The Angara Trust and the Montpelier Trust are two trusts that held Resource Management Accounts at UBS Financial Services Inc., Private Wealth Management. “Resource Management Account” is UBS’s own name for the account type, abbreviated “RMA” on the account-opening papers: the account-information sheet in the Montpelier package, headed “RMA Domestic TRUST”, records for that account a margin election and a primary and a secondary sweep fund for uninvested cash.1314 The Angara Trust’s January 2018 statement is addressed care of the Boston law firm Nutter McClennen & Fish at 155 Seaport Boulevard, and the Montpelier Trust’s client-information form gives the same street address, with “LLP”, in its contact block.32 UBS’s client-information form for each names Ghislaine Maxwell as the grantor.12 The two trusts are the first two entities named in the description of one block of a Government discovery letter of October 2, 2020 in United States v. Ghislaine Maxwell, which describes what was produced to the defence: “UBS records for Angara Trust, Montepelier Trust, Terramar Project, Inc., Max Foundation, Ghislaine Maxwell, Ghislaine Maxwell IRA, & Ellmax, LLC”.12 That grouping is the Government’s.
Nothing on this page is a finding of wrongdoing, and no document cited here alleges any. Account numbers, identity numbers, residential addresses, telephone numbers and e-mail addresses on the pages cited here are not reproduced.
What the client-information forms record
UBS’s “Client Information” sheet for the Angara Trust enters the trust type as “Irrevocable Trust”, the jurisdiction as “US Trust” and the date established as 09/15/2016. Under “Name of All Trustees” it carries three rows and all three are blacked out; the line under “Name of All Grantors” reads “Ghislaine Maxwell”. In the contact block the residential-address line is covered by a bar and the line beneath it reads “Boston, MA 02210-2698”; what the barred line holds is not established by the sheet.1 The extraction of that sheet closes the gap where the three trustee rows are blacked out, so a reader working from the machine text alone sees no trustee entry at all rather than three withheld ones.1 The trustees are not identified on this page.
The account-opening package for the Angara Trust opens with a “Signature Page Summary” listing six accounts, each described as “RMA Domestic - Trust” and each carrying the signature requirement “Client Relationship Agreement”. The six account numbers are blacked out.13
The corresponding sheet for the Montpelier Trust enters the same trust type and jurisdiction, a date established of 07/31/2018, three trustees, Christine Yvonne Malina-Maxwell, Jeffrey W. Roberts and Scott Borgerson, and one grantor, Ghislaine Maxwell. Its contact block gives 155 Seaport Boulevard, ATTN: Nutter McClennen & Fish LLP, Boston, MA 02210-2698. The net-worth block enters annual income in the range $200,000 to $499,999 and both liquid assets and net worth excluding primary residence in the range “$10,000,000 AND ABOVE”, and records that more than 80 per cent of total investable assets are held at UBS.2 The account sheet in the same package gives the account title as “Montpelier Trust”, the account risk profile as “Aggressive/Speculative”, the risk tolerance as “High Risk”, the investment objective as “Achieve capital appreciation (emphasis on growth of capital, not on income)” and the time horizon as “Longer than 10 years (through several market cycles)”, and records that “all beneficiaries for this trust are individuals (natural persons) or not-for-profit organizations”.14 The next sheet enters the source of funds for the account under “Other Income Source” as “transfer”, and against the two questions on anticipated activity enters “No” both to depositing funds from third parties and to withdrawing to pay or transfer to third parties.15
The Angara Trust account, 2018 and 2019
The release holds a run of 122 sheets of monthly UBS Resource Management Account statements for the Angara Trust covering January to December 2018, and a second run covering January 2019 and the period February to April 2019.39 The sheets read for this page carry the account name “ANGARA TRUST”, the friendly account name “Tr Cash/Funding” and the two advisers’ names in their headers; the first sheet of the January 2018 statement also carries the care-of addressee block for the Boston law firm.31617891819
The January 2018 statement opens the year at $12,388,213.23 on December 29 and closes at $11,744,821.70 on January 31, after withdrawals and fees including investments transferred out of $662,043.44, dividend and interest income of $18,070.31 and a change in market value of $581.60.316 In June 2018 the account opened at $11,750,948.74 and closed at $9,329,197.00, the month’s withdrawals and fees being $2,545,327.56 against deposits of $106,883.54.17
The December 2018 statement totals the year. Against an opening account value of $12,388,213.23 it records year-to-date deposits including investments transferred in of $148,906.22, withdrawals and fees including investments transferred out of $4,361,870.91, dividend and interest income of $194,884.69 and a change in market value of $531.28, for a closing account value of $8,370,664.51.8

The account was emptied in January 2019. That month’s statement opens at $8,370,664.51 and closes at $0.00, recording deposits of $922,440.00, withdrawals and fees of $9,294,385.80, dividend and interest income of $1,727.83 and a change in market value of −$446.54; those five lines are the whole of the printed column and they close to the printed closing account value of $0.00.9 The activity sheet sets out seven entries under “Other funds debited”, the largest of them a transfer of $8,353,454.04 on January 4 and the last a transfer of $922,440.00 on January 31; the description column beside each of the seven is blacked out, so the destination of each transfer is not printed on that sheet. The same sheet records that on January 2 and January 4 the account sold its holdings in the UBS Select Prime Preferred Fund and the UBS Select Government Preferred Fund for proceeds totalling $8,370,192.79.18
A combined statement for February to April 2019 opens April at $0.00 and closes at $0.00, and gives the year to date as an opening account value of $8,370,664.51, deposits of $1,024,734.00, withdrawals and fees of $9,396,679.80 and a closing account value of $0.00.19
The Montpelier Trust account, 2018 to 2020
The release holds a run of 160 sheets of UBS statements for the Montpelier Trust, beginning part way through the December 2018 statement and continuing month by month to June 2020.410 The account name is “MONTPELIER TRUST” and the friendly account name “Mont Hedge Fund”; the advisers are the same two named on the Angara statements.4
The first sheet of that run is marked “Page 17 of 20” of the December 2018 statement. It records the value of the account as $0.00 on November 30 and $1,000,000.00 on December 31, the change being a deposit including investments transferred in of $1,000,000.00. No income or market-value line appears in the December table at all.4 The February 2019 statement opens the month at $2,750,000.00 against a year-to-date opening of $1,000,000.00, and closes at $2,761,240.00. Its deposits line reads $0.00 for February against $1,750,000.00 year to date, so on the face of that column the whole of the year’s deposits to that point fell in January 2019.20 The last statement in the run, for June 2020, opens at $4,703,195.71, records a change in market value of $138,622.38 and closes at $4,841,818.09, with unrealised gains and losses of $462,923.02.10
Who dealt with the accounts
A correspondence about the Angara Trust’s tax reporting runs through the summer of 2018 between the trust’s outside accountants, its UBS advisers and Scott Borgerson; Ghislaine Maxwell and Laura K. Barooshian are on the copy line of the June 13 message.6 On June 13, 2018 Lindsay J. Annello, a manager at DiCicco, Gulman & Company LLP in Woburn, Massachusetts, wrote to Borgerson: “We are working through the 2nd Quarter estimated taxes calculation which is coming due on Friday, June 15th. Are you able to run a report for the Angara Trust’s UBS accounts through 5/31/18 to determine what the year-to-date income and gains/losses have been so far? I’ve already reached out to Jeff at Nutter to obtain this information, but he informed me that you have the online account access.”6 She added that failing that she could finalise the calculation “assuming all 2018 income is similar to the 2017 income with the exception of the $300k gain that was reported through the Angara Trust”.7
Borgerson forwarded the request to UBS the same day, copying Ghislaine Maxwell, under the subject line “Re: SB/GM - 2nd Quarter Estimated Taxes”, and wrote: “Please see below from Angara’s accountant. I couldn’t see where to run a YTD capital gain/loss for Angara when logging into ubs.com.” To Annello he wrote: “Angara is now mostly in cash/treasuries, and so the $300k gain from last year will not be the same this year (that closed out some old positions), so my guess is the number will be lower.”6 A reply of the same day, subscribed with the UBS Private Wealth Management signature block of Lyle Casriel, Senior Vice President for Investments and a Private Wealth Advisor and Portfolio Manager, ran the report and cautioned that “UBS disclaims this report is not intended to replace or mirror the final 1099s, however, we do share this to help ascertain estimate information.”6
The thread resumes in September. On September 3, 2018 Annello wrote to Casriel: “We are in the process of working through the 2018 3rd Quarter estimates for Scott. Could you please provide me with a copy of the 2018 YTD Tax Summary for the Angara Trust at your convenience?” Casriel answered the same day, “Of course. We will send this tomorrow”, and on September 4 sent the summary with the attachment “Angara Tax Summary Interim ao 8.31.18.pdf” and the note that it “is an informational report only, and should not be relied upon for tax purposes”.21 The request names its subject by a forename alone, and the forename is not resolved here because the documents do not resolve it: two men named Scott appear on the sheets cited on this page. One is Scott Borgerson. The other is Scott Stackman, one of the two financial advisers named on the statements of both trusts and addressed by name at the head of the March 2019 letter of authorisation. No document cited here says which of them the estimates were for.345 The initials in the thread’s subject line are not expanded on any sheet cited here. The release holds a second copy of the same thread family, of five sheets, at another identifier.22
On the evening of Wednesday, September 12, 2018 Borgerson wrote to the two UBS advisers, copying Jeffery Roberts at Nutter McClennen & Fish and an address displayed as GMAX, under the subject “trust renaming”: “There was a renaming of the Angara Trust, which required the creation of a new EIN for tax purposes. Is there a good time when I could give you a call over the next couple of days or early next week to give you the EIN over the phone? Angara’s assets will need to be moved over to this new entity, otherwise everything else stays the same. This isn’t time urgent and so no rush, just a paperwork drill.” The sheet cited for that quotation carries only an unzoned header, and the date used here is the local one quoted back on a second copy in the release; the two differ by four hours, which is Eastern daylight time against UTC.2324 Casriel replied thirty-two minutes later, measured on the same unzoned headers: “Hi Scott, Of course, Brittany here can help block a time that works for all.”24 No document cited here states what the trust was renamed to.
On March 5, 2019 Annello wrote to Casriel, copying Borgerson, under the subject “Angara Trust / Montpelier Trust 1099s”: “We are in the process of gathering information for the tax filings for the Angara Trust and the Montpelier Trust. To date, we’ve received 1099s for the following accounts held in the Angara Trust”. The list of accounts that follows is blacked out, as are the two account endings in the next sentence. She closed: “Also, were any 1099s issued for the Montpelier Trust in 2018?” A reply carrying the thread’s own inline stamp of 15:09 that same afternoon, its sender’s address blacked out and subscribed with the UBS Private Wealth Management signature block of Lyle Casriel, read: “Adding my team, we will come back to you to help you reconcile.” Borgerson answered the next day, March 6: “Thanks Lyle and team. Scott”25
The March 2019 authorisation and the July 2019 distribution
On March 12, 2019 Elyanna Rivas, a client service associate at UBS Private Wealth Management, wrote to Maxwell under the subject “MAXWELL: Transfer to Montpelier Trust”: “Per our conversation, please sign the attached letter of authorization to initiate the $500,000 transfer from your main UBS account to the Montpelier Trust main UBS account. Please sign where indicated and return to us via email (PDF) to process the transfer.” A reply the next day from an address displayed as “G Max” said: “attached is the singed document”.26
The letter itself is dated March 12, 2019, is addressed to “Scott Stackman / Lyle Casriel, UBS Financial Services Inc., Private Wealth Management, 1285 Avenue of the Americas, 38th Floor, New York, NY 10019” under the heading “RE: Internal Transfer to Montpelier Trust”, and authorises “a $500,000 transfer from my UBS account” to “the Montpelier Trust, UBS account”, each account named in the sentence by a reference that is not reproduced here. It is on Ghislaine Maxwell’s personal letterhead, whose street line is redacted.5 The release carries the letter three times within the same run and the copies differ in execution: the first of the three stands unsigned, with an unmarked rule above the printed name; the second and third each carry an ink signature crossing that rule, and on the second the printed name is highlighted.527
On July 1, 2019 a message subscribed by Rivas, under the subject “MONTPELIER TR: Quarterly Distribution”, told Borgerson: “As discussed, the quarterly distribution in the amount of $52,580.63 has been wired to the Scott Borgerson account at USAA Federal Savings Bank.” Borgerson answered: “Received. Thank you.”28
Four days earlier, on June 27, 2019, Juliana Shkreli, an associate director and senior wealth strategy associate at the same UBS desk, had told him that “the $240,000.00 wire transfer to the TIDEWOOD, LLC account at Citizens Bank is complete”, adding as a reminder that wires to the Montpelier Trust account “should be sent in USD”. Borgerson replied: “I see the $240k wire on this end into Citizens already. Thank you. Standing by on the other wiring instructions.”29
Production to the defence in United States v. Maxwell
The Government’s discovery letter of October 2, 2020 is written on the letterhead of the United States Attorney for the Southern District of New York at One Saint Andrew’s Plaza and is captioned in United States v. Ghislaine Maxwell, 20 Cr. 330 (AJN). Its two addressees are redacted, one at a New York postcode and one at a Denver postcode. It opens: “In recognition of the Government’s ongoing discovery obligations, today we are producing copies of the materials listed in the below index, which materials are stamped with control numbers SDNY_GM_000174967 through SDNY_GM_ 00328863”, the first of those two numbers being printed with an extra digit against the same number as it appears in the letter’s own table. The letter records that it and the enclosed materials are governed by the July 31, 2020 protective order in the case and that the letter is itself designated confidential.11
The index runs across both sheets and gives start and end control numbers for each block; the JPMorgan Chase row gives two of each. The blocks are Deutsche Bank records; JPMorgan Chase records; “GM Documents”; Citibank records for Ghislaine Maxwell; the UBS block at SDNY_GM_00324037 to SDNY_GM_00325754; “LSJ Scene2Go”; and American Express records for Jeffrey Epstein and Ghislaine Maxwell. The Deutsche Bank, JPMorgan Chase and American Express blocks are marked “Confidential” in the last column and the UBS block is not.1112
The statement runs can be placed inside that block by their own printed numbers. The first sheet of the 2018 Angara run carries the stamp SDNY_GM_00324173 beneath a second stamp reading EFTA_00196948; three further sheets of that run read here carry SDNY_GM_00324175, SDNY_GM_00324227 and SDNY_GM_00324287, and three sheets of the 2019 Angara run carry SDNY_GM_00324297, SDNY_GM_00324300 and SDNY_GM_00324307.31617891819 Each of those seven numbers falls between the start and end numbers the letter prints for the UBS block. That placement rests on the range: it is the arithmetic of a printed number against a printed range, and no document cited here states of any individual sheet that it was among the material produced.
The other UBS documents cited on this page carry stamps outside the span of control numbers the letter gives for its own production. The Montpelier statement run’s sheets read here carry SDNY_GM_00010004, SDNY_GM_00010020 and SDNY_GM_00010158; the sheets read from the Montpelier account-opening package carry SDNY_GM_00009962, SDNY_GM_00009968 and SDNY_GM_00009969; and the Angara account-opening package carries SDNY_GM_02742237 and SDNY_GM_02742239.4201021415131 All of those fall outside SDNY_GM_00174967 to SDNY_GM_00328863, so they were stamped in some production other than the one this letter describes; which one is not established by any document cited here.
The letter closes “Very truly yours, AUDREY STRAUSS, Acting United States Attorney”, above a solid black bar and the printed line “Assistant United States Attorneys”, with a second bar beneath it. This page does not identify the redacted signers.12 The bottom right corner of each of the letter’s two sheets prints “06.20.2018”, a date more than two years before the letter’s own date of October 2, 2020; it is reported here as printed and is not reconciled with the letter’s date.1112 The release holds the same two-sheet letter in several copies; the copy read for this page is the one cited, and the copies are not uniformly paginated.30
Numbering
Four numbering systems appear across the documents cited here, and any figure taken from them should be read against the one it comes from. The SDNY_GM_ stamps are the control numbers of the Government’s productions, and are the numbers the discovery letter’s index uses.11 The UBSTERRAMAR stamps appear on the adviser correspondence, which carries no SDNY_GM_ stamp at all on the sheets read here.2123 The EFTA_ stamp is the release’s own, and sits on the statement sheets beneath the SDNY_GM_ one.3 The EFTA identifier without an underscore is the document identifier used in the citations on this page and in the release’s viewer, and it advances sheet by sheet within a run.3 The initials in the SDNY_GM_ prefix and in the “SB/GM” of the adviser subject line are not expanded on any sheet cited here and are not expanded on this page.
What the documents cited here do not establish
No document cited here says where the money that left the Angara Trust account went. The seven “Other funds debited” entries for January 2019 print their amounts and black out their descriptions, and no statement sheet cited here names a destination for any of them.18 Nothing cited here connects the $9,294,385.80 that left the Angara account in January 2019 to the $1,750,000.00 deposited into the Montpelier account in the same month, and the sequence is set out above as a sequence and not as a transfer.920
No document cited here says what the Angara Trust was renamed to in September 2018, whether the new entity was the Montpelier Trust, or whether the move of assets the September 12 message describes ever took place.2324 Nothing cited here identifies the Angara Trust’s trustees, whose three rows are blacked out on the only client-information sheet for that trust cited here.1 Nothing cited here records a response from any person named on this page to anything reported here.
A search of the corpus for the phrase “Angara Trust” returns 175 pages and for “Angara” alone 217; for “Montpelier Trust” 232 pages and for the discovery letter’s spelling “Montepelier” 7, all seven of which are page 2 of a copy of that letter. Those counts are of the machine-read text and are a floor rather than a census, because a redacted or damaged line does not answer a search.
