There was a COE permit for a concrete ramp ( the one that exists now) and a floating dock. The fixed dock that is there was never permitted by COE. NMFS said it was too shallow of a bay, and yet they chose to build it anyway. I have a hard time imagining the COE did not notice it until we asked to fix it....especially when Jose Cedeno landed on it when we had the wetland delineations approved. I think we can make a good argument that you need to barge landing for larger items and to remove trash etc, and that it will have less environmental impact. As to the access docks, I think we can justify one especially since we need to remove the one in Shallow Bay to make COE happy. Getting two might be harder, unless you did show different ownership of parcels. But then as you stated we would have to have a reason for the dock to be on the parcel (building).
