⚠ what this page is about, and what it is not

A friendship that began in Brooklyn in the 1960s and is documented in the release in unusual density until his death in 2014. It twice touches Epstein’s legal record: once in 1981, as the named counterparty of a loan, and once in 2007-08, as the author of a character letter the defence put in front of a State Attorney. Everything else here is an ordinary friendship. No allegation against him exists anywhere in the release, and none is made here.

The letter the defence used

Epstein’s defence collected character letters and quoted them to the Palm Beach State Attorney. This man’s is quoted twice, at greater length than any other in the same passage.

⚠⚠ THE MEMORANDUM DOES NOT PRINT HIS FORENAME. It is covered, leaving “Eisenstein, O.D., also of Dallas, Texas”; Terry B. Kafka is named in full on the same page. The identification here rests on what the sentence does print, an optometrist of Dallas and a long-time friend from Epstein’s youth, read against the rest of the correspondence. This page states it as an identification, not as a name the document gives.3

The memorandum introduces him that way, records that they both drove New York City taxicabs during college summer breaks, and then gives a story from their schooldays:

In high school, although we both were excellent academically, we were jokers in physical education. … One month before graduation, our phys-ed teacher called us into his office and informed us that even though we were “two smart boys”, we would not graduate because we would get a failing grade in phys-ed. … After 10 minutes of negotiating with our teacher, Jeff convinced him that we would do anything he asked us to do until graduation.

and then the passage the memorandum introduces as his summary of the friendship:

Over the years, his genius has taken him to achieve levels of success unattainable by anyone I’ve ever met. … As we’ve gotten older, our lives have become more complicated, but we have never missed calling each other on our birthdays. It’s a small, silly thing, but how many childhood friends do you know, who have never forgotten your birthday? The most important thing to me is that as vast a difference [as] our worlds are, our long-term, deep seated friendship is the strongest lifelong friendship one could ever have.

The underlining of “never” is in the document.3

This is a letter solicited for a sentencing purpose and the page treats it as one. It is what a friend wrote when asked to write, to a prosecutor, on behalf of a man about to be sentenced. That does not make it insincere and this page does not suggest it was.

What the package of letters was for is written on its covering note, four pages earlier in the same production, handwritten on the firm’s letterhead:

Enclosing some fun reading on your Defendant

The character letters are the “fun reading.” They went to the State Attorney while the federal negotiation with Alexander Acosta ran in parallel, which also dates the memorandum, otherwise undated on its face, to the 2007-08 negotiation. The note is read in full at Jack Goldberger.3

What nine hundred documents are

A count this size has been an artefact three times on this wiki, so it was measured before anything was written.2

  • 1,265 pages across 1,172 documents, 1.08 pages per document. Hundreds of separate short items, not a photographed book and not a running head.
  • 629 of the documents carrying his name have a message he sent in them. That is the number that matters: the population is not people writing about him.
  • The only recurring structure is about thirteen documents carrying one Bear Stearns passage (1.3% of the pool) and, as it happens, the only documents in it that touch Epstein’s institutional history.
  • Deduplicated, his own messages are between 258 and 293, running 11 December 2008 to 14 February 2014. ⚠ The page gives a range, not a figure, because the two keys disagree.

The surname over-states him by about a sixth, and every spelling together by about a fifth; the confusable is his widow. Linda Eisenstein has 150 mentions, 134 of them without him, and 53 sender rows of her own across 48 documents, 29 after the same deduplication, running into September 2015. ⚠ A previous desk note assumed the confusable would be a son, because that was the shape on a neighbouring subject. It is not. An inherited assumption is not a measurement.2

Who he was

From his obituary, read at the image: born in Brooklyn to Lenny and Rivka Eisenstein, “a true Sea Gater”; he left Brooklyn at nineteen to join the Topeka band that became Kansas, and left the band on a promise to his parents; then the University of Kansas, then the Southern College of Optometry in Memphis, where he took his doctorate and met his wife Linda; then Dallas, and an optometry practice in Richardson. ⚠ The sources disagree on the practice name: the family’s own obituary reads Contact/Eyewear and a 2004 card statement reads CONTACT EYEWEAR, while a 2005 courier label reads CONTRACT EYE WEAR. Two of the three say Contact, and an earlier version of this page printed the courier’s spelling without saying the sources differed.1

⚠⚠ THE OBITUARY NAMES JEFFREY EPSTEIN. Among the survivors it lists “his lifelong friends and soul mates: Dr. Michael Buchholtz (NY), Jeffrey Epstein (NY), Terry Kafka (Dallas), Jerry Ruoti (NY) and Joseph Zucca (NY).” The family published that in the Dallas Morning News and on Legacy.com between 28 February and 3 March 2014, five and a half years after Epstein’s conviction and registration as a sex offender. It is the plainest statement of the friendship in the release, and it is the family’s, not the defence’s. The same paragraph names his brother Benjamin, his caretaker Arnie Mercado, and his staff at the practice.1

A band is named in his own hand, but it is not Kansas. In August 2012 he forwarded Epstein an executive summary for two men, writing: “This is Jeff Glixman from my old rock group Rocky Fox, along with Phil Ehart.” The word Kansas is not on the sheet. Glixman produced Kansas and Ehart drummed for it, but that is outside the document. What the document corroborates is a Topeka-era band called Rocky Fox, and an earlier version of this page claimed it corroborated Kansas.6

The friendship in the record

Four courier shipments sent in Epstein’s name reach him between 2002 and 2005, two of them to addresses the sheets print as Richardson, Texas and two to destinations the sheets bar,: two of the four sent under Ghislaine Maxwell’s name jointly with Epstein’s, the last addressed to his optometry practice. Two are signed for in his own name, as the courier rendered it. ⚠ What was in them is not recorded on any of the four, all of which read “NO REFERENCE INFORMATION”.7

He used Epstein’s houses, and Epstein’s staff arranged it. In September 2009 a message reached Epstein: “Please call! I’m enjoying the ranch immensely! Would love to talk” In September 2013 he asked directly, “Johnny, Can we do the ranch from Oct. 6-12 ?”, was told yes, and answered: “We’ll set up air and I’ll send the itinerary to Leslie. It’s been 5 years since visiting Zorro. The stay happened in mid-October and Epstein’s office tracked it across at least eighteen copies of the office schedule, down to the departure day. He wrote afterwards: “Johnny, Thanks for another great time at the ranch.”8

In April 2013 he stayed in New York on the same footing: an apartment found for him by Epstein’s assistant, a flight number in the office schedule, a member of Epstein’s staff flown in to drive him, and a party he organised himself, which Epstein’s office put in the schedule as “8:00pm Party for Warren Eisenstein at Philip’s Soho Loft”.9

In September 2009, as civil-deposition material was reaching the press, he wrote: “Don’t let those bastards wear you down…” Epstein’s own line, written the previous evening and sitting below his in the quoted chain, was “crazy, it comes with the territory”.10

1981, and the reason Epstein gave for leaving Bear Stearns

Epstein resigned from Bear Stearns on 12 March 1981, eighteen days before he testified. In S.E.C. testimony of 1 April 1981, Epstein said he had found “offensive” the way Bear Stearns handled a disciplinary action over a possible Reg D violation: he had lent money to a friend. In a 1989 deposition he put the loan at $20,000 and named this man. Bear Stearns fined him $2,500.

⚠⚠ THIS IS A CREDIBLE ALLEGATION AND NOT A DOCUMENTED FACT, AND THE DISTINCTION IS THE WHOLE POINT. The testimony itself is not in this corpus, and no loan instrument, no Bear Stearns personnel record and no transcript was found. What the release holds is two secondary texts: a Vanity Fair article printed out and kept in Epstein’s files, and pages of Filthy Rich that quote the 1 April 1981 testimony verbatim as question and answer and name the S.E.C. investigators. ⚠ An earlier version of this page called the account “a magazine’s”, singular, and said Epstein “twice gave this under oath as his reason for leaving.” Neither is what the sources say: the article offers the testimony and the deposition together as the answer to Bear Stearns’s public line that Epstein left of his own volition, and the deposition is cited only for the loan’s size and counterparty.4

The same article calls this man Epstein’s “closest friend.”4

The last eighteen months

In November 2012 he wrote jointly to Epstein and Terry Kafka to stop them overriding his oncologist, disclosing his diagnosis and asking them to leave the decisions to his doctor. The same day he forwarded both men the referral chain he had set running himself, through one of his own patients.11

His subject lines mark the rest. In July 2013: “I’m not dead yet”. In January 2014: “The End’s a comin”. The last message he is recorded sending Epstein is dated 14 February 2014.11

He died on 27 February 2014.A photograph of a brass memorial plaque bearing his name, his Hebrew name and the date is in Epstein’s own produced files, and so is the order confirmation for his newspaper obituary.1

What this page does not carry

No allegation against him was found anywhere in the release.12

One money instrument touches his practice, and this page had it wrong until it was checked. ⚠⚠ AN EARLIER VERSION SAID “NO WIRE, NO BANK LINE, NO CHEQUE AND NO INVOICE FOR SERVICES NAMES HIM.” A $6,500.00 charge to CONTACT EYEWEAR, DALLAS TX is posted 9 February 2004 on Jeffrey Epstein’s Chase Gold MasterCard statement, the largest single item on it and 52% of that month’s purchases. ⚠ Nothing in the release says what it was for, nothing shows this man personally received anything, and a charge at an optometrist is the most ordinary thing on this page. It is recorded because the sentence it refutes was built into a section.5

Why it was missed is the finding. The absence was measured in the vocabulary of the man’s name, across a document population defined by his name. The instrument is keyed to his business, and the page had chosen the courier’s misspelling of that business over the two sources that spell it correctly. The wrong trading name is part of what hid the charge.5

Documents in this population carry an unredacted driver’s-licence number belonging to a private third party, a date of birth appearing in more than one place, and an unredacted conference-call access code. None is reproduced, and their existence is reported to the editor.13

A promising-looking record was opened and discarded. A March 2013 exchange in which his identifiers and a guest’s were collected looked like a flight manifest and is not one: opened, it is credentials for a motor-racing event in Dallas. The page reports the discard because the unopened version of that document would have been a good false finding.13

"Warren Eisenstein" returns 987 documents and the surname 1,172, across 1,265 pages, 1.08 pages per document. ⚠⚠ A count this size is usually an artefact and this one was tested: on this wiki a photographed book’s running head once inflated a subject to hundreds of pages, and a firm name inflated another. Neither shape is present. 629 of the documents carrying his name have a message he sent in them; 204 are addressed to him; 96 are office schedule or alert lines. The only recurring structure is about thirteen documents carrying one Bear Stearns passage, 1.3% of the 997-document full-name pool. The thank-you of 21 October 2013: EFTA02576075 p.1, read at the image. ⚠ He addresses Epstein by nicknames throughout and signs off with a fixed phrase; the page prints them as the documents have them and decodes none of them.Several of these messages are addressed to “Jeffery Edwards”, an address Epstein used; the identification rests on the same e-mail address appearing under both names in the release.

  9. April 2013.An earlier version of this footnote carried no document identifiers at all. Lesley Groff to Epstein, 27 February 2013, EFTA02520839 p.1: “Warren Eisenstein is asking if he may stay in an apt when he comes April 22-28. We do have an apt available… Please advise” His own invitation of 5 March, EFTA02404766 p.1: “we’ll be in NY from April 23 thru the 28. Terry set up a get-together at his son Philip’s VERY COOL Soho Loft… It will be on Fri 4/26.” The office schedule for Tuesday 23 April, EFTA00391771 p.1, records a staff member flown in “to drive Warren around” and his own arrival at LGA. EFTA01896887 pp.3-4 carries the driver across 23-27 April, the departure flight, and “8:00pm Party for Warren Eisenstein at Philip’s Soho Loft”. ⚠ The party is the one act of his own in the episode and an earlier version recorded only what was arranged for him. ⚠ The schedule records only that he was to “stay at 301”, one of Epstein’s own New York buildings.

His own message is at the head of the sheet and Epstein’s line, written the previous evening, sits below it in the quoted chain. ⚠ An earlier version said Epstein’s was above his, which is the opposite of what the sheet shows.His message is two sentences and the body quotes the first; the second is coarse and is not reproduced.The page reports what each wrote and does not characterise what either meant.

  11. November 2012 to February 2014. ⚠⚠ THE JOINT MESSAGE WAS CITED TO THE WRONG DOCUMENT IN AN EARLIER VERSION. It is EFTA01975389 p.1, to Jeffrey Epstein and Terry Kafka, 14 November 2012: “I am begging you not to second guess Michael’s decisions… It’s my life (what’s left of it)… neither of you are oncologists… Michael is.” EFTA01980626 is only the referral chain, a Kafka reply wrapping his forward, and the diagnosis is redacted on it — the earlier version attached a statement about the diagnosis to the document that does not carry it. The subject lines: “I’m not dead yet”, 24 July 2013, EFTA02520357; “The End’s a comin”, 21 January 2014, EFTA02579727, body “My days are numbered. Dead man walkin’”. The last message of 14 February 2014 is EFTA02581494, which an earlier version did not cite at all. ⚠⚠ His diagnosis is named in the November 2012 message and is not reproduced here. The page reports that he disclosed one and asked that his doctor’s decisions stand. ⚠ The 2014 traffic about his death is largely Terry Kafka’s, and belongs on that page; an earlier desk note called this subject “the hub of the 2014 spike”, which is wrong: his own traffic peaks in 2013 and stops in February 2014 because that is when he died. 2

  12. Absences, each scoped, each with a live positive control.An earlier version said every countable result set had been opened. It had not: the enumeration this page inherited put massage in three documents when it is in ten, all of them about Jeffrey Epstein or a different Eisenstein. The conclusion survives a re-sweep over all 1,183 documents of the union; the claim to have opened everything does not, and is withdrawn. No allegation against him was found anywhere in the release. No deposition of him, no interview report, no filing naming him as a party was found. ⚠ Each of these says what was not found, not what does not exist.Two list documents were opened and weighed: EFTA00315076 places him on a “Visitor List” among academics and others, and this page does not treat appearing on someone else’s list as an act of his; but EFTA02438252, 7 October 2009, subject “The List”, is a Coney Island reunion list he compiled and sent Epstein himself, which by that same standard is an act and is recorded as one. He is named in one deposition, three times across two transcript pages, where Mark Epstein says “I think he went to the same schools, yeah. He was my brother’s age and names the school as P.S. 188, Brooklyn (⚠ which dates the friendship against Jeffrey Epstein and not against the witness), in Jane Doe v. Epstein, No. 08-80893-CIV-MARRA/JOHNSON (S.D. Fla.), 21 September 2009, when plaintiffs’ counsel asked Mark Epstein to name a close friend of Epstein’s from Coney Island and the answer was this name. That is a third party naming him, not an act of his, and the page records it as such.

Withheld, and one discard.EFTA02010908 prints an unredacted driver’s-licence number belonging to a private third party; a date of birth appears in more than one document; and EFTA00381524 carries an unredacted conference-call access code. None is reproduced and all are reported to the editor.The discard: a March 2013 exchange collecting his date of birth and a guest’s licence number looked like a flight manifest. It was opened. It is credentialling for a motor-racing event in Dallas, brokered through a driver, and it is recorded here because a page built on the unopened version would have carried a plausible and wholly false finding. 2
