Giuffre v. Maxwell

Virginia L. Giuffre filed Giuffre v. Maxwell in the U.S. District Court for the Southern District of New York on September 21, 2015, asserting a single state-law defamation claim against Ghislaine Maxwell. The complaint arose out of a January 2015 statement issued on Maxwell's behalf — through her London public-relations representative Ross Gow and solicitor Philip Barden — that called Giuffre's allegations of sexual abuse by Epstein and Maxwell 'untrue' and 'obvious lies.' That statement, drafted in early January 2015 and circulated to the press, is reproduced verbatim in the corpus at EFTA02794921. The case was originally assigned to Senior District Judge Robert W. Sweet and later, after Judge Sweet's death, reassigned to District Judge Loretta A. Preska, who supervised the multi-year unsealing process.

Discovery in 2016 was intensive and bitterly contested. Plaintiff was represented by David Boies, Sigrid McCawley, and Meredith Schultz of Boies Schiller & Flexner, with Bradley Edwards (Farmer Jaffe Weissing) and Paul G. Cassell (University of Utah College of Law) appearing pro hac vice; Maxwell was represented by Laura Menninger and Jeffrey Pagliuca of Haddon, Morgan and Foreman in Denver. Maxwell sat for two days of videotaped deposition at the Boies Schiller & Flexner offices in New York, on April 22, 2016 (EFTA02790377) and July 22, 2016 (DOJ-OGR-00003600 / EFTA02784957). Other deponents included former Palm Beach Police Department detective Joseph Recarey (EFTA02793012), Epstein's chief pilot 'Tony,' and numerous third-party fact witnesses. Epstein himself was deposed in the U.S. Virgin Islands in mid-2016 and asserted the Fifth Amendment. The parties also litigated a string of subpoena-enforcement motions, including a motion for civil contempt against a witness who declined to appear (EFTA02799489), a Rule 35 dispute over Giuffre's psychological records, and a months-long fight over an alleged 1999–2010 gap in plaintiff's email production (EFTA02787339).

Judge Sweet entered a sweeping protective order on March 17, 2016 that designated large categories of discovery 'Confidential,' and the docket rapidly accumulated hundreds of sealed exhibits and redacted filings. Maxwell moved for summary judgment in early 2017; argument was heard on February 16, 2017, after which third-party intervenor Michael Cernovich (represented by Randazza Legal Group) opposed plaintiff's effort to seal the summary-judgment transcript (EFTA02803665). The case settled before any ruling, on May 25, 2017. Cernovich and other media intervenors then pursued unsealing in the Second Circuit. In a series of orders culminating in 2019 (16-3945, 16-1722, 16-1625, and 16-2868, listed in an SDNY government inventory at EFTA00078630), the Second Circuit and Judge Preska on remand directed the gradual unsealing of thousands of pages of exhibits, depositions, and motion briefing. Major tranches were unsealed on January 3, 2019 and again in batches between January 3 and January 11, 2024. The unsealed materials in this case form the evidentiary backbone of the public Epstein record and were used as the predicate for the perjury counts in the 2020 federal criminal indictment against Maxwell (United States v. Maxwell, 20-cr-00330).

The DOJ EFTA production contains 2,811 pages and 442 emails linked to 15-cv-07433, the largest case-linked corpus after the federal criminal docket. Filings span the 2015 complaint through post-settlement unsealing orders entered as late as January 2024, and the captions in the sample reflect the case's procedural arc: original judge designation '15-cv-07433-RWS' (Sweet) on the 2016–2017 filings and '15-cv-07433-LAP' (Preska) on the post-2018 unsealing-era filings.

The corpus also captures the case's downstream evidentiary footprint. The Maxwell deposition transcripts and third-party depositions were re-filed years later as exhibits in United States v. Maxwell (20-cr-00330), in Government of the U.S. Virgin Islands v. JPMorgan Chase (22-cv-10904), and in unsealing-related motions before Judge Preska, which is why many of the same transcripts appear under multiple docket numbers. An AUSA-prepared 2018 inventory (EFTA00078630) lists the case alongside its four sealing appeals (16-3945, 16-1722, 16-1625, 16-2868 in the Second Circuit), confirming that prosecutors tracked the unsealing posture in real time. The corpus does not contain the original 2015 complaint, the May 2017 settlement agreement, or the 2024 final unsealing index; it does not unseal documents that remain withheld at the producing party's designation.
