Obviously this is a rough that does not protect us, which is why we will have to include provisions so that the intermediary doesn't go around us. Also, it doesn't mention compensation, which should be clearly stated so that there are no misunderstandings and that both the costs and commissions can be taken off the top when the settlement is paid, and we not have to wait for the government to reimburse our costs and pay our commissions. Understand that aside from the rights/mandate, we want this agreement to enable financing the litigation and PR assault that GS will surely try to mount.. So make sure that the mandate reflects everything needed to give you comfort to finance our efforts.. And forget the text draft, because ultimately we need to craft an agreement that gives us maximum flexibility and protects us. So get your attorneys to write exactly what we need. As soon as you do, I will get our guys in Libya to get the government to sign it and then they want to come to NYC to work with you to get things started....
