FOUNDATION'S AMENDED STATEMENT OF CLAIM 1. Claimants Financial Trust Company, Inc. ("FTC") and The C.O.U.Q. Foundation, Inc. ("COUQ") (collectively, "Claimants"), submit the following amended statement of their claims against The Bear Steams Companies, Bear Stearns & Co., Bear Steams Asset Management ("BSAM"), and Warren Spector ("Spector") (collectively "Bear Steams"). These claims arise out of the collapse in the summer of 2007 of a group of hedge funds managed by Bear Stearns. Claimants invested $40 million in these funds, and almost all of these investments, plus the interim profits, have been wiped out. To date, Claimants' base damages, with interest, exceed $45 million. Introduction 2. At all times relevant to the claims stated herein, Claimant FTC was a corporation owned and managed by Jeffrey Epstein ("Epstein"), a wealthy and successful investor.
