Presently before the Court is a Motion to Dismiss and Brief in Support filed by Defendant alleging that no justiciable claim or controversy exists. Doc. nos. 3, 4. Plaintiff filed a Response and Brief in Opposition to the Motion to Dismiss. Doc. nos. 7, 11. Defendant filed a Reply Brief. Doc. no. 18. The matter is now ripe for adjudication.
