Background

On May 1, 2020, Ghislaine Maxwell filed a three-count complaint in the Superior Court of the Virgin Islands against the Estate of Jeffrey E. Epstein, Co-Executors Darren K. Indyke and Richard D. Kahn, and NES, LLC, a New York limited liability company administered as part of the Estate. The complaint sought common-law and contractual indemnification and advancement of attorneys' fees, security costs, costs of safe accommodation, and other expenses incurred by reason of Maxwell's prior employment relationship with Epstein. Maxwell premised her claims on a purported promise by Epstein 'to support her financially' allegedly made approximately fourteen years earlier, and on her belief that NES's organizational documents entitled her to mandatory indemnification (EFTA02821977; EFTA02822253).

The Co-Executors moved to dismiss on May 1, 2020, arguing that 15 V.I.C. § 606(a) barred the action because it was filed before the one-year waiting period following issuance of letters testamentary (issued September 6, 2019 by Magistrate Judge Carolyn P. Hermon-Percell), and that NES's operating documents conferred no indemnification right (EFTA02821977). On June 1, 2020 the parties jointly moved to stay the case until September 7, 2020, when the statutory waiting period would expire (EFTA02822002). On July 12, 2020 — ten days after Maxwell's federal arrest in New Hampshire — the Government of the United States Virgin Islands moved to intervene under V.I. R. Civ. P. 24, citing its parallel Criminally Influenced and Corrupt Organizations Act (CICO) action against the same Estate defendants (Gov't of the U.S. Virgin Islands v. Indyke et al., No. ST-20-CV-14) and an unserved CICO investigatory subpoena directed to Maxwell (EFTA02822177; EFTA02822116). Maxwell opposed both intervention and dismissal in September 2020 (EFTA02822203; EFTA02822253), and the Co-Executors filed reply briefs (EFTA02822271; EFTA02822306).

Following Maxwell's federal conviction on December 29, 2021 and her June 29, 2022 judgment in United States v. Maxwell, 20-cr-330 (S.D.N.Y.), the Co-Executors filed a supplemental brief on August 1, 2022 arguing that public policy bars indemnification of a person convicted of intentional criminal wrongdoing (EFTA02822372). On September 7, 2022 the Superior Court permitted Maxwell's counsel to withdraw and ordered her to obtain new counsel within sixty days; she did not comply. A second order on March 17, 2023 again gave her sixty days; she again failed to obtain counsel or appear pro se. On September 19, 2023, the Co-Executors moved to dismiss for failure to prosecute under V.I. R. Civ. P. 41(b) (EFTA02822421), and Presiding Judge Harold W.L. Willocks granted the motion the same day, dismissing the complaint (EFTA02822433).
