The hackers have an old contact list from one of you, so one of your accounts has been compromised. Mindspring has had multiple wide-reaching breaches over the years -- their infrastructure is decades old and poorly maintained -- so it's more likely that the address book was garnered from his side. (Compromising an account and downloading the previous recipients was common a couple years back.) But. It would be a good idea for both of you to change your passwords.
