In choosing to file suit, Plaintiff/Counter-Defendant Jeffrey Epstein ("Epstein") was well-positioned to recognize the potential exposure that existed at the time the suit was filed, specifically that a malicious prosecution case could have been pursued by Defendant/Counter-Plaintiff J. a"), in the event that Epstein was unsuccessful in prosecuting the underlying complaint. Epstein nonetheless chose to file suit with constructive knowledge of this potentiality. 2.
