What His Public Statements Have Been
In an October 1, 2025 Pod Force One podcast with Miranda Devine, Lutnick volunteered the following claims about Epstein:
"My wife and I decided that I will never be in the room with that disgusting person ever again."
"I was never in the room with him socially, for business, or even philanthropy."
"One and absolutely done. That's my story."
"[Epstein was] the greatest blackmailer ever."
"What happened in that massage room, I assume, was on video."
By the time of the May 6 closed-door interview, the DOJ had released documents showing each of those framings was inaccurate — Lutnick visited Epstein's island with his family in 2012, exchanged emails as late as May 2018, signed an investment agreement two days after his island visit in which Epstein was a co-signatory, and was a 2012/2016 benefit co-chair alongside Glen and Eva Dubin (themselves named in the prosecution memo). On May 6 he walked back several of the podcast claims and reinterpreted "I" in "I was never in the room" to mean "I, Howard Lutnick, unaccompanied by my wife" — a reinterpretation that other House members described in real time as not credible. When the committee released the transcript on May 13, 2026, mainstream coverage led with the blackmail walk-back and the "three meaningless meetings" framing: AP, CBS News, The Guardian.
2. THE PROPERTY — THE $10 DEED CHAIN
The most specific factual allegation in the FBI Prominent Names entry — that "Epstein sold Lutnick a home for $10 which was then sold for millions" (EFTA01660622 p.17) — turns out to be substantially documented in public real-estate records.

In the May 6 interview, Lutnick repeatedly testified he bought the home "from Charles de Gunzburg" and said he did not know it had previously been owned by Wexner or Epstein (transcript pp.30, 40–42). He did not volunteer the intervening "11 East 71st Street Trust" of which Epstein was trustee.
Corpus evidence the "11 East 71st Street Trust" remained active after Lutnick took title
A September 29, 2005 fax cover sheet — preserved in five different EFTA files plus DOJ-OGR-00032922 — is addressed to "Jeffrey E. Epstein" at "11 East 71st Street Trust". By 2005 Lutnick was already living at 11 East 71st. The fax was an unsolicited utility-tax-consulting pitch from "Metropolitan Refunds," not Epstein business — but its arrival at a Trust still bearing that address shows the entity persisted, on paper, after Lutnick moved in:

What the documents do NOT show
They do not show that Lutnick paid Epstein. They do not show that Epstein retained any interest in 11 East 71st after 1996. Real-estate documents are mediated through trusts and not all participants in a nominal transfer have substantive economic interest. They also do not show the actual $7.6M figure or the $4M mortgage in the EFTA corpus — those are derived from external real-estate journalism. What the documents do show is that the entity "11 East 71st Street Trust" continued to receive correspondence in Epstein's name as late as 2005.
Lutnick's testimony
Q: Did you know at the time that you purchased the home that the home had previously been owned by Jeffrey Epstein and Les Wexner?
A: I don't know. I knew I bought it from Charles de Gunzburg. ... When I bought the house, I didn't know. I don't recall knowing. (Transcript p.40)Q: That Jeffrey Epstein previously owned your home?
A: Yes. ... I don't know that to be true. (p.42)
Public real-estate records and the corpus contradict the "I don't know" framing. Wexner's SAM Conversion Corp. owned 11 E 71st with Epstein as VP, and a trust bearing the address remained linked to Epstein through 2005.
3. THE THREE ACKNOWLEDGED INTERACTIONS — AND WHAT THE EMAILS SHOW
Lutnick's opening statement (transcript pp.9–11) divides his Epstein contact into "three occasions in which I interacted with Epstein in person. Each and every one was meaningless and inconsequential."
Interaction #1 — 2005 coffee + house tour
Lutnick describes a 10–15 minute coffee in Epstein's living room shortly after moving in, followed by a tour that ended when Epstein opened a door to reveal a massage table with candles around it. Lutnick asked how often he had massages; Epstein responded "Every day, and the right kind of massage." Lutnick and his wife left, and on the walk back next door agreed he would "avoid him" (transcript pp.12–15, 44–47).
Interaction #2 — May 1, 2011 ("scaffolding")
Lutnick testified he stood "in the foyer with my dog" while Epstein "told me what he had to say. ... My best recollection was it had to do with scaffolding" (transcript p.32–33). This was confirmed by both calendar entries and email traffic in the corpus:

In the transcript, Lutnick disputes the "drinks" calendar label specifically ("I did not have drinks" — p.72), but accepts that this exchange led to the May 1 in-person meeting. The minority counsel walked him through the email chain step by step (transcript pp.79–81).
What the May 2011 thread shows that Lutnick's testimony does NOT
In the call rotation EFTA00435530, Lutnick was added to the same outbound call list as Leon Black, Boris Nikolic, Jes Staley, and John Brockman — the same names that recur as Epstein's repeat callers in 2011. (Lutnick was added via a separate note in the same email — "ALSO, HOWARD LUTNICK is available today..." — rather than appearing in the initial enumerated list.) Lutnick's testimony characterizes the call as inconvenience-driven ("we were unable to connect by phone" — p.32). The corpus shows it as a routine entry on Epstein's weekly call sheet, on the same list as named co-conspirators (Staley) and known associates (Black).
Interaction #3 — December 23, 2012 lunch on Little Saint James
This is the central evidentiary problem with Lutnick's "I was never in the room with him socially" framing. The chain in the corpus shows direct Lutnick-to-Epstein outreach.

The "TopTenDB.pdf" attachment Epstein sent Lutnick the morning after the lunch was a substantive Deutsche Bank document. (The full attachment is not in the corpus, only the cover email — see EFTA00398744.)
Lutnick's testimony on how the invitation came about
"What I still cannot understand is this November 20, how or why, without any communication for years would he inexplicably know where I'm going. It's unsettling, actually." (transcript p.22)
"I find it inexplicable and unsettling. ... I have no recollection. So I can't give you more information." (p.23)
The corpus contradicts this framing in two specific ways:
1. Lutnick personally emailed Epstein on Dec 19, 2012 with travel plans, captain logistics, the names of his guests (Michael and Marcy Lehrman), and the ages of all eight children involved (EFTA00399319). His own email proves he was an active counterparty in coordinating the visit, not a passive recipient of an "inexplicable" invitation.
2. Lutnick originally proposed Sunday dinner, not lunch. It was Epstein who changed it to lunch ("come sat or sunday lunch?" — EFTA00399319).
What the documents do NOT show
They do not show that anything inappropriate happened during the lunch itself. Lutnick testified no women under 25 were present and he saw nothing unusual (transcript pp.24, 84). The DOJ has released photographs of Lutnick on Little Saint James from the December 2012 visit (NBC News), confirming the visit but not depicting misconduct. There is no documentary evidence that Lutnick visited the island on any other occasion.
4. THE ADFIN INVESTMENT — AND THE SIGNATURE PAGES
In late 2012 / early 2013, Cantor Ventures (specifically the SPV "CVAFH I LLC") signed a Series A Preferred Stock Purchase Agreement to invest in AdFin Solutions, Inc., a digital-advertising-exchange startup. Epstein also invested — through Southern Trust Company.

Lutnick's testimony on AdFin
Q: When this agreement was signed in December of 2012, did you know that Mr. Epstein was also a signatory to the agreement?
A: No. (Transcript p.87)"I don't think I heard about this investment till 2013, May. I think the pitch was made to me in May of 2013, from the document. So it wasn't in December." (p.88)
Lutnick's counsel proffered to the committee that "when Cantor Fitzgerald Venture Capital signed these documents, it was in ... 2013 in the spring" — not the document's December 28, 2012 date. The committee did not have time to verify this proffer in the room and accepted it on the record (transcript p.87).
What the AdFin documents DO and do NOT show
They show a contemporaneous business co-investment in which Epstein and Lutnick signed consecutive counterpart signature pages to the same series-A round. They do not show Lutnick was a personal investor (he signed on behalf of "CVAFH I LLC," a Cantor Ventures SPV). They do not show the two men negotiated directly at signing — they show only that they ended up with adjacent pages in the same closing binder.
The May 2018 email exchange (six and a half years after the lunch, Lutnick's only directly-acknowledged email exchange with Epstein in the transcript) shows Lutnick did respond personally to Epstein (signed "HWL") on AdFin's financial prospects — a substantive business communication six months before the Miami Herald exposé and 14 months before Epstein's federal arrest.
What is significant
In the transcript Lutnick characterized his entire 2018 contact with Epstein as a single four-message exchange "in one day once" (transcript p.18). The Frick-expansion / AdFin / Pierre Hotel exchange (EFTA01050718 → EFTA01050772) is that exchange. He responded personally rather than via his assistant Matthew Gilbert. Six months later Epstein was on the cover of the Miami Herald.
5. THE PHILANTHROPY OVERLAP — DUBIN BREAST CENTER & UJA
Lutnick's "never in the room ... for philanthropy" framing on Pod Force One is contradicted by his decade-long co-chair role at the Dubin Breast Center at Mount Sinai, alongside Glen and Eva Dubin — Glen Dubin being named in the FBI Prominent Names entry as having a victim allegation of massage at Maxwell's direction (EFTA01660622 p.17; see LUTNICK_DUBIN_INVESTIGATION.md).

In the transcript (p.69), Lutnick acknowledged hosting this event but said "I did not [see Epstein at it]. And he wasn't there." That is consistent with the corpus — the invitation was forwarded TO Epstein but there is no RSVP or attendance record. The Cantor Fitzgerald 3rd-floor New York office hosting a Clinton presidential fundraiser, with the invitation routed to Epstein, is documented. Whether Epstein attended is not.

What the philanthropy evidence DOES and does NOT show
The documents establish a multi-year overlap in philanthropic circles — co-chairing benefits alongside the Dubins (2012, 2016), hosting a Clinton fundraiser that was routed to Epstein, and being the honoree at a UJA dinner to which Epstein donated $50,000. The Cantor Fitzgerald Relief Fund / Brioni event in January 2017 (EFTA00443752, EFTA02661285) is a similar pattern: Cantor invitation, addressed to Epstein, "Howard Lutnick would like to invite you."
The documents do not show that Lutnick personally invited Epstein to these events. They do not show Lutnick handled Epstein's donations. They do show that the Lutnick-led organizations (Cantor Relief Fund, his philanthropic co-chair seats) treated Epstein as part of the contributor universe — and that Paulson, as UJA Wall Street Division chair, considered Epstein a "close friend of the Lutnicks." The latter framing is John Paulson's characterization, not corroborated independently.
6. THE NANNY AND THE STAFF DIRECTION
In October 2013, Richard Kahn (Epstein's accountant and co-executor; see WITNESS_BRIEF_KAHN.md) forwarded the résumé of a person identified in the file as "Emily Dawson" to Epstein, describing her as the "Lutnick nanny":

Lutnick's testimony:
Q: As we've seen from the Epstein files that have been released, it appears that a nanny that was in your employ had sent her resume to Mr. Epstein. Do you know anything about that?
A: I have no knowledge about it at all. ... That's correct. None.
Q: Do you know whether that person whose resume was sent to Mr. Epstein's staff was one of the nannies who accompanied your family on your visit to his island in December 2012?
A: I don't know. (Transcript pp.71, 94)
What the document DOES and does NOT show
The document shows a person identified by Kahn as the "Lutnick nanny" had her résumé forwarded to Epstein, and Kahn was actively scheduling an in-person meeting between her and Epstein via someone named "Peter." It does NOT show whether the nanny initiated the contact, whether she ever met Epstein, whether she was hired by Epstein, or whether she had been on the December 2012 island trip. The committee did not produce evidence answering any of those follow-up questions.
The document is significant principally because Richard Kahn — who controlled Epstein's finances and was named co-executor of the estate (see WITNESS_BRIEF_KAHN.md) — was directly handling staffing inquiries from someone Lutnick claims he had "no personal or professional relationship" with. The route Kahn proposed ("via Peter") implies a known intermediary.
7. THE NTOC TIPS AND THE FBI 302 — SIMON ANDRIESZ
The FBI's "Prominent Names" briefing page on the Epstein case (EFTA01660622 p.17) lists Lutnick alongside named alleged abusers. The Lutnick allegation is purely financial, not sexual — making him the only person on the page with that profile.

1. Simon Andriesz reported that Lutnick made his money through Ponzi schemes and money laundering. Lutnick and Epstein were neighbors and Epstein sold Lutnick a home for $10 which was then sold for millions. (EFTA01660622 p.17)
The same entry appears in four other versions of the FBI briefing: EFTA01656152 p.17, EFTA01656173 p.17, EFTA01656198 p.17, EFTA00164939 p.17, EFTA01648946 (4-page version with the Lutnick entry on p.1, the only one where "Simon Andriesz" is in unredacted form). The cross-document existence of these copies tells you the entry was an FBI working analytical product, not a one-off mention.

Source-reliability note
Per the project standard, the FD-302 is a Tier 1 source (sworn FBI 302) — but its evidentiary value is limited to documenting what Andriesz said to the FBI, not the truth of those allegations. Andriesz himself is a single-source tipster with a clear grievance against Cantor Fitzgerald (he claims the firm caused him a heart attack and seven hospitalizations). His allegations remain unsubstantiated in the corpus. No criminal case was opened against Lutnick on the basis of these tips, as the January 30, 2025 vetting memo confirms.
What this body of FBI material DOES and does NOT show
It shows that the FBI received serious allegations from an identified UK-based whistleblower against Lutnick across two separate NTOC contacts (Oct 14 + Oct 19, 2020), conducted a formal 302 interview with him in February 2021, and ran database queries that surfaced 26 NY case-file results, three SARs, a restricted closed money-laundering case, and a RICO real-estate control file with Lutnick's name in them. It does NOT show what any of those underlying case files actually contain — most are referenced only by serial number. It does NOT show whether the SARs were filed by banks against Lutnick or against entities he controlled. It does NOT corroborate Andriesz's allegations on the merits.
For Congress, the actionable question is not whether Andriesz is correct, but whether the FBI's January 2025 decision not to open an investigation — issued in the same memo that confirmed Lutnick was named in 26 NY case files — was warranted given the universe of records.
8. CONTEMPORANEOUS PROXIMITY TO TRUMP — THE iMESSAGE
The single most consequential document in the corpus tying Lutnick into the Trump-Epstein orbit is an iMessage thread from Epstein's phone, dated May 13, 2019 — eight weeks before Epstein's July 6, 2019 arrest at Teterboro Airport.

The sender identification ("Po") and the timing of the exchange — two days before Epstein forwarded the Frick / AdFin / Pierre exchange to Lutnick on May 28 (EFTA01050772) — indicate this is a contemporaneous data point about Trump's planned attendance at an event at Lutnick's house.
Lutnick's transcript answers on Trump
The transcript shows Lutnick repeatedly refusing to answer questions about conversations with Trump:
Mr. Subramanyam: Have you had conversations with President Trump about Jeffrey Epstein or the Epstein files generally or your involvement with any?
Secretary Lutnick: I'm not going to discuss conversations I had with the President, but you shouldn't take it one way or the other. ... I'm just not going to have any discussion on it. What the documents DO and do NOT show
The iMessage establishes that someone in Epstein's contact network was reporting Trump's whereabouts at Lutnick's residence in May 2019. It does NOT identify the sender. It does NOT prove Trump actually attended, prove what the gathering was, or prove Lutnick was even aware in advance. Trump and Lutnick had a long-running relationship — by Lutnick's own testimony (p.92), "more than 30 years."
What is significant is that Lutnick declined to answer questions about Trump-Epstein conversations without invoking executive privilege through the formal process required by House rules. His counsel ultimately reframed the objection as "asked and answered" rather than a privilege assertion. That ambiguity — refusal-to-answer without a recognized privilege basis — is itself a record.

12. COUNTER-STRATEGIES — HOW LUTNICK'S TEAM IS LIKELY TO FRAME GAPS
The "I, Howard Lutnick" reinterpretation
The transcript's central rhetorical move was Lutnick's reinterpretation of "I was never in the room with him socially" to mean "I, Howard Lutnick, unaccompanied by my wife, was never alone in a room with him" (transcript pp.48–53). The minority counsel pressed this for ten transcript pages without obtaining a literal-grammatical concession.
Counter: This is a reading of "I" that would not survive any standard of English usage. The Pod Force One transcript already contains a parallel construction ("I was never in the room with him for business") — businesses are not conducted alone. The natural reading is "I, Howard Lutnick" as the speaker — meaning the simple subject of the verb — not "I as opposed to we." Future questioning should not concede this reinterpretation but instead press the literal grammatical reading and ask Lutnick to either (a) acknowledge the original podcast statement was inaccurate or (b) explain why his October 2025 listeners should have inferred the qualifier.
"I was just speculating for a podcast"
On the "greatest blackmailer ever" claim and the "videos in exchange for the plea deal" claim, Lutnick repeatedly invoked "I was just speculating for a podcast" (transcript pp.18, 54–55, 73–74).
Counter: This frame is unstable. Either Lutnick was speculating wildly about Epstein's behavior with no factual basis — in which case the speculative claims he chose to broadcast were specifically about blackmail, videos, and the DOJ plea deal — or he was drawing on actual knowledge. If the former, the relevant follow-up is: "Why did you choose to speculate, on a public podcast, in those specific lurid directions rather than any other?" If the latter: identify the knowledge source.
"Inexplicable and unsettling"
Lutnick used "inexplicable and unsettling" as a stock phrase at least six times to characterize Epstein's apparent knowledge of his travel plans and the AdFin signature-page co-presence.
Counter: The corpus provides a direct explanation that is not inexplicable: Lutnick personally emailed Epstein with his travel plans on Dec 19, 2012 (EFTA00399319). The "inexplicable" framing presupposes Lutnick did not initiate; the contemporaneous email shows he did.
Executive privilege without invocation
Lutnick's counsel deferred Trump-related questions to "executive privilege" but did not invoke it through the Rule 16(c)(1) process — and ultimately reframed as "asked and answered."
Counter: The committee can demand a written privilege log identifying each topic withheld and the formal basis. Failure to provide that log means the questions are simply being refused, not privileged — exposing the witness to potential contempt if a future deposition reaches them under compulsion.
"Matthew Gilbert handled everything"
Lutnick repeatedly stated that emails addressed to "Lutnick, Howard" went to his longtime assistant Matthew Gilbert — "they were not — meaning, I would never see them" (transcript p.22).
Counter: Three of the May 2018 emails are signed "HWL" — Lutnick himself. Lutnick conceded these were him (transcript p.29). The "Matthew Gilbert handled all of it" framing therefore does not cover the substantive 2018 communications. Future questioning should focus exclusively on the HWL-signed exchanges.

The Andriesz tip (Tier 3 as an allegation) is corroborated as a deed-record fact (Tier 1) — the $10 nominal consideration is recorded on the actual deed, per Newsweek (Tier 2). What is NOT corroborated is the implied criminality. A $10 deed transfer following a trust restructuring is standard real-estate practice. The actual purchase price was $7.6M (transfer-tax records). The fact pattern is real; the inference of money laundering remains unsubstantiated.

Lutnick's "I" interpretation. Two readings of his Pod Force One statement coexist in the record: (a) the natural-language reading on which most listeners and journalists relied (he was claiming he had no in-person contact with Epstein after 2005); (b) Lutnick's May 2026 reinterpretation (he was claiming only that he, alone, without his wife, never set foot in a room with Epstein). Reading (a) is contradicted by the corpus. Reading (b) is consistent with the literal Latin "I" — but inconsistent with the verbal context "for business, or even philanthropy" which describes activities Lutnick conducted with his wife at Dubin Breast Center events.

"Glenn Dubin may stop by." The May 1, 2011 day-of-schedule (EFTA00307005) places Lutnick's 5pm appointment 90 minutes before a Woody Allen dinner at which "Glenn Dubin may stop by." Lutnick claims he was in the foyer for the scaffolding discussion only (transcript p.32–33). Whether Dubin or Lutnick overlapped is not documentary in the corpus — but the same-day rotation matters for the broader picture of Lutnick's placement in Epstein's social network.
14. NEWSWORTHY FINDINGS THE TRANSCRIPT SURFACES
Five findings emerge most clearly from cross-referencing the transcript with the corpus:

Lutnick personally initiated the December 2012 island contact. The committee's framing during questioning treated the 2012 visit as an Epstein-initiated approach. The corpus (EFTA00399319, EFTA02151286) shows Lutnick personally emailed Epstein "Hi Jeff" with travel plans, captain logistics, guests by name, and children's ages on Dec 19, 2012. He originally proposed dinner, not lunch. This single email transforms the visit from "inexplicable invitation" into active coordination.

The deed chain at 11 East 71st Street is a fact pattern, not a conspiracy theory. The $10 sale-price story from the Andriesz NTOC tip — Wexner's SAM Conversion Corp. → 11 East 71st Street Trust (Epstein trustee) → Comet Trust → Lutnick — is documented in public real-estate records and confirmed in corpus material (EFTA00263278, EFTA00263107). A trust by that exact address persisted in Epstein's correspondence through 2005 (EFTA01304561 p.13 and seven duplicates).

The FBI has substantially more on Lutnick than the single NTOC tip on the Prominent Names page. The April 23, 2021 Guardian complaint (EFTA01249210) records 26 NY case-file hits for Lutnick, including a restricted closed money-laundering case (272D-NY-306108) and a RICO real-estate control file (194-NY-C277070-B). DIVS returned 34 results including three SARs. The FBI declined to open an investigation in January 2025 despite all of this. Congress has never seen those underlying case files; the May 6 interview did not press on them.

The May 13, 2019 iMessage about Trump. Two months before Epstein's arrest, an iMessage from Epstein's phone (HOUSE_OVERSIGHT_027694) reads: "Trump is coming to Lutnick's house Thursday." Lutnick refused to discuss Trump conversations without formally invoking executive privilege. The iMessage itself was not introduced as an exhibit during the interview.

The AdFin co-signature, the May 2018 emails, and the Christmas Eve TopTenDB attachment together break the "meaningless and inconsequential" framing. Lutnick signed the AdFin Series A Preferred Stock Purchase Agreement on a counterpart page directly adjacent to Epstein's signature for Southern Trust Company (EFTA00289560 pp.20–21). The morning after the December 2012 island lunch, Epstein sent Lutnick a Deutsche Bank document called "TopTenDB.pdf" (EFTA00398744). In May 2018, six months before the Miami Herald series, Lutnick personally — not through Gilbert — emailed Epstein with substantive business analysis (EFTA01050772). None of these are "inconsequential."
15. WHAT THE TRANSCRIPT IS GOOD FOR
Despite its limitations as a voluntary off-camera transcribed interview, the May 6 record establishes several useful facts for the public record:
- Lutnick conceded the 2012 island visit happened. Pre-transcript, this was contested; post-transcript, it is on the record (pp.21, 24, 50).
- He conceded the 2011 scaffolding meeting happened. Same (pp.32–33).
- He conceded the May 2018 email exchange was him personally. Same (p.29).
- He conceded he attended the December 2012 lunch as a "social lunch" with his family (p.50) — directly contradicting his October 2025 podcast claim that he was "never in the room with him socially."
- He conceded he was speculating on Pod Force One about Epstein being a blackmailer, the existence of videos, and the trade-for-plea-deal theory (pp.54–55, 73–74). That concession is the substantive abandonment of his most newsworthy public statement about Epstein.
The record is therefore valuable as a baseline of admitted contact — the floor below which Lutnick cannot retreat in any subsequent proceeding.
