Box 301707, Charlotte Amalie, St Thomas, VI 00803-1707 and Thomas World Air LLC, hereinafter referred to as the Tenant. 1. The intended purpose of this understanding is to establish clear procedures and guidelines for access to the Airport Operations Area (AOA) from any gate or door in the Cyril E. King Airport Terminal and from any location with access points to the Airport Operations Area (AOA) through Terminal Gates, Terminal Doors, and other Vehicle access points. 2. This MOU includes methods for preventing the entry of unauthorized persons and ground vehicles onto the AOA, and establishes clear accountability for payment and settlement of any Fees, Penalties or other monetary Fines or disciplinary actions levied against the Tenant or Employee of the Tenant who fail to comply with the Airport Security Plan and 49 CFR 1542. 3. All persons who are authorized to access the AOA, or are required to monitor the access of persons entering the AOA through designated access points at their Leased premises or through authorized Terminal Gates, will be responsible for any Fees, Penalties or other Monetary Fines, levied against them by the VIPA and the TSA, whenever there is a breach or security violation at that location. 4. The Virgin Islands Port Authority will not incur any monetary fees, penalties or fines that are levied against any Airport Tenant, Airport FBO, Airport Employee or other Unauthorized persons who gain entry from a Passenger Gate, Fixed Base Operator(FBO) Access Gate, or other area that is under the control of the Airport Tenant, Airline or Fixed Base Operator (FBO).
