United States Virgin Islands v. JPMorgan Chase Bank, N.A.

Government of the United States Virgin Islands v. JPMorgan Chase Bank, N.A. was a federal civil action filed in the Southern District of New York on December 27, 2022 by the Attorney General of the U.S. Virgin Islands, acting parens patriae on behalf of the Territory and the V.I. Department of Licensing and Consumer Affairs. The Second Amended Complaint (EFTA00145666) brought claims under the federal Trafficking Victims Protection Act, 18 U.S.C. §§ 1591–1595, the Virgin Islands Criminally Influenced and Corrupt Organizations Act, and the Virgin Islands Consumer Fraud and Deceptive Business Practices Act. The case was assigned to Judge Jed S. Rakoff and consolidated for discovery and pretrial purposes with a parallel putative class action, Jane Doe 1 v. JPMorgan Chase Bank, N.A., No. 22-cv-10019 (S.D.N.Y.), filed approximately a month earlier.

The Government alleged that JPMorgan, which served as Epstein's primary financial institution from roughly 1998 through 2013, knowingly facilitated and concealed wire and cash transactions used to pay recruiters and victims of Epstein's trafficking operation centered on his Little St. James and Great St. James estates in the U.S. Virgin Islands; that it failed to comply with Bank Secrecy Act and USA PATRIOT Act anti-money-laundering obligations, including the duty to file Suspicious Activity Reports and Currency Transaction Reports; and that senior executives — including the former CEO of the bank's asset management division — advocated retaining Epstein as a client because of his own financial footprint and the deals and clients he brought to the bank. The action stemmed from a parallel V.I. CICO enforcement action against the Epstein Estate (Government of the U.S. Virgin Islands v. Indyke et al., ST-20-CV-14, Super. Ct. V.I.).

In March 2023, JPMorgan filed a third-party complaint against its former private bank executive Jes Staley, seeking contribution and indemnification on the theory that any liability the bank incurred was the product of Staley's personal misconduct. The Staley third-party action was litigated in parallel under the same docket caption ("JPMorgan Chase Bank, N.A. v. James Edward Staley"). Discovery proceeded on an expedited schedule before Judge Rakoff and produced an extensive sealed and partially-unsealed record of internal JPMorgan compliance materials, KYC reviews, and executive correspondence. On September 26, 2023 the Government and JPMorgan announced a $75 million settlement of the USVI action; the parallel Doe 1 putative class action against the bank was separately settled in June 2023 for approximately $290 million. The case is closed at the trial-court level.

The corpus contains 1,610 EFTA-stamped pages and 1,090 emails linked to docket 22-cv-10904, drawn predominantly from the case's voluminous summary-judgment and Daubert-stage exhibit record. Document types in the sample include the Second Amended Complaint (EFTA00145666), pro hac vice motions and declarations for both Government and Staley counsel, third-party-practice filings naming Jes Staley as third-party defendant, an attorney declaration in support of the Government's motion to exclude JPMorgan's three retained experts (EFTA02816986), Rule 45 third-party subpoenas issued by Government counsel (EFTA02806341), and a federal grand jury subpoena issued by the District of the Virgin Islands U.S. Attorney's Office to the Epstein Estate seeking the same materials produced to JPMorgan's outside counsel WilmerHale (EFTA00129042). A large fraction of the sample consists of numbered trial- and motion-stage exhibits — many filed under seal as exhibit cover sheets only — attached to the parties' Rule 56 statements and motions in limine in the run-up to the scheduled October 2023 trial.

The substantive exhibits in the sample are dominated by internal JPMorgan correspondence produced under the JPM-SDNYLIT Bates series. The emails span 2006 through 2019 and include: a July 2006 exchange between Jes Staley and asset management head Mary Erdoes about contemporaneous Palm Beach Post reporting on Epstein, in which Staley wrote that he had visited Epstein the prior night and that Epstein "adamently denies the ages" (EFTA02810781); 2007 internal correspondence about extending a new letter of credit to Epstein and continuing the relationship despite "existing LC" exposure (EFTA02811293); a March 2012 high-risk-client KYC approval thread escalated to Erdoes (EFTA02808009); 2013 exit-discussion threads between U.S. Private Bank CEO John Duffy, Erdoes, and others negotiating an "orderly transition" out of the Epstein relationship roughly five years after his 2008 plea (EFTA02811762, EFTA02812837, EFTA02813328); and a February 2019 email from Epstein's longtime assistant Lesley Groff to Erdoes referring a new private-banking prospect on Epstein's behalf (EFTA02816392). The exhibit record also includes Estate-of-Epstein-produced emails between Epstein and Cecile de Jongh — then a senior officer of Epstein's V.I. entity Southern Trust Company and wife of the V.I. governor — about V.I. customs, Economic Development Commission filings, immigration paperwork for women associated with Epstein, and contractor payments to a sitting V.I. senator (EFTA02808149, EFTA02808445, EFTA02814031, EFTA02815574). One large attachment in the sample is the Government's Rule 56.1 counter-statement (EFTA02815448), an 86-page document discussing V.I. Department of Justice sex-offender address verification "sweeps" of Epstein's St. Thomas property in conjunction with the U.S. Marshals Service. The corpus also contains JPMorgan's 2006 Senior-Level Code of Conduct affirmation record (EFTA02818276), used as an exhibit on the bank's internal compliance regime. The corpus does not contain a copy of the final settlement agreement, the trial record (the case settled before trial), or the full set of sealed exhibits whose cover sheets appear in the production.
