During the investigation, DVR systems, which stored recorded video of cameras within the New York Metropolitan Correctional Center (MCC), were seized from MCC. After the video was extracted, the video was uploaded by a unit within FBIHQ OTD to a system within OPWAN, called UK. The video could only be reviewed, not downloaded, by the case team. There were no missing minutes during this original upload. DOJ OIG requested a copy of the video due to DOJ OIG not having access to the FBI software. The download had to be requested through OTD and the video was put on a hard drive and given to DOJ OIG, and SDNY, in approximately late 2019 or early 2020. FBI New York handed over this copy of the video to aid in DOJ OIG's investigation. FBI New York did not request this copy back nor did DOJ OIG return the copy. FBI New York closed its investigation in May 2022. The two defendants who were charged in November 2019 had entered into a deferred prosecution agreement with the Southern District of New York (SDNY) and by May 2022, that agreement had been satisfied. At this time, the DOJ OIG was still conducting its investigation. With concurrence from the SDNY AUSA and FBI New York C19 SSA, all evidence, to include CART derivative evidence, was transferred to DOJ OIG, as the evidence was still pertinent to DOJ OIG's investigation.
