DOJ OPR Report (S.D. Fla.) — 2006-2008 Epstein Investigation

OPR-2020 is the Office of Professional Responsibility's internal-investigation matter captioned 'Investigation into the U.S. Attorney's Office for the Southern District of Florida's Resolution of Its 2006-2008 Federal Criminal Investigation of Jeffrey Epstein and Its Interactions with Victims during the Investigation.' The investigation arose from a 2010-2011 referral by then-U.S. Attorney Wifredo Ferrer (made after a December 10, 2010 Miami meeting with two Epstein victims and their counsel Paul Cassell and Brad Edwards), from sustained press attention culminating in the Miami Herald's 2018 'Perversion of Justice' series, and from congressional inquiries that followed Acosta's confirmation as Secretary of Labor in 2017.

OPR's jurisdiction over the matter was a function of statutory exclusivity: Section 8E(b)(3) of the Inspector General Act assigns DOJ attorney-misconduct allegations to OPR rather than to the DOJ Office of Inspector General. On January 29, 2019, Inspector General Michael E. Horowitz formally advised fourteen Members of Congress that, in response to their November 30, 2018 letter requesting an OIG investigation of Acosta's NPA decision, OIG lacked jurisdiction and the matter was referred to OPR. OPR opened a full investigation; over the next roughly twenty-two months its attorneys interviewed line and supervisory prosecutors from the U.S. Attorney's Office, FBI agents who had worked the case (including Special Agent Nesbitt Kuyrkendall, who was interviewed under oath by OPR shortly before her retirement), and Acosta himself. OPR also sought state grand-jury recordings and other underlying investigative materials from the Miami FBI Field Office.

OPR completed its report in November 2020. On November 12, 2020, the Department publicly released only an Executive Summary; the full multi-hundred-page report was sent to affected victims, transmitted to the U.S. Attorney's Office for the Southern District of New York under cover letters from OPR (because of the then-pending United States v. Ghislaine Maxwell prosecution), and made available to Congress on request. OPR's principal findings, summarized in the Executive Summary, were that the U.S. Attorney's Office's resolution of the federal investigation through a state plea and federal NPA was 'a flawed exercise of prosecutorial discretion,' that Acosta had 'exercised poor judgment' in entering the NPA, and that the Office's failure to confer with victims violated DOJ policy and the spirit of the Crime Victims' Rights Act, but that no DOJ attorney had committed professional misconduct as that term is defined in OPR's analytical framework. The full report was subsequently filed as Exhibit A to a defense submission in United States v. Maxwell (S.D.N.Y. 20-cr-00330, D.E. 293-1) on May 25, 2021, where it became part of the public record. Acosta resigned as Secretary of Labor on July 19, 2019, four months before OPR's report was issued.

The corpus links 384 EFTA-stamped pages and 2,269 emails to OPR-2020. The bulk of the in-corpus material is correspondence and litigation by-product rather than OPR work papers: the executed November 2020 OPR Report itself appears as a 349-page Exhibit A to defense Document 293-1 in 20-cr-00330 (DOJ-OGR-00004298), and OPR's identical November 12, 2020 cover letters to Acting U.S. Attorney Audrey Strauss in SDNY appear at EFTA00097637 and EFTA00101990. The Department's same-day public statement announcing release of the Executive Summary is preserved as a forwarded SDNY public-affairs email (EFTA00039868), and Inspector General Horowitz's January 29, 2019 letter to House members explaining the jurisdictional referral to OPR is at EFTA00811997.

The sample also surfaces the operational mechanics of OPR's investigation. EFTA01659231 is an April 9-10, 2019 email chain in which an OPR counsel scheduled an 8 a.m. interview at the West Palm Beach U.S. Attorney's Office and asked the FBI Miami field office to re-copy state grand-jury recordings whose original disk was unreadable. EFTA00031320 is a February 10, 2019 letter from Florida attorney Joe Titone offering an Epstein associate's testimony to OPR; EFTA00105452 is OPR counsel's March 6, 2019 internal email referring a parallel Jean-Luc Brunel attorney offer to SDNY rather than handling it within OPR. EFTA00077356, EFTA00155460, and EFTA01245137 capture September 27-28, 2021 correspondence from attorney Stuart N. Kaplan to SDNY AUSA Lara Pomerantz disclosing that his client, retired FBI Special Agent Nesbitt Kuyrkendall, had been interviewed under oath by OPR 'just prior to her retirement' in connection with her recollections of the Epstein investigation.

A second cluster of documents reflects the predicate civil-litigation record on which OPR drew. EFTA01098343 is petitioners' May 2011 motion attaching an earlier OPR letter declining to investigate while the Doe v. United States CVRA case (08-cv-80736) was pending. EFTA00206173, EFTA00208294, and EFTA00212808 are 2011 emails between the Southern District of Florida U.S. Attorney's Office and victim counsel discussing OPR referrals and Rule 6(e) issues that recur in the OPR record. EFTA00191148, EFTA00591958, EFTA02335898, EFTA02754323, and EFTA02755125 are Judge Marra's 2013 omnibus discovery order, the 2013 government privilege log, the 2015 Marra opinion adjudicating those privileges, and related government filings — the discovery dispute that ultimately produced the documentary universe OPR later analyzed. EFTA00225378 is a June 2008 Villafana travel-authorization memorandum (Operation Leap Year) reflecting the line-prosecutor's plan to interview New York-based victims and witnesses, included in the corpus as Exhibit B-132 to a Doe v. United States filing. The corpus also contains background materials such as 28 C.F.R. § 45.10 (the CVRA-compliance regulation, EFTA00211325) and unrelated 2020-2021 SDNY clip files and FOIA requests that referenced the Epstein matter.

The sample does not include OPR's underlying investigative file, witness interview transcripts, the OPR analytical memos, or the exhibits to the report itself. Several documents in the sample link to OPR-2020 through 'text_scan_explicit' references at medium confidence — they mention OPR, but were generated in adjacent civil and criminal proceedings (08-cv-80736, 20-cr-00330, ST-2020-CV-00155) rather than within the OPR matter — and should be read as ambient record rather than OPR work product.
