A producer withheld a name in the paragraph quoted and this page supplies nothing for it, describes no mark and says nothing about what any mark covers. ⛔ A sentence of the same message characterises a named departmental employee disparagingly; she is not named here and the characterisation is not reproduced, paraphrased or adopted. ⛔ A street line prints beneath Indyke’s name and is excluded. ⚠ Woods is named because he signs a professional assessment under his own credential; that is a professional act with investigative value, and it is the attribution that gives the sentence its weight. ↩ ↩2

  24. The scheduling-and-access channel between Epstein’s office and the Commissioner’s office, cited by container and read from the text layer throughout; I could not look at the image for any sheet in this note. 25. https://epstein-data.com/EFTA00455255 p. 1 — Daphne Wallace to Epstein, Monday June 19, 2017, 10:53 a.m., carrying the thread in which the 12:30 p.m. time was fixed. Read from the text layer; I could not look at the image for this sheet. The quoted span agrees across 3 copies. ⚠ Wallace is Epstein’s own assistant, not the Department’s; an earlier desk reading attributed this confirmation to the Commissioner’s office and that is wrong. ⚠ The departmental staff member she deals with is Shyra on this sheet. ⚠ An unrelated caller is named elsewhere on the sheet and is not reproduced. ⛔ Contact values print on the sheet and are excluded. ↩

  26. https://epstein-data.com/EFTA00469858 p. 1 — Bebe Avdiu, itinerary for February 21–25, 2018, circulated Tuesday February 20, 2018. Read from the text layer; I could not look at the image for this sheet. ⚠ An itinerary is a table, not prose; it is cited for the entry’s own wording and for nothing else, and it records a scheduled meeting and not an occurrence. ⚠ No name-free span on the entry is long enough to anchor the divergence screen, so NOTHING WAS MEASURED for it; the entry is described and its quoted fragment is short. ⛔ A building and floor line for the Commissioner’s office prints on this sheet and is not reproduced: the page says the office, never the address. ⛔ A household driver is named on the sheet and is deliberately not named here — he is a private employee doing an ordinary job, which is the case the desk leaves open with the owner, and it is flagged rather than left as a silence. The same meeting appears as a reminder in a longer itinerary at https://epstein-data.com/EFTA00285523 p. 5, a container of many sheets read at the image by an earlier pass and cited here page-level for that one entry. ↩

The quoted span agrees across 2 copies. ⚠ islan= is quoted-printable damage and is reproduced, not repaired. ⚠ The word minor on this sheet is a permit class — a minor coastal-zone permit — and the same is true of every occurrence of that word anywhere in this subject’s set. ↩

  32. https://epstein-data.com/EFTA01006576 p. 1 — Epstein to the Commissioner, Thursday December 21, 2017, carrying beneath it her two messages of the same morning. VERIFIED AT THE IMAGE at 400 dpi, and the image corrected the extraction a second time: the text layer opens her 6:16 a.m. message Sony to hear progress has been slow on the islands; at the image it reads Sorry, and the page quotes the image. ⚠ The stray hyphen inside his quoted sentence is on the sheet and is not removed. we gave the salgave co 25 k to the home for girls in st croix agrees across 9 copies; any suggesttions for another 25k agrees across 7 copies; I have been issuing repair and maintenance request for CZM throughout the territory within 2 days agrees across 12 copies; Dealing with the aftermath of a hurricane is always more challenging than the hurricane itself agrees across 9 copies. ⚠ salgave and suggesttions are the extraction’s renderings and are not repaired; this page does not identify the institution his sentence refers to. ⛔ A clause of his in this thread describes a third party’s medical condition; he is not named on the sheet, no detail about him is reproduced, and the clause is not quoted. ⛔ A rendering of this message exists on which the producer’s treatment of an envelope value differs from its treatment here. The value is withheld entirely under the standing rule, no copy is compared, no class is named, no position is given, and the divergent rendering is not cited on this page. ⚠ The span quoted above was put through the divergence screen in its own right and does not differ at any name position across its nine renderings. ↩ ↩2 ↩3

Read from the text layer; I could not look at the image for this sheet. ⚠ A one-word body carries no name-free span that could anchor the divergence screen: NOTHING WAS MEASURED, and the page states only the word and the date. ⚠ The date is the sheet’s own Sent: line; the corpus date field is not used. ↩

  34. https://epstein-data.com/EFTA00933704 p. 1 — the first sheet of the same container: Epstein to Cecile de Jongh, December 27, 2017, no just for public library, carrying her request of 11:09 a.m. and her list of the library’s areas. VERIFIED AT THE IMAGE at 300 dpi. ⭐ This sheet is what settles the OCR trap on the next one: de Jongh’s own prose spells Charles Wesley Turnbull Library correctly, in the same container, a sheet earlier. In the cover letter, do you want the donation to go to a specific program or area of the Library agrees across 2 copies; no just for public library agrees across 4 copies. ⚠ The remainder of her list describes territorial archives and collections and is neither relied on nor reproduced in full. ⛔ Nothing from any envelope block is quoted, described or compared. ↩ ↩2

A second rendering, Doc. 284-5 filed August 14, 2023, is at https://epstein-data.com/EFTA02815448 p. 45. Both read from the text layer; I could not look at the image for either sheet. ⚠⚠ TIER: these are a defendant bank’s pleaded facts in a contested motion, supported by exhibits not read for this page. The cheque itself, its drawer and its delivery were not read here and are not asserted as established. ⚠ One rendering mistypes the figure; the page takes the figure from the rendering that prints it cleanly and from Epstein’s own message, which states 25k. ⛔ Adjacent paragraphs of the same statement concern Epstein’s funding of activities involving children and are neither quoted, described nor relied on here: they are not about this subject, and minimisation governs. ↩
