DEFENDANT / COUNTERCLAIM PLAINTIFF ALAN DERSHOWITZ'S MEMORANDUM IN OPPOSITION TO NON-PARTY BOLES, SCHILLER & FLEXNER LLP'S MOTION TO OUASH OR FOR PROTECTIVE ORDER Defendant / Counterclaim Plaintiff Alan Dershowitz ("Dershowitz") respectfully submits this Memorandum in Opposition to the Motion to Quash or for Protective Order Regarding Subpoena (the "Motion to Quash") filed by non-party Boies, Schiller & Flexner LLP ("BSF'). Dershowitz also refers the Court to his memorandum in opposition to Jane Doe No. 3's motion to quash the subpoena served on her for additional details about the nature of this case and why Dershowitz is entitled to the discovery he seeks.' INTRODUCTION The Court should deny the Motion to Quash because the subpoena duces tecum served on BSF by Dershowitz is entirely proper and seeks the production of relevant, non-privileged Jane Doe No. 3 has no right to proceed anonymously as she has been identified publicly on several occasions and has made public statements to the media using her own name, as indicated by the exhibits that she submitted with her motion to quash. See Jane Doe No. 3's Motion to Quash, Exs. 1-4. Nonetheless, Dershowitz will refer to her as "Jane Doe No. 3" until the Court orders otherwise. EFTA01206865
