I think that the response previously given by was that the case began as a State prosecution and he believed that it should remain as a State prosecution, so long as certain minimum levels of punishment were satisfied — namely sex offender registration, some amount of imprisonment, and restitution/damages for the victims. The deal that had been worked out with the State before out intervention was either pre-trial diversion or a misdemeanor plea with no jail time and no sex offender registration. The rest of the questions relate to issues outside of our control. Since Epstein pled to State charges, his conditions of imprisonment and supervision were determined exclusively by the Palm Beach County Sheriff's Office, as was the calculation of his gain time and his eligibility for work release.
