United States v. Epstein

United States v. Jeffrey Epstein was a federal criminal prosecution brought in the Southern District of New York. A grand jury returned a sealed two-count indictment on July 2, 2019 charging Epstein with conspiracy to commit sex trafficking of minors, in violation of 18 U.S.C. § 371, and sex trafficking of minors, in violation of 18 U.S.C. § 1591. The indictment alleged that, from at least 2002 through at least 2005, Epstein recruited and paid dozens of minor girls—some as young as 14—to engage in sex acts at his Manhattan residence and his Palm Beach, Florida estate, and that he paid certain victims to recruit additional girls. Epstein was arrested at Teterboro Airport in New Jersey on July 6, 2019 and presented in S.D.N.Y. the following day.

The case was assigned to United States District Judge Richard M. Berman. After an initial conference on July 8, 2019 and a contested bail hearing on July 15, 2019, Judge Berman issued a 33-page Decision and Order on July 18, 2019 denying bail and remanding Epstein pending trial under the rebuttable-presumption framework of 18 U.S.C. § 3142(e)(3)(E). The defense team—Reid Weingarten and James Brochin of Steptoe & Johnson, Martin G. Weinberg, and Marc Fernich—moved to file Epstein's supplemental financial disclosure under seal and continued to litigate discovery, protective-order, and pre-trial detention issues at the Metropolitan Correctional Center (MCC), where Epstein was held in the Special Housing Unit known as 9 South.

On the morning of August 10, 2019, while the case was pending and before any trial or other disposition, Epstein died at the MCC. The Office of the Chief Medical Examiner of New York City ruled the death a suicide by hanging. On August 19, 2019, the United States Attorney's Office moved for an order of nolle prosequi, and on August 27, 2019 Judge Berman convened a public hearing—over the objection that a deceased defendant's case should be dismissed without ceremony—so that counsel for the Government, counsel for the deceased defendant, and the alleged victims could be heard pursuant to the Crime Victims' Rights Act, 18 U.S.C. § 3771. On August 29, 2019, Judge Berman entered the nolle prosequi, dismissing the indictment under the rule of abatement on death of the defendant. The case is closed; the underlying investigation, FBI file 50D-NY-3027571 / 31E-NY-3027571, continued and ultimately produced the separate prosecution of Ghislaine Maxwell.

The email portion of the corpus consists largely of routine litigation correspondence among AUSAs (the prosecution team identified on the docket as Rossmiller, Comey, and Moe, supervised by U.S. Attorney Geoffrey S. Berman), defense counsel, FBI case agents, and the SDNY Victim/Witness Unit—including coordination of victim interviews after the August 10 death (EFTA00017755) and unsolicited tip emails routed to the Victim/Witness Coordinator (EFTA00151173). The corpus also includes a 2006 Palm Beach Police Department incident report attached as an exhibit to a July 12, 2019 bail filing (EFTA02824217), illustrating the Government's reliance on pre-2008 Florida investigative records to establish the historic pattern of conduct underlying the SDNY indictment. The sample does not include the grand-jury transcripts, the sealed financial disclosure, or the underlying FBI investigative file (which is held under separate FBI case numbers and is the subject of separate briefings); readers should treat this docket as the public criminal-court record only, not the investigative file behind it.
