FD-302 (Rev. 5-8-1(1) -1 of 2- OFFICIAL RECORD Date ofentry 08/20/2019 , was interviewed in the offices of Special Investigations Unit of the Metropolitan Correctional Center located at 150 Park Row, New York NY 10007. Present during this interview was FBI SPECIAL AGENT FBI SPECIAL AGENT FEDERAL BUREAU OF INVESTIGATION , OIG SPECIAL AGENT , BOP LT. and myself. After being advised of the identity of the interviewing Agent and the nature of the interview, provided the following information: stated that he has been in MCC since March 4, 2019. also informed us that he knows what happened but that did not want to speak without his lawyer present. continued to speak and offered information anyway. stated that JEFF (as he referred to the victim) often complained about the machine. described a CPAP machine once asked to clarify. also stated that his cell mate JOHNNY CONTRERAS also saw everything but that he would never speak as he is a member of the MS 13 and that would get his family killed. stated that the guards never did their rounds/checks as they were supposed to. The last check was made sometime between 12:30AM - 1:00AM. The male black stayed by the door and the female black walked through the tier but did not walk all the way in. stated that they (meaning guards) noticed that JEFF was dead during breakfast and during the head count. was asked who entered the cell after the discovery to which answered, the male guard. This male guard entered and started to perform CPR (cardiopulmonary resuscitation). stated that the female guard stayed outside the cell and described her as being panicked. stated that when the door was opened, JEFF was on the floor. was able to see that the rope was not over his (JEFF's) head. The observed the body being removed and the guards had the rope in hand and defibrillator. stated that he did not see marks on JEFF's neck but did see bruising to the face.
